CONdITIONs OF saLe<br />

Lots Sold to the Highest Bidder: The highest bidder acknowledged by the auctioneer shall be the buyer. Under no circumstances are the<br />

consignors or the consignor’s agents or persons acting on behalf of the consignors permitted to bid at the auction on their consigned<br />

property. The auctioneer has the right to reject any bid, to advance the bidding at his or her absolute discretion and, in the event of any<br />

dispute between bidders or any other issue with respect to the highest bidder, to determine the successful bidder, to continue the bidding<br />

or to reoffer and resell the lot in question. In the event of any dispute after the sale, <strong>John</strong> <strong>Moran</strong> <strong>Auctioneers</strong>, Inc., a California Corporation<br />

(hereinafter referred to as, JMA), record of final sale shall be conclusive.<br />

THE CATALOGUE, BROCHURES OR IN THE BILL OF SALE OR INVOICE OR BIOGRAPHIC INFORMATION OR STATEMENTS MADE BY THE<br />

AUCTIONEER DURING THE AUCTION OR ELSEWHERE SHALL BE DEEMED SUCH A WARRANTY OR REPRESENTATION OR AN ASSUMPTION<br />

OF LIABILITY. NO EMPLOYEE OF JOHN MORAN AUCTIONEERS IS AUTHORIZED TO MAKE, ON OUR BEHALF OR THAT OF THE CONSIGNOR,<br />

ANY REPRESENTATION OR WARRANTY, ORAL OR WRITTEN, WITH RESPECT TO ANY PROPERTY.<br />

Buyer’s obligation to inspect each item: Buyers are strongly encouraged to view all items auctioned on display before the auction to<br />

determine the true condition and nature of any item(s) of interest. Although there is no legal requirement that each buyer inspect lots<br />

purchased before the auction, the failure to inspect may constitute a waiver of that buyer’s complaint that the item was not delivered in a<br />

condition equal to the existent condition at the auction as described in section 14 of these Conditions of Sale.<br />

All Sales Final: Notwithstanding any other terms of these conditions, any and all refunds shall be given at the sole discretion of JMA.<br />

Refunds requested on the grounds of authenticity must be made within 10 days of the auction date, and such requests must be accompanied<br />

by at least one supporting statement in writing from a recognized authority stating that the painting or art sold is incorrect or not the work<br />

of the artist. A recognized authority shall be defined as a person who has authored, edited, or substantially contributed to a monograph on<br />

the artist, a person who has curated, organized or substantially contributed to a solo exhibition on the artist, a person who has represented<br />

the artists estate or someone who represented or worked closely with the artist while they were alive and, in any of the above instances<br />

physically handled works of the period, medium and subject matter in question during the course of their duties. Please note that dealers<br />

who advertise to buy a wide range of artists, appraisers and representatives of other auction firms do not qualify as authenticators of<br />

individual artists unless they have had such specific involvement with an artists work as specified above in addition to their daily duties. Any<br />

lot in question must be returned to JMA in the exact same condition as when sold. Please be advised that JMA does not grant extensions to<br />

refund considerations based upon authenticity due to shipping delays. There are no exceptions to this refund policy.<br />

The Right to withdraw Lots: JMA reserves the right to withdraw any lot before or at the sale.<br />

Buyer’s Premium: The purchase price payable by a buyer shall be the sum of the final bid plus a premium of 17.5% of the final bid price.<br />

(Effective June 1, <strong>2008</strong>)<br />

A <strong>22</strong>.5% buyer’s premium shall apply on all purchases made via ebay Live.<br />

Lots are Subject to a Reserve Price: Some lots in the auction are subject to a reserve, which is the confidential minimum price below which<br />

the lot will not be sold (the reserve). In no event will the reserve price exceed the low estimate. JMA shall act to protect the reserve by<br />

bidding through the auctioneer. The auctioneer may open bidding on any lot below the reserve by placing a bid on behalf of the seller. The<br />

auctioneer may continue to bid on behalf of the seller up to the amount of the reserve, either by placing consecutive bids or by placing bids<br />

in response to other bidders. The estimates provided by JMA concerning a given lot, are carefully considered opinions of the cataloguer and<br />

fine art staff. Any estimates given are merely suggestive guidelines for interested buyers. Buyers must be aware that paintings and art are<br />

subject to fluctuating values depending on the subjective interests of collectors and a wide variety of other uncontrollable factors. The lots<br />

auctioned may sell at prices either above or below estimates.<br />

Winning Bid Constitutes an Immediate Transfer of Title: Title to the offered lot shall pass to the buyer upon the fall of the auctioneer’s<br />

hammer and announcement by the auctioneer that the lot has been sold, subject to compliance by the buyer with all other Conditions of Sale.<br />

