VANDALS HAVE cost ratepayers up<br />

to $25,000 after yet another attack on<br />

the statue of Captain James Cook in<br />

Victoria Square.<br />

That is the estimated repair bill from<br />

the two attacks, early on <strong>February</strong> 14,<br />

and again the following night.<br />

It is the third time Cook’s statue has<br />

been targeted on the anniversary of<br />

his death – he was killed in Hawaii on<br />

<strong>February</strong> 14, 1779.<br />

During last week’s initial overnight<br />

attack, three of the four sides of the<br />

granite base were daubed with slogans<br />

in red paint proclaiming: ‘Happy Cpt<br />

Cook is Dead Day’, ‘<strong>The</strong> Crown is<br />

Complicit’ and ‘Landback’.<br />

POLICE HAVE spoken with two<br />

people seen on a walking track<br />

moments before the Port Hills<br />

fire was noticed, as part of their<br />

investigation into the blaze that<br />

covered more than 650 ha.<br />

More than 100 houses were<br />

evacuated after the fire on the<br />

Port Hills last Wednesday. One<br />

woman lost her “whole life”<br />

after her container home was<br />

destroyed.<br />

Police have said the fire is being<br />

treated as unexplained.<br />

It can now be revealed residents<br />

near Hoon Hay Valley Rd saw two<br />

people around a walking track on<br />

the hill followed by smoke. <strong>The</strong><br />

pair then drove off with residents<br />

taking photos of the car and<br />

sending them to the police.<br />

A police spokesperson<br />

confirmed police had spoken to<br />

those people, as well as the ones in<br />

the car.<br />

Controversial intersection won’t be closed<br />

remain open after a close<br />

community board vote sealed<br />

its fate.<br />

<strong>The</strong> Main South, Riccarton,<br />

and Yaldurst Rds intersection<br />

was recommended for closure<br />

by city council staff, who said it<br />

was a hot-spot for accidents.<br />

“Over the last 10 years there<br />

have been 81 crashes at the<br />

Main South Rd and Yaldhurst<br />

Rd intersection,” city council<br />

transport operations manager<br />

Stephen Wright said.<br />

“Seventy of those involved vehicles<br />

turning right from Main<br />

South Rd and colliding with<br />

vehicles on Riccarton Rd.”<br />

Two people were seriously<br />

injured, including a cyclist.<br />

Wright said.<br />

<strong>The</strong> contentious topic was<br />

adjourned by the Waipuna<br />

Halswell-Hornby-Riccarton<br />

Community Board last week<br />

and a special meeting held on<br />

Tuesday.<br />

At Tuesday’s meeting, the<br />

debate lasted for two and a half<br />

hours before a decision was<br />

a year has been intercepted by<br />

police and issued with a trespass<br />

presence that night and<br />

he contacted police, who arrived<br />

promptly and interviewed the<br />

man under a street light.<br />

Police told Swanepoel the man<br />

offered no explanation for his<br />

behaviour before being issued<br />

with the notice.<br />

Swanepoel recorded the conversation<br />

on his mobile phone<br />

and hoped it marked the end of<br />

regular attacks which spanned<br />

more than a year.<br />

In the latest attack on Valentine’s<br />

Day cream was poured<br />

over the windscreen of his car<br />

and a tray of raw mince was<br />

shoved into a neighbour’s letterbox.<br />

<strong>The</strong> vandalism typically took<br />

place between 1am and 4am.<br />

“He turned up much earlier<br />

than usual this time,” Swanepoel<br />

said.<br />

“A neighbour texted me<br />

saying he’d spotted him. We<br />

phoned the police, they turned<br />

up very promptly and were extremely<br />

helpful, very kind about<br />

the situation.<br />

“<strong>The</strong>y questioned the man and<br />

he denied it at first. In the end<br />

he did admit he’s been doing it.<br />

He said he had no reason for his<br />

actions. Hopefully this is the<br />

end,” Swanepoel said.<br />

Fatal stab<br />

CHARGES HAVE been dropped<br />

against the man arrested in<br />

connection with the fatal stabbing<br />

of Anaru Williams in a Hei Hei<br />

park.<br />

Williams was found dead with<br />

stab wounds at Wycola Park in<br />

