APC, describing the<br />

allegati<strong>on</strong> that he is a<br />

Camero<strong>on</strong>ian <str<strong>on</strong>g>as</str<strong>on</strong>g> puerile,<br />

face-saving, vexatious,<br />

absolutely and completely<br />

unfounded.<br />

Atiku, in his resp<strong>on</strong>se to<br />

preliminary objecti<strong>on</strong> APC<br />

filed to challenge his petiti<strong>on</strong><br />

against the declarati<strong>on</strong> of<br />

President Muhammadu<br />

Buhari <str<strong>on</strong>g>as</str<strong>on</strong>g> winner of the<br />

February 23 presidential<br />

electi<strong>on</strong>, maintained that he<br />

is a full blooded Nigerian.<br />

He urged the presidential<br />

electi<strong>on</strong> petiti<strong>on</strong> tribunal<br />

sitting in Abuja to ignore<br />

what he termed <str<strong>on</strong>g>as</str<strong>on</strong>g><br />

“extraneous facts,<br />

c<strong>on</strong>tradictory, diversi<strong>on</strong>ary,<br />

ev<str<strong>on</strong>g>as</str<strong>on</strong>g>ive, speculative and<br />

vague <str<strong>on</strong>g>as</str<strong>on</strong>g>serti<strong>on</strong>s,” by APC<br />

and President Buhari.<br />

Atiku told the tribunal that<br />

c<strong>on</strong>trary to APC’s allegati<strong>on</strong><br />

that he is an alien, he said he<br />

is a Nigerian by birth and a<br />

Fulani by tribe.<br />

He told the tribunal that he<br />

h<str<strong>on</strong>g>as</str<strong>on</strong>g> been a Nigerian politician<br />

for about 30 years, adding that<br />

in 1992, he c<strong>on</strong>tested in the<br />

presidential primaries <strong>on</strong> the<br />

platform of then Social<br />

Democratic Party, SDP,<br />

al<strong>on</strong>gside the late Chief M.K.O<br />

Abiola and Amb<str<strong>on</strong>g>as</str<strong>on</strong>g>sador Baba<br />

Gana Kingibe.<br />

He said: “C<strong>on</strong>trary to the<br />

allegati<strong>on</strong>s c<strong>on</strong>tained in<br />

paragraphs 1, 2, 3, 4, 5 and 6<br />

of the 3rd Resp<strong>on</strong>dent’s reply,<br />

the petiti<strong>on</strong>ers state that the 1st<br />

petiti<strong>on</strong>er is a citizen of Nigeria<br />

by birth and thus qualified to<br />

vote and be voted for and<br />

returned in the electi<strong>on</strong> to the<br />

office of the president of the<br />

Federal Republic of Nigeria,<br />

held <strong>on</strong> Saturday, February 23,<br />

2019 going by the relevant<br />

provisi<strong>on</strong>s of the 1999<br />

C<strong>on</strong>stituti<strong>on</strong> (<str<strong>on</strong>g>as</str<strong>on</strong>g> amended).<br />

“In further resp<strong>on</strong>se to<br />

paragraphs 1, 2, 3, 4, 5, 6 and<br />

8 of the 3rd resp<strong>on</strong>dent’s reply,<br />

the petiti<strong>on</strong>ers state <str<strong>on</strong>g>as</str<strong>on</strong>g> follows:<br />

‘The 1st petiti<strong>on</strong>er w<str<strong>on</strong>g>as</str<strong>on</strong>g> born<br />

<strong>on</strong> November 25, 1946 in<br />

Jada, Adamawa State by<br />

Nigerian parents and he is,<br />

therefore, a citizen of Nigeria<br />

by birth.<br />

“The 1st petiti<strong>on</strong>er’s father,<br />

Garba Abdulkadir, w<str<strong>on</strong>g>as</str<strong>on</strong>g> a<br />

Nigerian by birth, who hailed<br />

from Wurno in present day<br />

Sokoto State while the<br />

mother, Aisha Kande w<str<strong>on</strong>g>as</str<strong>on</strong>g> also<br />

a Nigerian who hailed from<br />

Dutse in present day Jigawa<br />

State.<br />

“The parents of the 1st<br />

petiti<strong>on</strong>er are both Fulani, a<br />

community/tribe indigenous<br />

to Nigeria.<br />

“The birth of the 1st<br />

petiti<strong>on</strong>er in Jada, in present<br />

day Adamawa State of<br />

Nigeria w<str<strong>on</strong>g>as</str<strong>on</strong>g> occ<str<strong>on</strong>g>as</str<strong>on</strong>g>i<strong>on</strong>ed by<br />

the movement of his paternal<br />

grandfather called Atiku, who<br />

w<str<strong>on</strong>g>as</str<strong>on</strong>g> an itinerant trader, from<br />