The buyer shall forthwith assume full risk and responsibility for the lot and shall pay the full purchase price or such part thereof as JMA, in<br />

its sole discretion, shall require. In addition, the buyer may be required to sign a confirmation of purchase or abide by any other financial<br />

terms that JMA deems necessary to protect the interest of the consignors.<br />

CONdITIONs OF saLe<br />

Removal of Purchased lots: All items sold may not be removed from JMA’s premises, or the premises of the auction, until the buyer has paid<br />

in full the purchase price therefor or has satisfied such terms, as JMA, in its sole discretion, shall require. Subject to the foregoing, all lots are<br />

to be paid for and removed from JMA premises at the buyer’s expense no later than the third calendar day following the sale, and, if not so<br />

removed, JMA may transfer any such lot to its warehouse at the risk and expense of the buyer. If a lot has not been collected the third calendar<br />

day following the sale and JMA does transfer the uncollected property to its warehouse, the buyer will be liable to JMA for storage and<br />

handling charges of $10.00 per day for each lot. In addition to other remedies available by law, JMA reserves the right to impose a late charge<br />

of 1% per month or the maximum permitted by law on the purchase price commencing on the day following the date on which payment is due if<br />

the buyer does not make payment in full in accordance with these Conditions of Sale.<br />

Absent Bidders: Bids which are submitted to JMA in writing or are otherwise left with JMA prior to an auction for execution at or below<br />

a specified price (Absentee bids), as well as telephone bids, shall be entertained and executed by JMA for the convenience of bidders not<br />

present at auction, but JMA shall not be responsible for failing to execute such bids or for errors relating to our execution of such bids.<br />

Bidding on any article(s), whether in person, by agent, order bid, telephone or other means, constitutes the highest bidders acceptance of<br />

these Conditions of Sale. All absentee bids must be received by JMA prior to the day of sale. Bidders by telephone are also encouraged to<br />

leave a cover bid in case of technical failure.<br />

Applicable taxes: Unless exempted by California law, the buyer shall be required to pay any applicable state and local sales tax or<br />

compensating use tax on the purchase price.<br />

Buyer’s Breach of Conditions of Sale: If the buyer fails to comply with any of these Conditions of Sale, JMA may, in addition to asserting<br />

all remedies available by law, including the right to hold such defaulting buyer liable for the purchase price, (I) cancel the sale, retaining as<br />

liquidated damages any payment made by the buyer, (II) resell the property without reserve at public auction or privately on seven days notice<br />

to the buyer, or (iii) take such other action as we deem necessary or appropriate. If JMA resells the property, the original defaulting buyer<br />

shall be liable for the payments of any deficiency in the purchase price and all costs and expenses, including warehousing, the expenses of<br />

both sales, reasonable attorneys‚ fees, commissions, incidental damages and all other charges due hereunder. In the event that such buyer<br />

pays a portion of the purchase price for any or all lots purchased, JMA shall apply the payment received to such lot or lots that JMA, in our<br />

sole discretion, deems appropriate. JMA shall have the benefit of all rights of a secured party under the Uniform Commercial Code adopted in<br />

the State of California where the auction is held.<br />

Governing Law, Venue and Jurisdiction: The rights and obligations of the parties with respect to the Conditions of Sale and the conduct of<br />

the auction shall be governed and interpreted by the laws of the State of California. By bidding at an auction, whether present in person or<br />

by agent, by absentee bid, telephone or other means, the buyer shall be deemed to have consented to the exclusive jurisdiction of the courts<br />

of such state and the federal courts sitting in such state. Further, the buyer agrees that the venue for any action arising out of the failure to<br />

abide by the Conditions of Sale, or any conduct related to or arising out of the auction, shall be the Los Angeles Superior Court, Pasadena<br />

