For the year end 30 November 2020<br />

The <strong>MSA</strong> GB Board<br />

The <strong>MSA</strong> GB Board of Management is<br />

made up of the elected representatives<br />

from each of the areas and nations of<br />

Great Britain.<br />

At a meeting held prior to the national<br />

AGM, the Board elects a National<br />

Chairman and Deputy Chairman. The<br />

Board met several times during the year<br />

under review, mainly online because of<br />

Covid-19.<br />

Administration<br />

The Board appoints staff to administer<br />

the association. Over the past year, they<br />

have been Kingston Smith Associate<br />

Management who take care of the daily<br />

running and administration of the<br />

association at our Head Office in<br />

Macclesfield.<br />

The association has continued to use<br />

several external organisations to assist<br />

with various tasks including legal advice,<br />

publishing, IT and printing.<br />

Finance<br />

The Board would like to thank the<br />

accounting team at Moore Kingston<br />

Smith Accounting for their help and<br />

assistance in producing this year’s<br />

accounts. They are printed on pages 8-10<br />

and will be published as usual on<br />

www.msagb.com<br />

Membership League<br />

The <strong>MSA</strong> GB Recruitment league table is<br />

based on net percentage membership<br />

growth/retention over the year and<br />

awards the Ron Feltham Memorial Cup<br />

to the best performing region.<br />

Congratulations to <strong>MSA</strong> GB South East<br />

who head the table for the year under<br />

review (see table, facing page).<br />

Subscriptions<br />

The association continues to provide<br />

information, representation, services and<br />

support to members at a subscription<br />

within the financial reach of all ADIs.<br />

<strong>MSA</strong> membership subscriptions have<br />

not risen since August 2017. The<br />

standard fee for cheque, debit or credit<br />

card payers remains at £70.<br />

There is a discount for those members<br />

opting to pay by direct debit.<br />

The Board will consider the<br />

subscription during the year ahead.<br />

Publications<br />

Due to the coronavirus pandemic, it was<br />

not possible to produce our monthly<br />

membership magazine, Newslink, in a<br />

printed format.<br />

To ensure a regular flow of information<br />

to members during what was a critical<br />

time the board made the decision to<br />

launch a News Bulletin in the short term<br />

before appointing Chamber Media<br />

Services (CMS) to be our official<br />

publishers of Newslink and other<br />

publications in a digital format this<br />

financial year.<br />

Copies of Newslink are hosted on the<br />

Yumpu digital media website.<br />

The Board places on record its thanks<br />

to our publishers for all their work.<br />

A special thanks, too, to all our<br />

advertisers who have continued to<br />

maintain their support for our<br />

publications over the past 12 months,<br />

and to all our contributors and editors<br />

from the regions and nations of the <strong>MSA</strong><br />

GB who work so hard to make Newslink<br />

such a great read.<br />

Digital media<br />

The Board has continued to review the<br />

<strong>MSA</strong> GB brand to ensure it is fully<br />

integrated into the digital marketplace.<br />

The Board remains keen to maintain<br />

access to <strong>MSA</strong> GB information and<br />

services across a wide variety of<br />

platforms.<br />

Our website – www.msagb.com – has<br />

continued to be popular with members.<br />

The site is regularly updated, and the<br />

Board of Management have taken steps<br />

to modernise the website in the future<br />

year.<br />

Social media<br />

The association continues to be active<br />

across a variety of social media platforms<br />

and we continue to expand our ‘likes’,<br />

‘followers’ and ‘friends’ year on year.<br />

SMS texting and email<br />

With our expansion in the digital<br />

marketplace, it is even more important<br />

we have your up-to-date contact<br />

information. The Board requests<br />

members to help themselves by<br />

ensuring they keep <strong>MSA</strong> GB informed by<br />

letting us know if you change your email<br />

address or your telephone number.<br />

Texts and emails continue to be a<br />

popular way through which information<br />

is passed on to members.<br />

Organisations<br />

The <strong>MSA</strong> GB has continued to be<br />

