Administration
The Board appoints staff to administer
the association. Over the past year, they
have been Kingston Smith Associate
Management who take care of the daily
running and administration of the
association at our Head Office in
The association has continued to use
several external organisations to assist
with various tasks including legal advice,
publishing, IT and printing.
Finance
accounting team at Moore Kingston
Subscriptions
The association continues to provide
information, representation, services and
support to members at a subscription
within the financial reach of all ADIs.
MSA membership subscriptions have
not risen since August 2017. The
standard fee for cheque, debit or credit
card payers remains at £70.
There is a discount for those members
opting to pay by direct debit.
The Board will consider the
subscription during the year ahead.
Publications
Due to the coronavirus pandemic, it was
not possible to produce our monthly
membership magazine, Newslink, in a
printed format.
To ensure a regular flow of information
to members during what was a critical
time the board made the decision to
launch a News Bulletin in the short term
before appointing Chamber Media
Services (CMS) to be our official
publishers of Newslink and other
publications in a digital format this
financial year.
Copies of Newslink are hosted on the
Yumpu digital media website.
The Board places on record its thanks
to our publishers for all their work.
A special thanks, too, to all our
advertisers who have continued to
maintain their support for our
publications over the past 12 months,
and to all our contributors and editors
from the regions and nations of the MSA
GB who work so hard to make Newslink
such a great read.
MSA GB ANNUAL REPORT 2019-2020
Digital media
The Board has continued to review the
MSA GB brand to ensure it is fully
integrated into the digital marketplace.
The Board remains keen to maintain
access to MSA GB information and
services across a wide variety of
platforms.
Our website – www.msagb.com – has
continued to be popular with members.
The site is regularly updated, and the
Board of Management have taken steps
to modernise the website in the future
year.
Social media
The association continues to be active
across a variety of social media platforms
and we continue to expand our ‘likes’,
‘followers’ and ‘friends’ year on year.
SMS texting and email
With our expansion in the digital
marketplace, it is even more important
we have your up-to-date contact
information. The Board requests
members to help themselves by
ensuring they keep MSA GB informed by
letting us know if you change your email
address or your telephone number.
Contact us at info@msagb.com .
Texts and emails continue to be a
popular way through which information
is passed on to members.
Organisations
The MSA GB has continued to be
members of the Parliamentary Advisory
Committee on Transport Safety (PACTS)
and the Royal Society for the Prevention
of Accidents (RoSPA).
Throughout the pandemic, MSA GB
representatives attended various
conferences, meetings and seminars in
digital format, spoke at numerous
events to promote the MSA GB and kept
instructors informed at local events
through what has proved to be
extremely difficult times for everyone,
including the driver training profession.
EFA
During the year under review, MSA GB
has continued its membership of the
European Driving Schools Association
(EFA). Representatives from MSA GB
attended delegate meetings on a virtual
platform this year due to Covid-19.
MSA GB ANNUAL REPORT 2019-2020
National Associations Strategic
Partnership (NASP)
The major driver trainer bodies have
continued to collaborate through NASP
to work on behalf of the profession and
tackle the many complex issues
affecting the driver training industry
during the pandemic.
NASP has worked closely with the
DVSA, DfT and other Government bodies
over the past year, ensuring members
received up-to-date information with
the current situation regarding Covid-19.
Annual Conference
Unfortunately, the MSA GB’s National
Annual Conference and Training Day
2020 had to be cancelled, because of the
Covid-19 lockdown across the country.
By way of trying to keep some sort of
normality the board decided to hold a
virtual AGM on 19th July 2020. This was
very successful, with speakers from both
the association and the DVSA.
Members who attended enjoyed the
event and a report was published on the
News Bulletin.
Members’ Insurance
MSA GB holds Public Liability Insurance
in the sum of £10,000,000 and
Professional Indemnity insurance in the
sum of £5,000,000 for the MSA GB and
for MSA GB members engaged in any
driver training that they are qualified to
deliver.
The current policy is provided by
Hiscox and expires on 31st May 2021; MSA
GB will renew this policy on the due date
or purchase a new policy with similar
cover.