Branch located at 300 E. Walnut Street, Pasadena, California 91101 or the Federal Court Central District located at 312 North Spring Street,<br />

Los Angeles, California, 90012-4793. The buyer expressly agrees that (I) neither JMA nor the seller shall be liable, in whole or in part, for<br />

any special, indirect or consequential damages, including, without limitation, loss of profits and (II) the buyer’s damages, if any, are limited<br />

exclusively to the original purchase price paid for the lot.<br />

Delivery of Lots Sold: The packing and handling of purchased lots by <strong>John</strong> <strong>Moran</strong> Auctioneer’s staff at the auction is undertaken solely as a<br />

courtesy to customers. There is no charge for packing material and labor supplied to you on the evening of the sale. In no event will JMA be<br />

liable for damage to painting, glass or frames regardless of cause in connection with this free service.<br />

JMA may, in our discretion and as a service to buyers, arrange to have purchased lots packed, insured and forwarded at the request,<br />

expense and risk of the buyer. JMA assumes no responsibility for acts or omissions in such packing or shipping by other packers or carriers,<br />

whether or not recommended by JMA. Nor does JMA assume any responsibility for any damage to picture frames or to the glass therein. In<br />

circumstances in which JMA arranges and bills for such services via invoice or credit card, JMA will include an administration charge.<br />

In the case of JMA personally delivering an item, if an item cannot be delivered in condition equal to the existent condition at the time of<br />

sale, or should any item be mis delivered, stolen or lost prior to delivery, JMA‚s liability shall not exceed the amount paid by the buyer at the<br />

auction. Buyers are strongly encouraged to view all items auctioned on display before the auction to determine the true condition of items of<br />

interest.<br />

Notices, Demands and Refunds: Any demands for refunds, problems with the lot(s) sold or notices of any kind concerning the auction shall be<br />

in writing and addressed to JMA at 735 West Woodbury, Altadena, California 91001.<br />

Effect of any Unenforceable Provisions: Should any of the Conditions of Sale be deemed unenforceable by a competent court having<br />

jurisdiction, such unenforceable provision shall have no effect on the enforcability of the remaining provisions contained in the Conditions of<br />

Sale.<br />

1001 Otto Poertzel, bronze & marble bust young woman<br />

Circa 1930, signed ‘’Prof Poertzel’’ (1876-1963, German), with further ‘’RVM’’ pastille<br />

mark, depicting a young woman with upswept hair, on a mottled brown and red<br />

marble plinth, overall, 9.25’’ H x 8.5’’ W x 5’’ D, est:$700/900. Provenance: Property<br />

from the Marianne J. Knox Trust, Los Angeles, CA Condition: Good condition<br />

overall. Nicely modeled. With some light brownish surface patina to white marble-<br />

particularly at extremities. General light marks and scratches commensurate with<br />

age.<br />

1002 set of four Neoclassic style silvered wall lights<br />

Probably first half 20th c, silvered metal and cut and pressed glass, each urn-form<br />

backplate atop a baluster pedestal over a drapery-swagged platform issuing three<br />

foliate-sheathed J-form candlearms hung with faceted and shaped luster drops,<br />

surmounted by a floral spray issuing further drops, wired for electricity,<br />

<strong>22</strong>.5’’ H x 16.5’’ W x 8’’ D, est:$1200/1800. Provenance: Property from the Marjorie<br />

Bacon Trust, Montecito, CA Condition: Nicely made. Decoration well executed.<br />

General marks, scratches and rubbing to surface commensurate with age. Rubbing<br />

gives nice patina to set. Some dirt accumulation overall, glass elements, in particular,<br />

would benefit from cleaning. Minor chips and losses to glass elements. Wiring should<br />

be checked by a qualified electrician prior to use.<br />

1003 a sevres style porcelain double-handled vase<br />

Late 19th/20th c, with overglaze blue interlaced ‘’L’’ marks centering a ‘’B’’ and<br />

surmounting an ‘’A’’, the flared rim above a fluted neck over a tapering body<br />

surmounted by a pair of loop handles, over a fluted socle above a square base<br />

with incurved corners, 14’’ H x 7’’ W x 7’’ D, est:$1500/2000 Condition: Made in two<br />

sections. Body removable from socle. Bronze cap on top of socle stamped ‘’41’’. Good<br />

condition overall. Nicely painted. General light marks, scratches and slight rubbing to<br />

surface. Most notable rubbed loss to decoration on rim, handles and base.<br />

1004 a German porcelain plaque beauty ‘Longing’<br />

Late 19th/early 20th c, probably Berlin, impressed ‘’107’’ and titled ‘’Sehnsucht<br />