the early hours of December <strong>22</strong>.<br />

A 36-year-old man was found at<br />

the scene and taken into custody.<br />

He later appeared in the district<br />

court in December charged with<br />

assault.<br />

Days later a 31-year-old woman<br />

appeared in court on a charge of<br />

wounding with intent to cause<br />

grievous bodily harm.<br />

Another person was referred to<br />

Youth Aid in relation to the fatal<br />

attack.<br />

Police have said they have not<br />

ruled out further, more serious<br />

charges. <strong>The</strong> man appeared in<br />

court last Friday and his matter<br />

was “finalised”.<br />

“Police carried out a review<br />

once the investigation was complete<br />

and determined under the<br />

Solicitor General’s Guidelines<br />

the threshold for prosecution had<br />

not been met in this instance,” a<br />

police spokesperson confirmed.<br />

“<strong>The</strong> charge was therefore<br />

withdrawn.” <strong>The</strong> 36-year-old has<br />

been granted permanent name<br />

suppression.<br />

THE PORT Hills fire has<br />

forced the cancellation of<br />

major mountain biking event,<br />

Crankworx Summer Series.<br />

It was to be held at Christchurch<br />

Adventure Park from March 1-3.<br />

However, the fire has put paid<br />

to the event, organisers have announced.<br />

“At this time, the situation<br />

remains in the hands of the fire<br />

service and the full extent of<br />

the impact on the Port Hills,<br />

(Christchurch Adventure Park),<br />

and surrounding areas is yet to<br />

be fully determined,” Crankworx<br />

wrote in a statement on Facebook.<br />

“It is with a heavy heart that we<br />

must announce the complete cancellation<br />

of Crankworx Summer<br />

Series New Zealand for <strong>2024</strong>.<br />

Crankworx was “deeply saddened”<br />

by the decision, it said.<br />

said the decision was “disappointing,<br />

but understandable”.<br />

Staff at the park were “fully<br />

focussed” on preparing the park<br />

to reopen to the public as soon as<br />

in New Zealand on October 8,<br />

1769, left a legacy of scientific<br />

and geographical knowledge, he<br />

is also a controversial figure in<br />

prompted a call to station<br />

security guards at the landmark<br />

to prevent another costly restoration<br />

materials and remedial work<br />

undertaken by a heritage conservator.<br />

bookmaker and philanthropist<br />

Matthew Barnett, and was<br />

shaped from a 12-tonne block of<br />

1932 and moved to a more central<br />

location when motor vehicle<br />

traffic on Victoria St stopped<br />

flowing through the square in<br />

1989.<br />

Monuments to Cook have<br />

drawn criticism in the past,<br />

particularly in present-day<br />

Gisborne, where his crew killed<br />

local Māori during an early<br />

interaction at the Turanganui<br />

River.<br />

In 2019, the statue of Cook<br />

on Gisborne’s Titirangi Hill<br />

wife has drawn plenty of interest.<br />

<strong>The</strong> five-bedroom, three-bathroom<br />

property in Chevron Pl<br />

was put on the market by receivers<br />

Waterstone Insolvency with a<br />

sale deadline of 4pm Tuesday.<br />

It is the family home of Marc<br />

Findlay and Deborah Jane<br />

Robinson-Findlay, who were<br />

both placed into receivership in<br />

December.<br />

Waterstone Insolvency is acting<br />

on behalf of Auckland-based<br />

business finance lender Ignite<br />

Solutions Ltd.<br />

Other unidentified creditors are<br />

involved. Waterstone Insolvency<br />

would not reveal the scale of the<br />

debts incurred by the couple.<br />

Although it had a rateable<br />

value of $1.18 million in August<br />

20<strong>22</strong>, extensive renovations<br />

were undertaken after a consent<br />

to add two bedrooms and an<br />

ensuite was issued in 2021.<br />

“We have received a number<br />

of offers that the receivers are<br />

currently reviewing,” said Waterstone<br />

Insolvency consultant<br />

Peter Drennan.<br />

Findlay, a sole trading individual<br />

project manager, said he<br />

had not worked for six months, a<br />

factor leading to the home being<br />

sold.<br />

