Community Access to Information<br />

By-Laws<br />

Council undertook a review of the By-Laws during 2015/2016 and adopted new By-Laws in June 2016 which came into effect<br />

on 1 January 2017.<br />

The South Australian Parliament (Legislative Council) disallowed Council’s By-Law 6 – Cats on 14 October <strong>2021</strong>.<br />

The following By-Laws were in operation at 30 June <strong>2021</strong>:<br />

» By-Law 1 Permits and Penalties<br />

» By-Law 2 Moveable Signs<br />

» By-Law 3 Roads<br />

» By-Law 4 Local Government Land<br />

» By-Law 5 Dogs<br />

» By-Law 6 Cats<br />

Council endorsed a revised draft Cats By-Law at its meeting on 18 January <strong>2022</strong>. The By-Law was subsequently provided<br />

to the RSPCA and Animal Welfare League for comment, and to the Dog and Cat Management Board for formal consultation.<br />

Following receipt and consideration of these comments, Community consultation was undertaken from Friday 27 May –<br />

Friday 1 July <strong>2022</strong>. The By-Law project was incomplete at the end of the financial year.<br />

Copies of adopted By-Laws and associated resolutions are accessible from Council’s website or Council’s office during<br />

business hours.<br />

Freedom of Information<br />

Council received 6 requests for information under the Freedom of Information Act from 1 July <strong>2021</strong> to 30 June <strong>2022</strong> (compared<br />

to 12 in 2020/<strong>2021</strong>).<br />

» Three applications were granted in full<br />

» One application was granted in part. The basis for disallowing access in full for this application was based on Schedule<br />

1 - Exempt Documents - Documents affecting personal affairs – Clause 6 (1) of the Freedom of Information Act 1991<br />

» Two applications were unfinished as at 30 June <strong>2022</strong>, and will be carried forward to the <strong>2022</strong>/2023 reporting period<br />

» Two accredited Freedom of Information Officers spent approximately 3% of their time assessing applications and making<br />

their determinations.<br />

Council publishes an updated Freedom of Information Statement on its website annually in accordance with Section 9(1a) of<br />

the Freedom of Information Act 1991.<br />