Wurno in present day Sokoto<br />

State to Jada in the company<br />

of his friend, Ardo Usman.<br />

“That in Jada, Atiku, the<br />

grandfather of the 1st<br />

petiti<strong>on</strong>er gave birth to Garba<br />

who in turn gave birth to the<br />

1st petiti<strong>on</strong>er and named him<br />

after his own father Atiku.<br />

“The 1st petiti<strong>on</strong>er’s mother,<br />

Aisha Kande, w<str<strong>on</strong>g>as</str<strong>on</strong>g> the granddaughter<br />

of Inuwa Dutse who<br />

came to Jada <str<strong>on</strong>g>as</str<strong>on</strong>g> an itinerant<br />

trader too from Dutse in<br />

present day Jigawa State.<br />

“That all averments<br />

c<strong>on</strong>cerning Germany, British<br />

Camero<strong>on</strong>s, League of<br />

Nati<strong>on</strong>s and Plebiscite are<br />

false and misleading in<br />

relati<strong>on</strong> to the 1st petiti<strong>on</strong>er<br />

and, therefore, completely<br />

irrelevant more so that the 1st<br />

petiti<strong>on</strong>er is a Nigerian by<br />

birth within the<br />

c<strong>on</strong>templati<strong>on</strong> of the<br />

C<strong>on</strong>stituti<strong>on</strong> of the Federal<br />

Republic ofNigeria, 1999 (<str<strong>on</strong>g>as</str<strong>on</strong>g><br />

amended).<br />

Fabricated,<br />

c<strong>on</strong>trived<br />

“The averments in the<br />

aforesaid paragraphs are<br />

indeed fabricated, c<strong>on</strong>trived,<br />

made in bad faith and<br />

designed to embarr<str<strong>on</strong>g>as</str<strong>on</strong>g>s the 1st<br />

petiti<strong>on</strong>er.<br />

“In resp<strong>on</strong>se to paragraph<br />

7 of the 3rd resp<strong>on</strong>dent’s<br />

reply, the petiti<strong>on</strong>ers aver that<br />

the votes of the 1st petiti<strong>on</strong>er<br />

in the electi<strong>on</strong> of February 23,<br />

2019 to the office of the<br />

president are not w<str<strong>on</strong>g>as</str<strong>on</strong>g>ted<br />

votes, and the 1st petiti<strong>on</strong>er<br />

being a qualified candidate<br />

in the said electi<strong>on</strong> indeed<br />

secured majority of lawful<br />

votes over and above the<br />

votes of the 2nd resp<strong>on</strong>dent.<br />

Career and political<br />

activities<br />

“In further reacti<strong>on</strong> to<br />

Paragraph 7 of the 3rd<br />

Resp<strong>on</strong>dent Reply, the<br />

Petiti<strong>on</strong>ers hereby plead and<br />

c<strong>on</strong>tend that at all times<br />

material the 1st petiti<strong>on</strong>er h<str<strong>on</strong>g>as</str<strong>on</strong>g><br />

been a Nigerian by birth and<br />

h<str<strong>on</strong>g>as</str<strong>on</strong>g> participated in the<br />

following career and political<br />

activities and h<str<strong>on</strong>g>as</str<strong>on</strong>g> also<br />

received the following<br />

awards and h<strong>on</strong>ours:<br />

“The 1st petiti<strong>on</strong>er w<str<strong>on</strong>g>as</str<strong>on</strong>g> a<br />

civil servant in the Nigeria<br />

Customs Service for over 20<br />

years and retired <str<strong>on</strong>g>as</str<strong>on</strong>g> a deputy<br />

director.<br />

Qualificati<strong>on</strong> to<br />

c<strong>on</strong>test electi<strong>on</strong>s<br />

“The issue of qualificati<strong>on</strong> of<br />

the 2nd resp<strong>on</strong>dent to c<strong>on</strong>test<br />

electi<strong>on</strong> to the office of<br />

President of the Federal<br />

Republic of Nigeria is a<br />

mandatory statutory and/or<br />

c<strong>on</strong>stituti<strong>on</strong>al requirement<br />

that cannot be waived by the<br />

petiti<strong>on</strong>ers <str<strong>on</strong>g>as</str<strong>on</strong>g> err<strong>on</strong>eously<br />

