moves <strong>to</strong> disqualify Buhari<br />

Division of the Court of<br />

Appeal has been asked <strong>to</strong><br />

invoke its original<br />

jurisdiction <strong>to</strong> determine<br />

whether President<br />

Muhammadu Buhari<br />

supplied false information<br />

about his educational<br />

qualification and certificates,<br />

in the Form CF001 he<br />

submitted <strong>to</strong> Independent<br />

National Elec<strong>to</strong>ral<br />

Commission, INEC, before<br />

the 2019 general elections.<br />

The appellate court is in an<br />

appeal marked CA/A/436/<br />

2019, further urged <strong>to</strong><br />

determine whether the office<br />

of the At<strong>to</strong>rney-General of<br />

the Federation and Minister<br />

of Justice, is competent <strong>to</strong> file<br />

processes <strong>to</strong> defend the<br />

allegation that President<br />

Buhari lied on oath about his<br />

qualifications.<br />

The appeal was lodged by<br />

three litigants, Kalu Agu,<br />

Labaran Ismail and Hassy<br />

El-Kuris, who identified<br />

themselves as elec<strong>to</strong>rate and<br />

tax payers.<br />

The trio are challenging the<br />

dismissal of a suit they filed<br />

against President Buhari,<br />

prior <strong>to</strong> the February 23<br />

presidential election.<br />

Opera<strong>to</strong>rs, shareholders seek technical<br />

suspension of Oando shares<br />

•Call for FG’s intervention <strong>to</strong> resolve crisis<br />

OPERATORS in the<br />

capital market and<br />

shareholders have called on<br />

Securities and Exchange<br />

Commission, SEC, and<br />

Nigerian S<strong>to</strong>ck Exchange,<br />

NSE, <strong>to</strong> place the shares of<br />

Oando Plc on technical<br />

suspension <strong>to</strong> protect<br />

minority shareholders of the<br />

company, which share price<br />

has fallen by over 20 per cent<br />

in the past two trading days.<br />

They also stated that the<br />

court injunction obtained by<br />

Oando could lead <strong>to</strong> long<br />

legal battle, which could<br />

further affect the company’s<br />

shares price on the NSE, if it<br />

was not placed on<br />

suspension.<br />

The opera<strong>to</strong>rs also called<br />

on the Federal Government<br />

<strong>to</strong> urgently intervene in the<br />

conflict between the SEC and<br />

Oando Plc.<br />

Meanwhile, the SEC<br />

executives, at press time,<br />

were still holding meeting<br />

regarding the court order<br />

obtained by Oando.<br />

Spokesperson for SEC,<br />

Mrs Efe Ebelo, said : “SEC<br />

is still holding a meeting. I<br />

can’t speak now.”<br />

Oando speak volume. As<br />

company, we are more<br />

interested in protection of<br />

minority shareholders, their<br />

investments and protection<br />

of capital market.<br />

‘’The consequences of this<br />

far-reaching<br />

recommendation from the<br />

regula<strong>to</strong>r has tremendous<br />

effect on the share price of<br />

the company, both local and<br />

international, market<br />

integrity, rule of law and<br />

expected returns on<br />

investment.<br />

‘’For purposes of fair<br />

hearing, we expect the<br />

company <strong>to</strong> come out with<br />

its position on the matter as<br />

this will allow the<br />

shareholders <strong>to</strong> <strong>take</strong> a<br />

position with respect <strong>to</strong> the<br />

issue at hand.<br />

‘But going by the findings<br />

of the investiga<strong>to</strong>r, the board<br />

and management of the<br />

company have much<br />

clarification <strong>to</strong> make, the role<br />

played by the external<br />

audi<strong>to</strong>r, the audit committee,<br />

the external board evalua<strong>to</strong>rs<br />

and even the regula<strong>to</strong>rs, who<br />

have unfettered access <strong>to</strong> the<br />

account of the company, who<br />

gave approval <strong>to</strong> the account<br />

as presented, should also be<br />

indicted.<br />

‘’I believe that SEC, as<br />

currently constituted, has no<br />

power <strong>to</strong> <strong>take</strong> such a farreaching<br />

decision without<br />

the consent of a board. The<br />

regula<strong>to</strong>r has been operating<br />

without a board for more<br />

than four years and as such,<br />

is like a car without a pilot, a<br />

human being with body<br />

without the head. Even the<br />

