Trade Talks: RegulationsFOREWARNED IS FOREARMED:PROTECTING AGAINST CHANGEJon Vanstone is a member of BRAC and Chair of Certass Trade Association. Below he looksat the wider issues for products and construction with the impending regulation changes.Products in construction are under scrutinylike never before, and with our departurefrom the EU we have entered a transitionperiod where our representation on the rulesand obligations enforceable on ourselves isdiminished.British Standards Institute (BSI) remains withinCEN and CENELEC with a proposed membershipextension till the end of 2021. Yet standardsthat are made at international levels and withinEurope through CEN, CENELEC and ETSI, BSIis obliged to adopt withdrawing any BritishStandards that conflict.For many, the end of transition cannot comesoon enough as we need to know where weare, especially with so many home-grownamendments ahead. UK Construction will entera totally new phase with the introduction of themuch-anticipated Building Safety Regulator(BSR) from the shadows of the Health and SafetyExecutive (HSE).Much is yet to be defined but we know thatBSR will oversee the design and managementof buildings with a specific focus on higherriskbuildings delivering effective and robustenforcement of standards. The headline beingthat there will be power to apply criminalsanctions to building owners who do not followthe regime.The exact definition of what is higher risk isbeing consulted upon and will increase thetypes of buildings included – currently seen bymany as high rise flats over 18 metres – as amuch-needed drive for change flows throughoutconstruction.The regulator will advise government on whichbuildings should be included in scope, drivenby an evidenced analysis of risk,and is likely to include manyspecialist buildings such ashospitals and schools.Government decisions inconstruction are dictated byImpact Analysis, yet these havebeen called in to question recentlyas rapid responses to outputs from Grenfellanalysis have led to widespread restrictions oncertain products.Product regs – landscape is still unclearWe know that much more will come as regardsto product regulation in the UK this year, with theimminent introduction of UKCA marking, but CEmarking will remain in place until 1st January2021. The exact landscape is still unclear, andthe number of interest groups is rising.Those who have had products restricted need tostart amassing third party evidence if they areto reverse the decisions already made. The aimis to ensure an appropriate risk profile for everyproduct with an aim to ensuring that restrictionsare proportionate to the safety risk they present.We know that more than 300 high rise buildingsare still in urgent need of rectification work, andwhilst those owned by authorities can be driventowards rectification rapidly, the majority inprivate ownership are harder to move whilst theBSR and its powers remain a theoretical body.The automotive industry has been in the situationwe stand now due to road traffic deaths, anditems such as seat belts and air bags appearedin rapid fashion. The only issue is that cars go tothe scrap heap much quicker than houses andour industry programmes will be about repair andupgrades as opposed to replacement.01292 292 095www.certass.co.uk@CertassLtdConstruction is under asignificant safety spotlightand as the focus moves fromproducts and design ontothe competency of the people,there will be a considerablenumber who will leave the industry.A number of bodies talk about the absenceof workers in our construction sector – whichcurrently employs about 2.4 million people – butit is better to have a deficit than a group of poorinstallers which are currently prevalent in almostevery discipline including glazing.So, with much change ahead, the pressureto know more and be represented becomesof paramount importance to fabricators andmanufacturers.