Our monthly membership magazine
Newslink continues to keep members
informed and entertained in equal
measure in its new digital format
• The Public Liability Insurance protects
members where a third party makes a
claim, caused by the negligence of a
member, for personal injury or damage
to property, not belonging to the
member, when outside the car.
• The Professional Indemnity Insurance
covers MSA GB members in case of
action taken against them by a third
party for professional error, negligence
or omission in the professional advice
they give to the public.
Advice
During the year under review there has
been a continuing demand from
members coming forward for help and
to receive advice on a wide variety of
matters, not least how to handle the
exceptional circumstances created by
Covid-19.
In Memoriam
Sadly, over the year under review, we lost
a stalwart of MSAGB North East, Roy
Appleby, who was an Honorary Member
of the association. Our sympathies and
condolences go out to Roy’s family; he
will be sadly missed.
Our deepest sympathies go out, too, to
all those members who have lost loved
ones through the pandemic.
The Future
instructors should operate. These
professional bodies expect their
members to adhere to this Code of
Practice. The current NASP member
document.
ADI Terms of Business
It is important that you present
yourself to pupils in a business-like
fashion. One of the ways MSA GB
members do this is to use our
exclusive Terms of Business, which
you can download free from our
website.
They set out the ‘rules’ that will govern
the relationship between the ADI and
the pupil in a professional manner.
They ensure the ADI is not out of
pocket... and that any breaches of the
contract entered into between ADI and
pupil are recoverable in a court of law if
necessary.
Are these terms... really necessary?
Many ADIs say they have never needed
them because nothing ever goes wrong.
Others state that they have the details
for cancelling lessons printed on their
appointment cards and that is all they
need, while others think it’s enough to
sign up to the DVSA’s Code of Practice.
They are wrong. The purpose of the
DVSA’s Code of Practice is to set out how
the ADI will behave towards the pupil;
putting cancellation terms on your
appointment cards only covers you for
missed lessons. The MSA’s Terms of
Business cover far more issues and
places a number of conditions on to the
client.
Of course, for the vast majority of
business transactions between trainers
and pupils, nothing goes wrong, but like
most business deals, it is only when
something goes wrong that you need a
written note of what the agreement was.
The MSA GB Terms and Conditions of
Business try to make sure that all bases
are covered and your business is
protected.
The terms cover the simple things
– such as cancellations – as well as prices,
lesson duration and other matters. They
also set out what the pupil has to do
regarding their licence and the
responsibilities they have towards their
ADI.
GENERAL INFORMATION
ADI and the L-test bus lane problem
The situation: An envelope drops
through your letter box stating that your
car was photographed by CCTV in a bus
lane during its period of operation and
you are required to pay a fine. You don’t
recall this incident and on checking your
diary you realise the car was out on an
L-test at the time of the incident.
Your predicament: As the owner,
registered keeper, leaser or person
responsible for the vehicle you are
required to pay the fine. Unlike an
offence like speeding, the law requires
you to pay, not to provide details of the
driver.
The resolution: Clause 12 of the MSA
GB recommended Terms of Business
clearly state: ‘During an official driving
test the client is in charge of the vehicle
and is liable for any fines or charges
levied as a result of any motoring offence
committed.’ Therefore you are able to
claim the fee from the client.
That’s why you need the reassurance
of having the MSA GB’s Terms of
Business behind you. It also covers you
for missed lessons when the pupil fails to
show, and explains the pupil’s
responsibilities to you and your tuition
vehicle, as well as setting out your own
responsibilities to your pupils.
Incident Procedure
The MSA offers many services to its
members but this is one we hope you
never have to use: it’s the correct
procedures to follow in the event of a
traffic incident.
However, if you are involved in a crash
and you follow these procedures, it
should help to speed up any insurance
claim.
Stop
After being involved in any collision
which involves someone else, the law
requires you to stop. If you are able,
switch all engines off and do not smoke.
n Try to warn other traffic.
n Move away from the immediate
scene if you are going to use a mobile
phone.