USA SEC has not operated<br />

without a board since 1939."<br />

on May 31, as well as a court<br />

injunction restraining SEC<br />

from sacking Oando’s<br />

Senate leadership: APC yet <strong>to</strong> zone<br />

position <strong>to</strong> S-South— Caucus<br />

National Assembly and<br />

election of presiding officers,<br />

concerned caucus of All<br />

Progressives Congress,<br />

APC, yesterday, said the<br />

party was yet <strong>to</strong> zone the<br />

position of Deputy Senate<br />

President <strong>to</strong> the South-<br />

South geo-political zone.<br />

This came on a day<br />

Peoples Democratic Party,<br />

PDP, caucus in the House<br />

of Representatives said it<br />

had yet <strong>to</strong> endorse House<br />

Leader, Femi Gbajabiamila,<br />

or any other aspirant for the<br />

position of speaker in the<br />

incoming 9th National<br />

Assembly.<br />

In a statement signed by<br />

Segun Bello and Sunday<br />

Umutu in Abuja, yesterday,<br />

the APC leaders <strong>to</strong>ok a<br />

swipe at Sena<strong>to</strong>r Ita Enang<br />

on his position that Sena<strong>to</strong>r<br />

Ovie Omo-Agege (APC,<br />

Delta Central), had been<br />

endorsed for the position of<br />

Deputy Senate President.<br />

According <strong>to</strong> the APC<br />

leaders, Sena<strong>to</strong>r Ita Enang<br />

cannot speak for the party<br />

and can no longer speak for<br />

the Presidency, considering<br />

the fact that he was no longer<br />

Senoir Special Assistant <strong>to</strong><br />

President Muhammadu<br />

Buhari on National<br />

Assembly Matters (Senate).<br />

They said in a statement:<br />

“Section 151 of the 1999<br />

Constitution states that the<br />

appointment of all special<br />

advisers shall cease when<br />

the President ceases <strong>to</strong> hold<br />

office, while Section 171<br />

states that the appointment<br />

of the Secretary <strong>to</strong> the<br />

Government of the<br />

Federation and any office or<br />

the personal staff of the<br />

President shall cease when<br />

the President ceases <strong>to</strong> hold<br />

office.<br />

“Therefore, our attention<br />

has been drawn <strong>to</strong> the<br />

statement of Sena<strong>to</strong>r Ita<br />

Enang in an interview in<br />

7.00am news on Radio<br />

Nigeria on Wednesday, 5th<br />

June, 2019.<br />

“In the interview, Sena<strong>to</strong>r<br />

Enang stated that Sena<strong>to</strong>r<br />

Lawan Ahmad will emerge<br />

as Senate President of the<br />

9th Senate, while Femi<br />

Gbajiabiamila will emerge as<br />

speaker, House of<br />

Representatives. He went<br />

on <strong>to</strong> state that Sena<strong>to</strong>r Ovie<br />

Omo-Agege will emerge as<br />

Deputy Senate President.<br />

“Although, in the<br />

interview he was referred <strong>to</strong><br />

as the Senior Special<br />

Assistant <strong>to</strong> the President on<br />

National Assembly Matters,<br />

we write <strong>to</strong> state that he<br />

spoke on personal capacity<br />

and expressed his own<br />

opinion and certainly not in<br />

any way the position of the<br />

Presidency.<br />

“It should be noted that his<br />

appointment as Senior<br />

Special Assistant <strong>to</strong> the<br />

President on National<br />

Assembly Matters ceased<br />

with the end of the<br />

President’s first term on<br />

May 29, 2019, as provided<br />

in Section 151(3) of the 1999<br />

Constitution (As<br />

Amended).<br />

“Therefore, his statement<br />

about Sena<strong>to</strong>r Ovie Omo-<br />

Agege should be seen<br />

wholly as figment of his<br />

imagination, because he<br />

has probably supported<br />

him."<br />

Meanwhile, PDP caucus<br />

in the House of<br />

Representatives has said it<br />

never endorsed Femi<br />

Gbajabiamila or any other<br />

aspirant for position of<br />

speaker.<br />

In a statement by the<br />

Minority Leader, Leo Igor,<br />

the caucus stated that at no<br />

time did it ask member <strong>to</strong><br />

vote a particular candidate.<br />

Ogor stated that the Sallah<br />

message in which the<br />

caucus stated that members<br />

of the PDP were free <strong>to</strong><br />

attend political meetings<br />

and sessions of the aspirants<br />

did not translate <strong>to</strong><br />

endorsement or asking<br />

members <strong>to</strong> vote for them.
