7.3.1.1 work<strong>in</strong>g hours and vacation entitlements<br />

accord<strong>in</strong>g to law, full-time employment (vollzeitarbeit) is:<br />

� a work<strong>in</strong>g day of 8 hours (with<strong>in</strong> a 24-hour period)<br />

� a weekly work<strong>in</strong>g time of 40 hours (work<strong>in</strong>g period from Monday to Sunday <strong>in</strong>clusive)<br />

Collective barga<strong>in</strong><strong>in</strong>g agreements have shortened the work<strong>in</strong>g week <strong>in</strong> many branches of bus<strong>in</strong>ess. .<br />

A surcharge of 50 percent or compensatory time off is applicable for overtime work.<br />

If the daily work<strong>in</strong>g time exceeds six hours, it must be <strong>in</strong>terrupted by a break of at least half an hour.<br />

This break is unpaid and is not <strong>in</strong>cluded <strong>in</strong> the work<strong>in</strong>g hours.<br />

Other work<strong>in</strong>g hours arrangements are possible: m<strong>in</strong>imum <strong>in</strong>come employment, part-time employment,<br />

seasonal employment etc.).<br />

Workers are granted a vacation entitlement (Urlaubsanspruch) for at least five weeks (= thirty<br />

work<strong>in</strong>g days) per year; this also applies to m<strong>in</strong>imum <strong>in</strong>come employees and part-time employees. In<br />

addition to the regular salary an employee <strong>in</strong> <strong>Austria</strong> is additionally paid a vacation bonus (so-called<br />

13 th monthly salary) and a Christmas bonus (so-called 14 th salary), each amount<strong>in</strong>g to a full monthly<br />

salary; these bonus payments are however subject to lower taxes.<br />

7.3.1.2 term<strong>in</strong>ation<br />

Every employee who has concluded an employment contract or has a position specifications statement<br />

is <strong>in</strong> pr<strong>in</strong>ciple protected by <strong>Austria</strong>n labour law through the term<strong>in</strong>ation notice deadl<strong>in</strong>es.<br />

The follow<strong>in</strong>g term<strong>in</strong>ation deadl<strong>in</strong>es are applicable:<br />

term<strong>in</strong>ation by the employer:<br />

for salaried employees: the Salaried Employees Act regulates the m<strong>in</strong>imum term<strong>in</strong>ation deadl<strong>in</strong>es.<br />

for waged employees: the term<strong>in</strong>ation notice is two weeks pursuant to the <strong>Austria</strong>n Civil Code<br />

(ABGB); however, the collective agreements, employer/works council agreements normally foresee<br />

longer respectively <strong>in</strong> some cases even shorter term<strong>in</strong>ation notice periods.<br />