(Longing)’’, signed ‘’Wagner’’, depicting a Classical maiden, in a rose gown, looking<br />

into the distance, within a two-tone giltwood and gilt-gesso frame, the plaque, 6’’<br />

H x 4’’ W, est:$1500/2500. Provenance: Property from a Private Laguna Beach, CA<br />

Residence Condition: Overall: 14’’ x 12’’. The plaque in good overall condition with<br />

only minor fading to surface. Not examined out of frame. Frame with some rubbing,<br />

cracking to pierced carved elements and areas of minor overpainted restoration.<br />

1005 a Biedermeier walnut chest of drawers<br />

First half 19th c, the rounded rectangular double reeded top above a cushion-molded<br />

frieze drawer over three further drawers above a straight apron over curved bracket<br />

feet, 34.75’’ H x 36’’ W x 19.5’’ D, est:$500/800 Condition: Nice diminutive size. Figuring<br />

of walnut veneer rich and dramatic. Structurally sound. General marks, nicks and<br />

scratches commensurate with age and use. Mounts replaced. With some minor<br />

lifting to veneer in areas, namely to top with some faint circular water marks. With<br />

scattered small losses, patched and overpainted repair to veneer in areas, namely<br />

around mounts. Feet later and with losses to veneer. No key.<br />

1006 C. e. Wood three panel screen birds landscape<br />

Right panel signed lower left ‘’C. E. Wood’’, oil on canvas laid to board, the outside<br />

panels depicting birds within a landscape, the central panel depicting a stream<br />

running through a wooded landscape, each within a hinged mahogany frame, each<br />

panel overall, 75.5’’ H x 27.75’’ W, est:$1500/2000 Condition: The painted panels:<br />

66’’ x 24’’. Nicely painted. Some yellowing to surface of panels overall. Panels with<br />

areas of well matched inpainting overall, particularly to sky/background areas -<br />

visible only under blacklight. With areas of patched repair to sky on right panel.<br />

Probably very recently reframed into mahogany screen frames - timber and hinges<br />

appear quite fresh. With tearing and losses to paper backing of reverse.<br />

1007 a Bohemian Wilhelm schiller & son majolica vase<br />

Late 19th c, marked ‘’WS&S / 645’’, in the Renaissance style, with banded rim<br />

decorated with griffons and acanthus scrolls over a tapering stem, decorated with<br />

knights and with lion mask handles to sides, over a reeded base, decorated with<br />

foliate scrolls interspersed with grotesque masks, on cartouche-form feet,<br />

18.25’’ H x 9’’ Dia., est:$500/700. Provenance: Property of a Private Pasadena, CA<br />

Collector Condition: Good condition overall. Well executed relief decoration. Nicely<br />

painted. General light marks and scratches to surface overall. Gilding to top rim<br />

edge largely rubbed. Gilding also rubbed on bottom half of ring handles. Some minor<br />

scattered inherent firing flaws to surface. Mix of glossy and matte glazing.<br />

1008 a Bohemian Wilhelm schiller & son majolica vase<br />

Late 19th c, of large scale, marked “WS&S / <strong>22</strong>4”, in the Renaissance style, with<br />

flared rim over a fluted tapering neck above a tapering body with a pair of anthemia<br />

handles to sides, centered by a portrait roundel depicting a woman, within a foliate<br />

and strapwork surround, over a circular spreading fluted foot,<br />

31’’ H x 15’’ W x 11.5’’ D, est:$1500/2500. Provenance: Property of a Private Pasadena,<br />

CA Collector Condition: Good condition overall. Well executed relief decoration.<br />

Nicely painted. General light marks and scratches to surface overall. With an<br />

inherent divot to rim of mouth. Scattered minor flaked losses to glazing overall. With<br />

some small chipped losses to base, as visible in photo.<br />

1009 a Continental majolica figural centerpiece Triton<br />

19th/early 20th c, probably German or Italian, marked with a blue underglaze sixprong<br />

star, modeled as a winged Triton holding aloft a shell on a waved quadripartite<br />

base, decorated overall with floral clasps, 20’’ H x 19.5’’ W x 20.5’’ D, est:$1000/1500.<br />