members of the Parliamentary Advisory<br />

Committee on Transport Safety (PACTS)<br />

and the Royal Society for the Prevention<br />

of Accidents (RoSPA).<br />

Throughout the pandemic, <strong>MSA</strong> GB<br />

representatives attended various<br />

conferences, meetings and seminars in<br />

digital format, spoke at numerous<br />

events to promote the <strong>MSA</strong> GB and kept<br />

instructors informed at local events<br />

through what has proved to be<br />

extremely difficult times for everyone,<br />

including the driver training profession.<br />

EFA<br />

During the year under review, <strong>MSA</strong> GB<br />

has continued its membership of the<br />

European Driving Schools Association<br />

(EFA). Representatives from <strong>MSA</strong> GB<br />

attended delegate meetings on a virtual<br />

platform this year due to Covid-19.<br />

National Associations Strategic<br />

Partnership (NASP)<br />

The major driver trainer bodies have<br />

continued to collaborate through NASP<br />

to work on behalf of the profession and<br />

tackle the many complex issues<br />

affecting the driver training industry<br />

during the pandemic.<br />

NASP has worked closely with the<br />

DVSA, DfT and other Government bodies<br />

over the past year, ensuring members<br />

received up-to-date information with<br />

the current situation regarding Covid-19.<br />

<strong>Annual</strong> Conference<br />

Unfortunately, the <strong>MSA</strong> GB’s National<br />

<strong>Annual</strong> Conference and Training Day<br />

2020 had to be cancelled, because of the<br />

Covid-19 lockdown across the country.<br />

By way of trying to keep some sort of<br />

normality the board decided to hold a<br />

virtual AGM on 19th July 2020. This was<br />

very successful, with speakers from both<br />

the association and the DVSA.<br />

Members who attended enjoyed the<br />

event and a report was published on the<br />

News Bulletin.<br />

Members’ Insurance<br />

<strong>MSA</strong> GB holds Public Liability Insurance<br />

in the sum of £10,000,000 and<br />

Professional Indemnity insurance in the<br />

sum of £5,000,000 for the <strong>MSA</strong> GB and<br />

for <strong>MSA</strong> GB members engaged in any<br />

driver training that they are qualified to<br />

deliver.<br />

The current policy is provided by<br />

Hiscox and expires on 31st May <strong>2021</strong>; <strong>MSA</strong><br />

GB will renew this policy on the due date<br />

or purchase a new policy with similar<br />

cover.<br />

Our monthly membership magazine<br />

Newslink continues to keep members<br />

informed and entertained in equal<br />

measure in its new digital format<br />

• The Public Liability Insurance protects<br />

members where a third party makes a<br />

claim, caused by the negligence of a<br />

member, for personal injury or damage<br />

to property, not belonging to the<br />

member, when outside the car.<br />

• The Professional Indemnity Insurance<br />

covers <strong>MSA</strong> GB members in case of<br />

action taken against them by a third<br />

party for professional error, negligence<br />

or omission in the professional advice<br />

they give to the public.<br />

Advice<br />

During the year under review there has<br />

been a continuing demand from<br />

members coming forward for help and<br />

to receive advice on a wide variety of<br />

matters, not least how to handle the<br />

exceptional circumstances created by<br />

Covid-19.<br />

In Memoriam<br />

Sadly, over the year under review, we lost<br />

a stalwart of <strong>MSA</strong>GB North East, Roy<br />

Appleby, who was an Honorary Member<br />

of the association. Our sympathies and<br />

condolences go out to Roy’s family; he<br />

will be sadly missed.<br />

Our deepest sympathies go out, too, to<br />

all those members who have lost loved<br />

ones through the pandemic.<br />

The Future<br />

The <strong>MSA</strong> GB Board of Management is<br />

committed to providing members with<br />

the best possible information,<br />

representation, services and support to<br />

help members prosper personally,<br />

professionally and commercially.<br />

Runners Up Cup<br />

The Runners-Up trophy is awarded to the region that comes second in membership,<br />

based on the criteria as outlined on facing page. Introduced in 1994, it was originally<br />

known simply as the Runners Up Cup. This trophy was retired in 2005, to replaced<br />

