measures to establish appropriate mechanisms to ensure<br />
protection of all women from domestic violence which should<br />
be treated as a criminal offence punishable by law (Article 69).<br />
Although Kosovo is not a member of the European Union, very<br />
soon she will be required to make a series of commitments in<br />
terms of recognition, harmonization of legal and structural<br />
framework of the justice system with EU standards, such as:<br />
• Documents on human rights principles which refer to<br />
United Nations treaties and other documents according to<br />
which violence against women is violence of fundamental<br />
human rights. Such documents include ECHR, the European<br />
Social Charter, European Convention for the Prevention and<br />
Treatment of Torture and cruel or degrading punishment.<br />
• European Union Instruments - signing of the SAA produces<br />
a set of commitments in terms of recognition, harmonization<br />
of legal and structural framework of the justice system with<br />
these standards. The EU has addressed gender equality<br />
through a series of directives, resolutions, recommendations<br />
and acts issued by the Council of the European Union,<br />
European Commission and European Parliament.<br />
In the implementation of the above international acts and in<br />
accordance with social conditions, culture and tradition in<br />
building family relationship, the state of Kosovo has developed<br />
its legal mechanisms to combat domestic violence.<br />
• UNMIK promulgated the Regulation 2003/01, v.2003 "On<br />
amending the law on criminal acts related to sexual<br />
violence", considering the act of rape in marital relation as<br />
offence.<br />
• In May 2003, UNMIK adopted the Regulation on Protection<br />
against Domestic Violence 2003/12, giving the power to the<br />
courts for issuing protective orders as a civil remedy.<br />