Provenance: Property of a Private Pasadena, CA Collector Condition: Good condition<br />

overall. Nicely modeled and decorated. General marks, scratches and rubbing to<br />

surface commensurate with age and use. A few small chipped losses at edge of<br />

base. Minor losses to tips of Triton’s hair. Ruffled edges of shell with a few well<br />

matched overpainted losses to tips.<br />

1010 a Renaissance style carved alabaster ewer<br />

Late 19th c, the ruffled spout above entwined dolphins extending to an entwined<br />

dolphin-form handle over a tapering body carved with acanthus leaves and centering<br />

a female mask, over a flared gadrooned collar, on a square base with canted corners<br />

above a conforming wooden plinth, 39’’ H x 15’’ W, est:$600/900. Provenance: Property<br />

of a Private Pasadena, CA Collector Condition: In three sections: spout, handle and<br />

body with attached plinth. Very nicely carved. With various cracks, chipped losses<br />

and repairs to surface overall, commensurate with age- as visible in catalogue<br />

photos.<br />

1011 Continental gilt-metal amethyst glass covered urn<br />

Late 19th c, in the Renaissance style, the pierced foliate-cast enameled finial inset<br />

with amethyst colored ‘jewels’, over a spreading faceted lid above a conforming body<br />

over a circular foliate-cast base, inset with further jewels, on scrolled feet,<br />

16’’ H x 7’’ Dia., est:$1000/1500. Provenance: Property from the Marjorie Bacon Trust,<br />

Montecito, CA Condition: General light marks and scratches, commensurate with<br />

age. Metal elements largely rubbed. With losses to enamel overall. Glass somewhat<br />

spotted. With a 0.75’’ x 0.25’’ chip to rim of body. Lip of lid with a 0.25’’ x 0.5’’ chip.<br />

Base mount appears to be assembled from various circular mount elements. Slight<br />

dirt accumulation overall.<br />

1012 an elizabethan style oak 15 piece dining suite<br />

Early 20th c, by the Grand Rapids Chair Company, comprising a draw-leaf trestle<br />

dining table (30.5’’ x 76’’ [closed] x 37’’), 2 armchairs (46.75’’ x 24’’ x 23’’), 10 side<br />

chairs (37.75’’ x 21.25’’ x 18.75’’), a sideboard with removable flatware tray and secret<br />

drawers (39’’ x 76’’ x <strong>22</strong>.25’’), and a court-cupboard buffet (58.25’’ x 48’’ x 20’’), ,<br />

est:$2000/4000 Condition: Table open: 120’ long. Armchair- height of seat: 19’’, width<br />

of seat: 20’’, depth of seat: 18’’. Elements all very well made. Good condition overall.<br />

With typical minor marks, nicks and scratches commensurate with age and use. With<br />

a dark honey color to timber overall. Carved decoration nicely executed. One draw<br />

leaf end to table sticks slightly. Armchairs carved to the reverse. Upholstery to chairs<br />

with some overall wear. Minor nicked losses to carved elements in areas. Some nicks<br />

and wear to stretchers and legs commensurate with age and use.<br />

1013 an Italian Renaissance style hall stand<br />

20th c, the reverse breakfronted top above a pair of twisted wrought iron bars<br />

suspended by pierced scrolling lion head terminals, flanking a triple-divided back<br />

inset with mirror plates, with a pair of carved cameo roundels to sides, over a further<br />

1046 French silver five piece dresser set Morel & Cie<br />

First half 19th c, with Minerva mark, maker’s mark ‘’MXV’’, further marked ‘’Morel<br />

& Cie’’, and interior of lid of each piece inscribed ‘’Donne / a ma chere fille Marie /<br />

B.C.P. 1826’’, comprising a short rectangular box with removable interior frame<br />