averred in paragraph 499 (d)<br />

of the 3rd Resp<strong>on</strong>dent’s Reply.<br />

“In further resp<strong>on</strong>se to<br />

paragraphs 493, 497, 498, 499,<br />

500 and 501 of the 3rd<br />

resp<strong>on</strong>dent’s reply, the<br />

Petiti<strong>on</strong>ers challenge the 3rd<br />

Resp<strong>on</strong>dent to produce the<br />

originals or Certified True<br />

Copies of the 2nd<br />

Atiku replies APC, says I'm a full<br />

blooded Nigerian<br />

President Muhammadu Buhari.<br />

resp<strong>on</strong>dent’s purported<br />

certificates obtained from<br />

elementary school, Daura and<br />

Mai’adua, Middle School,<br />

Katsina and Katsina<br />

Provincial Sec<strong>on</strong>dary School<br />

and all other instituti<strong>on</strong>s<br />

pleaded in paragraphs 500<br />

and 501 of 3rd resp<strong>on</strong>dent’s<br />

reply.”<br />

Atiku maintained that his<br />

petiti<strong>on</strong> is competent and<br />

meritorious, saying the return<br />

of President Buhari <str<strong>on</strong>g>as</str<strong>on</strong>g> winner<br />

of the February 23 presidential<br />

poll w<str<strong>on</strong>g>as</str<strong>on</strong>g> undue and wr<strong>on</strong>gful.<br />

“The 3rd resp<strong>on</strong>dent’s reply<br />

does not answer the points of<br />

substance in the Petiti<strong>on</strong> but<br />

same is full of extraneous facts,<br />

c<strong>on</strong>tradictory, diversi<strong>on</strong>ary,<br />

ev<str<strong>on</strong>g>as</str<strong>on</strong>g>ive, speculative and<br />

vague <str<strong>on</strong>g>as</str<strong>on</strong>g>serti<strong>on</strong>s”, he added.<br />

Buhari's<br />

qualificati<strong>on</strong><br />

More so, Atiku argued that<br />

the tribunal h<str<strong>on</strong>g>as</str<strong>on</strong>g> the requisite<br />

jurisdicti<strong>on</strong> to c<strong>on</strong>sider his<br />

c<strong>on</strong>tenti<strong>on</strong> that Buhari lacked<br />

the educati<strong>on</strong>al qualificati<strong>on</strong><br />

to c<strong>on</strong>test the presidential<br />

electi<strong>on</strong>.<br />

“C<strong>on</strong>trary to the 3rd<br />

Resp<strong>on</strong>dent’s c<strong>on</strong>tenti<strong>on</strong> in<br />

paragraphs 1, 2, 3, 4 and 5 of<br />

the Preliminary Objecti<strong>on</strong>, this<br />

H<strong>on</strong>ourable Court is vested<br />

with the vires and jurisdicti<strong>on</strong><br />

to adjudicate <strong>on</strong> the<br />

Petiti<strong>on</strong>ers’ allegati<strong>on</strong>s <str<strong>on</strong>g>as</str<strong>on</strong>g><br />

raised vide Grounds (D) and<br />

(E) in paragraph 15 of the<br />

Petiti<strong>on</strong>, <str<strong>on</strong>g>as</str<strong>on</strong>g> well <str<strong>on</strong>g>as</str<strong>on</strong>g> the related<br />

facts c<strong>on</strong>tained in paragraphs<br />

384 to 409 of the petiti<strong>on</strong>, <str<strong>on</strong>g>as</str<strong>on</strong>g><br />

these grounds do not fall<br />

within the purview of preelecti<strong>on</strong><br />

matters c<strong>on</strong>templated<br />

by secti<strong>on</strong> 285 (9) and (14) of<br />

the C<strong>on</strong>stituti<strong>on</strong> of the Federal<br />

Republic of Nigeria, 1999 (4th<br />

Alterati<strong>on</strong> No 21) Act 2017.<br />

“Grounds 15 (d) and (e) of<br />

the petiti<strong>on</strong> and indeed all the<br />

grounds of the Petiti<strong>on</strong> are<br />

covered by Secti<strong>on</strong>s 35(1) and<br />

(2) and 138 (1)(e) of the<br />

Electoral Act, 2010 (<str<strong>on</strong>g>as</str<strong>on</strong>g><br />

amended) and are therefore<br />

cognizable in an electi<strong>on</strong><br />

petiti<strong>on</strong>.<br />

“The issue of the<br />

qualificati<strong>on</strong> of the 2nd<br />

resp<strong>on</strong>dent to c<strong>on</strong>test the<br />

presidential electi<strong>on</strong> under<br />

scrutiny, which is at the<br />

epicenter of the petiti<strong>on</strong>ers’<br />

grounds (d) and (e) of<br />

paragraph 15 of the petiti<strong>on</strong><br />

is not <strong>on</strong>ly a pre-electi<strong>on</strong><br />

matter but also a post-electi<strong>on</strong><br />

matter within the relevant<br />

provisi<strong>on</strong>s of the C<strong>on</strong>stituti<strong>on</strong><br />

of the Federal Republic of<br />

Nigeria, 1999 (<str<strong>on</strong>g>as</str<strong>on</strong>g> amended)<br />