The ADI Code of Practice<br />

About the code<br />

The Driver and Vehicle Standards<br />

Agency (DVSA) and the driver training<br />

industry place great emphasis on<br />

professional standards and business<br />

ethics. This industry Code of Practice has<br />

been agreed between the National<br />

Associations Strategic Partnership<br />

(NASP) and the DVSA, and can be seen<br />

at http://www.n-a-s-p.co.uk/<br />

It is a framework within which all<br />

instructors should operate. These<br />

professional bodies expect their<br />

members to adhere to this Code of<br />

Practice. The current NASP member<br />

groups are listed at the end of this<br />

document.<br />

Personal conduct<br />

Driver trainers will be professional,<br />

comply with the law, keep clients safe<br />

and treat them with respect<br />

The instructor agrees to:<br />

n at all times behave in a professional<br />

manner towards clients in line with the<br />

standards in the National Standard for<br />

Driver and Rider Training<br />

n at all times comply with legislative<br />

requirements including:<br />

- the protection of personal freedoms,<br />

the prevention of discrimination based<br />

on age, disability, gender, race, religion<br />

or sexual orientation<br />

- not using mobile devices like phones<br />

when driving or supervising client’s<br />

driving and only when parked in a safe<br />

and legal place – demonstrating a high<br />

standard of driving and instructional<br />

ability upholding safety standards<br />

including showing consideration for all<br />

other road users particularly pedestrians,<br />

cyclists, motorcyclists and horse riders<br />

- consumer, workplace and data<br />

protection regulations, the handling,<br />

storing, use and dissemination of video<br />

or audio recordings made in or around<br />

their tuition vehicle<br />

n avoid inappropriate physical contact<br />

with clients<br />

n avoid the use of inappropriate<br />

language to clients<br />

n not initiate inappropriate discussions<br />

about their own personal relationships<br />

and take care to avoid becoming<br />

involved in a client’s personal affairs or<br />

discussions about a client’s personal<br />

relationships, unless safeguarding<br />

concerns are raised<br />

n avoid circumstances and situations<br />

which are, or could be perceived to be, of<br />

an inappropriate nature<br />

n respect client confidentiality while<br />

understanding the actions to take if a<br />

client reveals concerns about their<br />

private lives<br />

n treat clients with respect and<br />

consideration and support them to<br />

achieve the learning outcomes in the<br />

National standard for driving cars and<br />

light vans (Category B) as efficiently and<br />

effectively as possible<br />

n ensure that their knowledge and<br />

skills on all matters relating to the<br />

provision of driver training comply with<br />

current practice and legislative<br />

requirements<br />

n use social network sites responsibly<br />

and professionally:<br />

- ensuring that clients’ personal<br />

information is not compromised<br />

- ensuring when using social media for<br />

marketing purposes that what is written<br />

is compliant with privacy and data<br />

protection legislation pertaining to<br />

digital communications, the laws<br />

regarding spam, copyright and other<br />

online issues<br />

- treating other users of social media<br />

including clients, colleagues and their<br />

views with respect<br />

- be careful not to defame the<br />

reputation of colleagues, the DVSA,<br />

driving examiners or the ADI Register<br />

- not distribute, circulate or publish<br />

footage taken of driving tests from in car<br />

cameras, without permission from the<br />

DVSA and the client<br />

Business dealings<br />

Driver trainers will account for monies<br />

paid to them, record client’s progress,<br />

advise clients when to apply for their<br />

driving tests and guide them fairly<br />

through the learning process<br />

The instructor agrees to:<br />

n safeguard and account for any<br />

monies paid in advance by the client in<br />

respect of driving lessons, test fees or for<br />

any other purpose and make the details<br />

available to the client on request<br />

n on or before the first lesson make<br />

clients aware of both this code of<br />

practice and their terms of business<br />

which should include:<br />

- legal identity of the school/instructor<br />

with full postal address and telephone<br />

- number at which the instructor or<br />

their representative can be contacted<br />

- the current price and duration of<br />

lessons<br />

- the current price and conditions for<br />

use of a driving school car for the<br />

practical driving test<br />

- the terms which apply to cancellation<br />

of lessons by either party<br />

• the terms under which a refund of<br />

lesson fees may be made<br />

- the procedure for making a<br />

complaint<br />

n check a client’s entitlement to drive<br />

the vehicle and their ability to read a<br />

number plate at the statutory distance<br />

on the first lesson and regularly during<br />

their training<br />

n make a record of a client’s progress,<br />

