the button if we can get – number 1 Is the Court <strong>of</strong> Appeals<br />
going to be willing to completely reverse and send you back for<br />
a new trial? Number 1. Number 2 are we going to have - be able<br />
to re-litigate and revisit those issues that predate your<br />
confession? In the timeline <strong>of</strong> things I think the Court <strong>of</strong><br />
Appeals is goanna be willing to back up to when your attorney<br />
committed malpractice.<br />
MR. HAEG: Ok.<br />
MR. OSTERMAN: Ok? I don't think the search warrant issues are<br />
goanna be necessarily covered and I don't think I can - I can<br />
get you to escape the complete and total liability – I don't<br />
think the Court <strong>of</strong> Appeals would be willing to do that.<br />
MR. HAEG: Well when I can show that the search warrants – see<br />
I've been doing my research – when the search warrants bad it's<br />
called the poisonous tree.<br />
MR. OSTERMAN: Fruit <strong>of</strong> the poisonous tree. But here's the<br />
situation. The Court <strong>of</strong> Appeals is only going to go back to<br />
what they can clearly identify as being the wrong feature in<br />
your case that produced all the wrong results.<br />
MR. HAEG: Well wasn't that one <strong>of</strong> them?<br />
MR. OSTERMAN: No.<br />