<str<strong>on</strong>g>as</str<strong>on</strong>g> well <str<strong>on</strong>g>as</str<strong>on</strong>g> the Electoral Act,<br />

2010 (<str<strong>on</strong>g>as</str<strong>on</strong>g> amended) and<br />

therefore competent and not<br />

statute-barred.<br />

“The issue of n<strong>on</strong>qualificati<strong>on</strong><br />

of the 2nd<br />

resp<strong>on</strong>dent is fundamental<br />

and can therefore not be<br />

waived <str<strong>on</strong>g>as</str<strong>on</strong>g> err<strong>on</strong>eously alleged<br />

by the 3rd Resp<strong>on</strong>dent.<br />

“In reply to paragraph 6 of<br />

the preliminary objecti<strong>on</strong>, the<br />

petiti<strong>on</strong>ers c<strong>on</strong>tend that the<br />

petiti<strong>on</strong> discloses re<str<strong>on</strong>g>as</str<strong>on</strong>g><strong>on</strong>able<br />

cause of acti<strong>on</strong> capable of<br />

c<strong>on</strong>ferring this H<strong>on</strong>ourable<br />

Court with jurisdicti<strong>on</strong> to<br />

entertain same.<br />

“In answer to paragraph 7<br />

of the Preliminary Objecti<strong>on</strong>,<br />

the Petiti<strong>on</strong>ers aver that the<br />

paragraphs of the Petiti<strong>on</strong> set<br />

out therein by the 3rd<br />

Resp<strong>on</strong>dent are not in any<br />

way generic, vague, unreferable<br />

(sic), n<strong>on</strong>- specific,<br />

nebulous, bogus, imprecise,<br />

speculative or at large.<br />

“Indeed the said<br />

paragraphs of the Petiti<strong>on</strong><br />

have stated clearly the facts of<br />

the electi<strong>on</strong> Petiti<strong>on</strong>, the<br />

grounds <strong>on</strong> which the Petiti<strong>on</strong><br />

is b<str<strong>on</strong>g>as</str<strong>on</strong>g>ed and the reliefs sought<br />

by the Petiti<strong>on</strong>ers in<br />

c<strong>on</strong>s<strong>on</strong>ance with the dictates<br />

of paragraph 4(1)(d) of the<br />

First Schedule to the Electoral<br />

Act, 2010 (<str<strong>on</strong>g>as</str<strong>on</strong>g> amended).<br />

“In further answer to<br />

•Adds Allegati<strong>on</strong> puerile,<br />

vexatious<br />

Alhaji Atiku Abubakar<br />

paragraph 7 of the Preliminary<br />

Objecti<strong>on</strong>, the Petiti<strong>on</strong>ers<br />

c<strong>on</strong>tend that <str<strong>on</strong>g>as</str<strong>on</strong>g>suming<br />

without c<strong>on</strong>ceding that the<br />

3rd Resp<strong>on</strong>dent is not clear<br />

<str<strong>on</strong>g>as</str<strong>on</strong>g> to the import of all or any of<br />

the paragraphs alleged to be<br />

vague, the 3rd Resp<strong>on</strong>dent is<br />

obliged to seek further and<br />

better particulars from the<br />

Petiti<strong>on</strong>ers, which they have<br />

failed to do and can therefore<br />

not be heard to complain of<br />

vagueness.<br />

“More so, when they have<br />

replied to the paragraph in<br />

questi<strong>on</strong> and others they<br />

challenged.<br />

Allegati<strong>on</strong>s of<br />

n<strong>on</strong>-compliance<br />

“In answer to paragraphs 8,<br />

9, 10, 11 and 12 of the<br />

Preliminary Objecti<strong>on</strong>, the<br />

Petiti<strong>on</strong>ers state that all the<br />

allegati<strong>on</strong>s of n<strong>on</strong>compliance<br />

in the petiti<strong>on</strong><br />

have been tied to specific<br />

polling units, wards and local<br />

governments <str<strong>on</strong>g>as</str<strong>on</strong>g>sociated with<br />