which will include the number of lessons<br />

provided, and ensure that the client is<br />

aware of their progress and future<br />

fitted with an extra interior rear-view<br />

- accompany the client on their<br />

practical driving test and listen to the<br />

debrief, when requested to do so by the<br />

client.<br />

Advertising<br />

Driver trainers will take care to<br />

advertise and promote their businesses<br />

in a clear and fair manner<br />

The instructor agrees that:<br />

n the advertising of driving tuition<br />

shall be clear, fair and not misleading<br />

n any claims made in advertising shall<br />

be capable of verification and comply<br />

with current CAP Advertising Codes<br />

n advertising that refers to pass rates<br />

should not be open to misinterpretation<br />

and the basis on which the calculation is<br />

prepared should be made clear.<br />

- if a client believes that their instructor<br />

is not providing a satisfactory business<br />

service they can contact their local<br />

ADI Terms of Business<br />

It is important that you present<br />

yourself to pupils in a business-like<br />

fashion. One of the ways <strong>MSA</strong> GB<br />

members do this is to use our<br />

exclusive Terms of Business, which<br />

you can download free from our<br />

website.<br />

They set out the ‘rules’ that will govern<br />

the relationship between the ADI and<br />

the pupil in a professional manner.<br />

They ensure the ADI is not out of<br />

pocket... and that any breaches of the<br />

contract entered into between ADI and<br />

pupil are recoverable in a court of law if<br />

necessary.<br />

Are these terms... really necessary?<br />

Many ADIs say they have never needed<br />

them because nothing ever goes wrong.<br />

Others state that they have the details<br />

for cancelling lessons printed on their<br />

appointment cards and that is all they<br />

need, while others think it’s enough to<br />

sign up to the DVSA’s Code of Practice.<br />

They are wrong. The purpose of the<br />

DVSA’s Code of Practice is to set out how<br />

the ADI will behave towards the pupil;<br />

putting cancellation terms on your<br />

appointment cards only covers you for<br />

missed lessons. The <strong>MSA</strong>’s Terms of<br />

Business cover far more issues and<br />

places a number of conditions on to the<br />

client.<br />

Of course, for the vast majority of<br />

business transactions between trainers<br />

and pupils, nothing goes wrong, but like<br />

most business deals, it is only when<br />

something goes wrong that you need a<br />

written note of what the agreement was.<br />

The <strong>MSA</strong> GB Terms and Conditions of<br />

Business try to make sure that all bases<br />

are covered and your business is<br />

protected.<br />

The terms cover the simple things<br />

– such as cancellations – as well as prices,<br />

lesson duration and other matters. They<br />

also set out what the pupil has to do<br />

regarding their licence and the<br />

responsibilities they have towards their<br />

ADI.<br />

ADI and the L-test bus lane problem<br />

The situation: An envelope drops<br />

through your letter box stating that your<br />

car was photographed by CCTV in a bus<br />

lane during its period of operation and<br />

you are required to pay a fine. You don’t<br />

recall this incident and on checking your<br />

diary you realise the car was out on an<br />

L-test at the time of the incident.<br />

Your predicament: As the owner,<br />

registered keeper, leaser or person<br />

responsible for the vehicle you are<br />

required to pay the fine. Unlike an<br />

offence like speeding, the law requires<br />

you to pay, not to provide details of the<br />

driver.<br />

The resolution: Clause 12 of the <strong>MSA</strong><br />

GB recommended Terms of Business<br />

clearly state: ‘During an official driving<br />

test the client is in charge of the vehicle<br />

and is liable for any fines or charges<br />

levied as a result of any motoring offence<br />

committed.’ Therefore you are able to<br />

claim the fee from the client.<br />

That’s why you need the reassurance<br />

of having the <strong>MSA</strong> GB’s Terms of<br />

Business behind you. It also covers you<br />

for missed lessons when the pupil fails to<br />

show, and explains the pupil’s<br />

responsibilities to you and your tuition<br />

vehicle, as well as setting out your own<br />

responsibilities to your pupils.<br />

Incident Procedure<br />

The <strong>MSA</strong> offers many services to its<br />

members but this is one we hope you<br />

never have to use: it’s the correct<br />

procedures to follow in the event of a<br />

traffic incident.<br />

However, if you are involved in a crash<br />

and you follow these procedures, it<br />

should help to speed up any insurance<br />

claim.<br />

Stop<br />

After being involved in any collision<br />

which involves someone else, the law<br />

requires you to stop. If you are able,<br />

switch all engines off and do not smoke.<br />

n Try to warn other traffic.<br />

n Move away from the immediate<br />

scene if you are going to use a mobile<br />

phone.<br />

Police<br />

If there are any injuries, call the police.<br />