(3.5’’ x 4.75’’ x 3.25’’), two long rectangular boxes (3.75’’ x 8.25’’ x 3.25’’) and two<br />

covered urns (5.25’’ x 3.5’’), all with crown finial, armorial to one side and cipher<br />

to opposite side, richly decorated, incised and in relief overall with rose sprays,<br />

laurel garlands and foliate-headed paw feet, 5 pcs, weight, 96 oz tw approximately,<br />

est:$5000/7000. Note: French silversmith Jean-Valentin Morel operated the firm of<br />

Morel & Cie with his partner Charles-Edmond Duponchel, co-director of the Paris<br />

Opera in the 1830s and 1840s, between 1842 and 1848. Their partnership ended<br />

in 1848, resulting in a lawsuit issued by Duponchel which prohibited Morel from<br />

operating in the Department of the Seine. Morel then moved to London to open<br />

his own business. It appears, from the presentation inscription on this set, that the<br />

pieces pre-date the company of Morel & Cie by over 15 years. It is possible that the<br />

Morel & Cie mark was later added when the set may have been retailed by company.<br />

Another possibility is that the set was indeed manufactured by Morel & Cie but the<br />

inscription post-dated to commemorate an event, such as a birth date. The coat of<br />

arms on the set is that of the Choiseul-Praslin family. Marie Laure Isabelle Choiseul-<br />

Praslin was born on 19 September 1826 to Charles Laure Hughes Théobald de<br />

Choiseul, 5th Duc de Praslin and his wife Françoise Sébastiani-Porta. Provenance:<br />

Condition: Apparently first quality (.950) silver. Very well made and finely decorated.<br />

With gilt-washed interiors. With typical marks, scratches, very slight dings, rubbing<br />

gentle cleaning. All crown finials with some level of flattening and losses to prongs,<br />

as visible in catalogue photos. Small box with hinge mechanism to lid cut- lid lifts off<br />

Presentation walking stick inscribed, ‘’A.B. Valentine, Bennington, VT from ADE San<br />

Francisco, Cal., May 20th 1882’’, the yellow gold-filled head set with 1’’ diameter gold<br />

quartz roundel, mounted on a pale walnut tapering stick, together with a framed<br />

photograph of Valentine with other Union Army members, with five $0.02 cancelled<br />

stamps to reverse dated ‘’Jul/1/1865’’, two portrait photos, one taken by C. Dart,<br />

Bennington, VT, signed ‘’A.B. Valentine, 1862’’, the other taken by Brady’s, NY, NY;<br />

and a cylindrical gold quartz bar pin, in a yellow gold-filled mount (2’’), matching<br />

cane, 5 pcs, the walking stick overall, 36.75’’ H x 1.5’’ Dia., est:$6000/8000. Note: Major<br />

Alonzo B. Valentine (April 1 1830 - [after] 1900) was a born into a well-to-do family in<br />

Bennington, Vermont and in the early part of his life worked in the family woolen mill.<br />

In 1852 Valentine journeyed west after news of the rich gold deposits in California.<br />

He worked in the gold fields until 1854, when he returned to Vermont and the family<br />

business. Valentine remained in Vermont until the start of the civil war when he<br />

enlisted in the Union Army in 1862 and served ‘’meritoriously’’ until 1866, when<br />

he again returned to Bennington. Upon his return, Valentine became a prominent<br />

businessman and statesman, serving as commander of the Vermont Department of<br />

the Grand Army in 1882 and 1883 and state Senator in 1884. Provenance: Property<br />

“Pond Lilies”, 1934, signed in ink verso: Ned Scott, platinum print , image size:<br />

9.5’’ x 7.5’’, est:$600/800. Note: Ned Scott was born in France and moved to<br />

Manhattan as a young man. There he became a member of the Camera Club of New<br />

York and developed a successful career as a commercial photographer. In 1935, Scott<br />

moved west to Hollywood and worked for the next seven years shooting film stills for<br />

important directors such as Tania Tuttle, Paul Strand, <strong>John</strong> Ford and Orson Welles.<br />

While he was well known for his artistic collaborations in the motion picture industry,<br />

his iconic portraits of <strong>John</strong> Wayne and Rita Hayworth reflect Scott’s pure artistic<br />

form and are his most glamorous shots. In 1946, Ned Scott received Look Magazine’s<br />

1109 Lyonel Feininger (1871-1956 New york, Ny/Germany)<br />

“Die Teufelssonate”, signed and dated upper right: Feininger 08, ink on paper<br />

under glass, image size: 13.5’’ x 12.75’’, est:$20,000/30,000. Literature: Berliner<br />