the allegati<strong>on</strong>s.<br />

“In further answer to<br />

paragraphs 8, 9, 10, 11 and<br />

12 of the preliminary<br />

objecti<strong>on</strong>, the petiti<strong>on</strong>ers<br />

c<strong>on</strong>tend that particulars of<br />

polling units where<br />

irregularities, n<strong>on</strong>-compliance<br />

and other infracti<strong>on</strong>s took<br />

place were supplied in the<br />

Petiti<strong>on</strong> which ought to be read<br />

together and not in isolati<strong>on</strong><br />

<str<strong>on</strong>g>as</str<strong>on</strong>g> the 3rd resp<strong>on</strong>dent h<str<strong>on</strong>g>as</str<strong>on</strong>g><br />

clearly d<strong>on</strong>e.<br />

“In answer to paragraphs 13,<br />

14, and 15, of the preliminary<br />

objecti<strong>on</strong> alleging failure to<br />

join pers<strong>on</strong>s named in the<br />

paragraphs of the Petiti<strong>on</strong><br />

listed by the 3rd resp<strong>on</strong>dent,<br />

the petiti<strong>on</strong>ers c<strong>on</strong>tend that the<br />

individuals, officers,<br />

instituti<strong>on</strong>s and pers<strong>on</strong>ages<br />

named in those paragraphs<br />

acted for and <strong>on</strong> behalf of the<br />

1st Resp<strong>on</strong>dent <str<strong>on</strong>g>as</str<strong>on</strong>g> agents,<br />

and/or <strong>on</strong> the authority of the<br />

1st Resp<strong>on</strong>dent which is a<br />

named party in this Petiti<strong>on</strong>.<br />

“In answer to paragraphs 16<br />

and 17 of the preliminary<br />

objecti<strong>on</strong>, the Petiti<strong>on</strong>ers<br />

c<strong>on</strong>tend that to the extent that<br />

the listed paragraphs deal<br />

with the questi<strong>on</strong> of the<br />

qualificati<strong>on</strong> of the 2nd<br />

resp<strong>on</strong>dent to c<strong>on</strong>test the<br />

presidential electi<strong>on</strong>, these<br />

paragraphs cannot be<br />

pige<strong>on</strong>holed within the<br />

narrow c<strong>on</strong>fine of secti<strong>on</strong> 31(5)<br />

and (6) of the Electoral Act,<br />

2010 (<str<strong>on</strong>g>as</str<strong>on</strong>g> amended), since<br />

qualificati<strong>on</strong> is both a pre and<br />

post- electi<strong>on</strong> matter.<br />

“In answer to paragraph 18<br />

of the Preliminary Objecti<strong>on</strong>,<br />

the Petiti<strong>on</strong>ers c<strong>on</strong>tend that<br />

paragraph 15 (b) and (c) of<br />

the Grounds of the Petiti<strong>on</strong> <str<strong>on</strong>g>as</str<strong>on</strong>g><br />

well <str<strong>on</strong>g>as</str<strong>on</strong>g> paragraphs 107 to 363<br />

and 364 to 387 of the Petiti<strong>on</strong><br />

are proper, valid, and in no<br />

way hypothetical in that the<br />

reliefs sought in the Petiti<strong>on</strong><br />

are clearly tied to the<br />

paragraphs aforesaid and the<br />

entirety of the Petiti<strong>on</strong> taken<br />

together, such that this court<br />

h<str<strong>on</strong>g>as</str<strong>on</strong>g> the jurisdicti<strong>on</strong> to entertain<br />

the paragraphs and the<br />

grounds up<strong>on</strong> which they are<br />

b<str<strong>on</strong>g>as</str<strong>on</strong>g>ed.<br />

“In answer to paragraph 19<br />

of the Preliminary Objecti<strong>on</strong>,<br />

the Petiti<strong>on</strong>ers c<strong>on</strong>tend that<br />

paragraphs 389 and 390 of the<br />

Petiti<strong>on</strong> are clear statements of<br />

facts tied to the provisi<strong>on</strong>s of<br />

the Electoral Act (supra),<br />

which in no way offend the<br />

rules of pleadings.”<br />

On his lawyer's<br />

qualificati<strong>on</strong><br />

Likewise, Atiku urged the<br />

tribunal to ignore the<br />

allegati<strong>on</strong> that his lead lawyer<br />

w<str<strong>on</strong>g>as</str<strong>on</strong>g> not qualified to practice<br />

in Nigeria.<br />

He told the tribunal that<br />

c<strong>on</strong>trary to APC’s allegati<strong>on</strong>,<br />

his lawyer, Livy Uzokwu,<br />

SAN, w<str<strong>on</strong>g>as</str<strong>on</strong>g> a former Attorney<br />

General of Imo State.