You should also call them if you feel<br />

anyone else involved has committed an<br />

offence or if you have caused damage to<br />

someone else’s property.<br />

The police may ask you to produce<br />

your documents. If you do not carry<br />

them with you, you will have to take<br />

them to a police station you nominate.<br />

Injuries<br />

Call an ambulance. Tell them the<br />

number of people who are injured. Try to<br />

help others if you can, but do not move<br />

them. Remember, someone who does<br />

not look injured may well have internal<br />

injures or be suffering from shock.<br />

Information<br />

Take time to ask any witnesses for<br />

their name(s) and address(es) or, if you<br />

are unable to speak to a witness, take a<br />

note of the registration number(s) of the<br />

vehicle(s) they are travelling in.<br />

Take the name(s) address(es) and<br />

telephone number(s) of all parties<br />

involved in the accident and their<br />

insurance details if they have them.<br />

Also take note of how many occupants<br />

are in each vehicle. You will also need<br />

the make, model and registration<br />

numbers of the vehicles involved and<br />

take lots of photos of the scene and<br />

surrounding area as well as the damage<br />

to the vehicles.<br />

Once you have left the scene of the<br />

accident you should contact your<br />

insurers as soon as possible, especially if<br />

you feel that you were at fault, if you or<br />

the other party has any injuries or if you<br />

feel there is something suspicious.<br />

Your insurance company will want to<br />

know the following information:<br />

n police officer’s ID and police station;<br />

n weather conditions;<br />

n were any lights on the vehicles?;<br />

n exact time and location of the<br />

accident;<br />

n colour and damage to any other<br />

vehicle or property;<br />

n all declared injures;<br />

n the condition and width of the road;<br />

was the horn sounded?;<br />

n and were any signals in use?<br />

It is useful to make a quick sketch of<br />

the crash scene, adding in relevant<br />

details so you can refer to them later.<br />

Obviously, as nearly everyone travels<br />

with a camera on their phone nowdays,<br />

take photos of the scene, too. Make sure<br />

you take pictures of road markings and<br />

areas of damage on the car. This will<br />

help your insurer if there are any<br />

disputes.<br />

Take note, too, of any road signs and<br />

markings, traffic lights, etc, note the<br />

position and colour of any vehicles, the<br />

names andwidths of roads.<br />

Note how far away from the kerb you<br />

and other parties involved are, any skid<br />

marks and to which vehicle they belong.<br />

Make a note of the position of any<br />

witnesses in relation to the accident<br />

scene; you will also need to note the<br />

direction of travel and estimate the<br />

speed of any vehicles before the<br />

accident occurred.<br />

If you can mark on your sketch which<br />

way is north, it may help avoid confusion<br />

later.<br />

Remember to note:<br />

n Position of vehicles<br />

n Direction of travel<br />

n Speed before impact<br />

n Road names<br />

n Obstructions to vision<br />

n Which way is north gradients<br />

n Weather: dry/wet/snow/<br />

n Skid marks & road<br />

n Visibility: good/misty/fog/ice/sunny<br />

n Road markings, signs<br />

n Road conditions: dry/wet<br />

n Traffic: heavy/light<br />

New licences, plates reflect exit from EU<br />

To mark the first anniversary of Brexit,<br />

the Government unveiled new designs for<br />

driving licences and number plates without<br />

the EU flag, with the first batches issued<br />

from 1 January <strong>2021</strong>.<br />

While existing licences and number plates<br />

will still be valid, the new versions will be<br />

issued to everyone renewing a licence or<br />

getting one for the first time.<br />

The new designs coincide with the<br />

beginning of a number of agreements<br />

recently made between the UK and member<br />

states for British drivers, making it easier<br />

for Britons to drive in the EU when existing<br />

restrictions end.<br />

Thanks to these agreements, UK drivers<br />

who hold photocard licences will not need<br />

an international driving permit to drive in<br />

any of the 27 EU member states, Iceland,<br />

Norway, Switzerland or Liechtenstein. UK<br />

drivers won’t need to display a GB sticker in<br />

most EU countries if their number plate has<br />

GB or GB with a Union Flag on it.<br />

Although national restrictions are still in<br />

place, and people should not be travelling<br />

internationally unless for work or other<br />

legally permitted reasons, these new<br />

arrangements mean that Britons can easily<br />

drive in the EU for years to come<br />

Transport Secretary Grant Shapps said:<br />

“Changing the designs of our driving<br />

licences and number plates is a historic<br />

moment for British motorists, and a<br />

reassertion of our independence from the<br />

EU, one year on from our departure.<br />

“Looking to the future, whether it’s for<br />

work or for holidays abroad, these changes<br />

mean that those who want to drive in the<br />

EU can continue to do so with ease.”<br />