Police
If there are any injuries, call the police.
You should also call them if you feel
anyone else involved has committed an
offence or if you have caused damage to
someone else’s property.
The police may ask you to produce
your documents. If you do not carry
them with you, you will have to take
them to a police station you nominate.
Injuries
Call an ambulance. Tell them the
number of people who are injured. Try to
help others if you can, but do not move
them. Remember, someone who does
not look injured may well have internal
injures or be suffering from shock.
Information
Take time to ask any witnesses for
their name(s) and address(es) or, if you
are unable to speak to a witness, take a
note of the registration number(s) of the
vehicle(s) they are travelling in.
Take the name(s) address(es) and
telephone number(s) of all parties
involved in the accident and their
insurance details if they have them.
Also take note of how many occupants
are in each vehicle. You will also need
the make, model and registration
numbers of the vehicles involved and
take lots of photos of the scene and
surrounding area as well as the damage
to the vehicles.
Once you have left the scene of the
accident you should contact your
insurers as soon as possible, especially if
you feel that you were at fault, if you or
the other party has any injuries or if you
feel there is something suspicious.
Your insurance company will want to
know the following information:
n police officer’s ID and police station;
n weather conditions;
n were any lights on the vehicles?;
n exact time and location of the
accident;
n colour and damage to any other
vehicle or property;
n all declared injures;
n the condition and width of the road;
was the horn sounded?;
n and were any signals in use?
GENERAL INFORMATION
Continued from page 37
It is useful to make a quick sketch of
the crash scene, adding in relevant
details so you can refer to them later.
Obviously, as nearly everyone travels
with a camera on their phone nowdays,
take photos of the scene, too. Make sure
you take pictures of road markings and
areas of damage on the car. This will
help your insurer if there are any
disputes.
Take note, too, of any road signs and
markings, traffic lights, etc, note the
position and colour of any vehicles, the
names andwidths of roads.
Note how far away from the kerb you
and other parties involved are, any skid
marks and to which vehicle they belong.
Make a note of the position of any
witnesses in relation to the accident
scene; you will also need to note the
direction of travel and estimate the
speed of any vehicles before the
accident occurred.
If you can mark on your sketch which
way is north, it may help avoid confusion
later.
Remember to note:
n Position of vehicles
n Direction of travel
n Speed before impact
n Road names
n Obstructions to vision
n Which way is north gradients
n Weather: dry/wet/snow/
n Skid marks & road
n Visibility: good/misty/fog/ice/sunny
n Road markings, signs
n Road conditions: dry/wet
n Traffic: heavy/light
n Occupants of other cars; How many
were in each car
n Width of accident sketch
New licences, plates reflect exit from EU
To mark the first anniversary of Brexit,
the Government unveiled new designs for
driving licences and number plates without
the EU flag, with the first batches issued
from 1 January 2021.
While existing licences and number plates
will still be valid, the new versions will be
issued to everyone renewing a licence or
getting one for the first time.
The new designs coincide with the
beginning of a number of agreements
recently made between the UK and member
states for British drivers, making it easier
for Britons to drive in the EU when existing
restrictions end.
Thanks to these agreements, UK drivers
who hold photocard licences will not need
an international driving permit to drive in
any of the 27 EU member states, Iceland,
Norway, Switzerland or Liechtenstein. UK
drivers won’t need to display a GB sticker in
most EU countries if their number plate has
GB or GB with a Union Flag on it.
Although national restrictions are still in
place, and people should not be travelling
internationally unless for work or other
legally permitted reasons, these new
arrangements mean that Britons can easily
drive in the EU for years to come
Transport Secretary Grant Shapps said:
“Changing the designs of our driving
licences and number plates is a historic
moment for British motorists, and a
reassertion of our independence from the
EU, one year on from our departure.
“Looking to the future, whether it’s for
work or for holidays abroad, these changes
mean that those who want to drive in the
EU can continue to do so with ease.”
Driving licences and number plates can
be renewed online.
The new licences have
dropped the EU flag for
the Union flag, though
driving rights within the
EU remain