Illustrirte Zeitung, 19 February 1911, illustrated on the cover. Note: This 1908 drawing<br />

demonstrates a pivotal shift in Lyonel Feininger’s artistic career. Between 1906 and<br />

1908, Feininger transformed himself from a master caricaturist into an exemplary<br />

painter. Working in Berlin and Paris, he was greatly influenced by his French peers<br />

and tried to suppress his affinity for cartooning and illustration just when he had<br />

reached the pinnacle of his career in these fields. The verticality and attenuated<br />

forms in the drawing are adaptations of certain elements of the Art Nouveau<br />

movement which just a few years later he would amplify to greater extremes.<br />

The subject matter is autobiographical, with something of a psychological twist.<br />

Feininger’s parents, both musicians, impressed upon their son their belief in the<br />

superiority of music over applied and fine arts. According to a 1905 letter excerpt<br />

published in E. Scheyer, ‘’Lyonel Feininger: Caricature and Fantasy’’, Detroit, MI,<br />

1964, p. 13, ‘’I remember so well: When I was a very small boy, four or five years<br />

old, in New York, we lived in a three story house all by ourselves: I used to sit in the<br />

dusk in the big dining room in the basement. The large stove gave heat also to the<br />

music room above. The register of the stove was open for me so that I might hear<br />

the better - than there I was - perfectly entranced, while my parents were playing,<br />

my father the violin, my mother accompanying him on the piano, music by Bach,<br />

Beethoven, Mendelssohn, Schumann, Schubert. Waves of delight went through me<br />

- I believe nobody ever had an idea what was happening with me: later anyhow my<br />

father didn’t consider me to be deeply musical. But maybe my inclination for technical<br />

constructions, which then had the upper hand, was not very favorably looked upon<br />

by my father, I tinkered too much for his taste - he didn’t like it, that I was able to drive<br />

pins so straightly into the wooden models which I was building all the time - miniature<br />

ships, locomotives and such - he seemed to think that this precluded all feeling for<br />

art.’’<br />

Feininger’s parents traveled together extensively on musical tours and he and his<br />

siblings were left with relatives and family friends for long periods of time, resulting<br />

in feelings of despair and isolation. ‘’In moments of loneliness ‘he imagined faces<br />

lurking in the moving shadows’ under the elevated [train] and was haunted by “ghostlike<br />

apparitions and forms not of this world.’’ (ibid, p.19).<br />

The Devil’s Sonata, or Devil’s Trill Sonata (Il trillo del diavolo) was composed by<br />

Venetian violinist Giuseppe Tartini (1692-1770). The story goes that Tartini one night<br />

dreamt that the devil appeared at the foot of his bed, asking to be his student. Tartini<br />

proceeded to play his violin and at the end of his instruction, he handed the devil<br />

his instrument to test his skill. The devil began to play with such virtuosity a sontata<br />

so beautiful, complicated and technical that Tartini immediately awoke with a gasp<br />

and attempted to play what he had just heard in his dream. He transcribed the<br />

composition as best as he could remember it but claimed it fell far short of what<br />

the devil played for him. As he told the French astronomer Jerome Lalande, who<br />

recorded the story in his ‘Voyage d’un francois en Italie’, 1769, ‘’The piece I then<br />

composed is without doubt my best, the Devil’s Sonata, but it falls so far short of the<br />

one that stunned me that I would have smashed my violin and given up music forever<br />

if I could but possess it’’.<br />

The theme of the looming violinist recurred in Feininger’s later oeuvre, as in ‘’The<br />

Virtuoso’’, circa 1920 and ‘’Der rote Geiger’’ of 1934.<br />

This work will be included in the Lyonel Feininger archives of drawings and<br />

good condition. Two small tears along the upper edge, 0.5’’ and 0.25’’, a 0.5’’ tear<br />

with tape backing it along the upper left edge and a 0.25” tear along the right center<br />

edge. Paper is slightly rippled. Paper margins are toned and stained and with tears<br />

throughout and missing paper to the edges. Newspaper clipping is mounted to a nonarchival<br />

body, right of spout. Small nicked loss to finial of coffee pot. Timber elements lacking<br />