week, Findlay was adjudged<br />

bankrupt in 2017, leaving<br />

Christchurch tradespeople thousands<br />

of dollars out of pocket.<br />

Family reveals reason for Goldie sale<br />

Graham has revealed why they<br />

are selling six paintings by iconic<br />

artist Charles Goldie.<br />

Art+Object on March 25.<br />

they will be exhibited in the<br />

Christchurch next month.<br />

So we just figured someone<br />

should enjoy them now and we<br />

can see them enjoy it and get the<br />

thrill of owning them like dad<br />

did.”<br />

rich-lister, assembled the pieces<br />

between 2005 and 2013 before he<br />

died in 2015 aged 71.<br />

Goldie, who was considered<br />

the finest painter of kaumātua<br />

and people of importance, died<br />

in 1947 aged 76.<br />

“Two or three million<br />

dollars (for a painting) is not<br />

unreasonable. New Zealand,<br />

only in the last decade or so,<br />

has started to get prices past $1<br />

million,” Roberts said.<br />

<strong>The</strong> prized piece in<br />

the collection, Te Aho O Te<br />

Rangi, A Noted Waikato Warrior,<br />

has a catalogue price of $2-3<br />

million.<br />

Roberts said because multiple<br />

pieces are going up at once,<br />

they are more likely to achieve a<br />

higher sales value compared to<br />

the sale of just one.<br />

Colin McCahon’s 1982<br />

painting holds the current record<br />

for the most expensive New<br />

Zealand artwork which sold for<br />

$2.45m in September 20<strong>22</strong>.<br />

overseas buyer with current<br />

regulations in the Antiquities<br />

Act which protect New Zealand<br />

Developer calls for his day in court<br />

PROPERTY developer Dave<br />

Henderson wants to be tried in<br />

a court in front of a jury of his<br />

peers.<br />

Either that, he says, or the<br />

Crown should withdraw charges<br />

hanging over his head for almost<br />

nine years, and which are now in<br />

a legal limbo.<br />

A judge said in 2019 the prosecution<br />

of Henderson for alleged<br />

breaches of the Insolvency Act<br />

was an “astronomical” waste of<br />

taxpayers’ money.<br />

And Henderson is prepared<br />

to go to the Supreme Court to<br />

lay down his challenge to put<br />

him on trial or drop the charges<br />

completely.<br />

“I’m not afraid of the court.<br />

I’m not afraid of going there. I’m<br />

not afraid of a robust hearing,”<br />

Henderson said.<br />

“[I’m] not afraid of any of that<br />

because I know, at the end of<br />

the day, the charges were laid<br />

malevolently.”<br />

Henderson was referring to<br />

charges dating back to the middle<br />

of last decade and which the<br />

Court of Appeal has described as<br />

“relatively trivial in nature”.<br />

In 2015, two representative<br />

charges were filed against Henderson,<br />

alleging he had broken<br />

the law by being involved in<br />

the management of a business<br />

while he was an undischarged<br />

bankrupt.<br />

Henderson, who was bankrupted<br />

in 2010 but has since been<br />

discharged, says he had permission<br />

to do that.<br />

In 2016, a further charge was<br />

laid alleging that he made a false<br />

statement about his employment<br />

and income over the previous<br />

years. He denies that too.<br />

Henderson is no stranger to<br />

legal battles with government<br />

agencies and officials.<br />

He was once chased by Inland<br />

Revenue for a supposed tax bill of<br />

nearly $1 million, proving after<br />

a five-year fight and financial<br />

devastation that, in fact, the department<br />

owed him $65,000.<br />

He later bought the Cashel<br />

St building which housed the<br />

Inland Revenue staff who had<br />

pursued him.<br />

He renamed it and for three<br />

years they had to go to work at<br />

Henderson House. When the<br />

lease ran out, he evicted them.<br />

Henderson wrote a book about<br />

his Inland Revenue fight, titled<br />

Be Very Afraid. <strong>The</strong> book then inspired<br />

a 2007 movie, We’re Here<br />

This time, Henderson’s<br />

protagonists are the Official Assignee,<br />

the public servant who<br />

administers the Insolvency Act<br />

within the Ministry of Business,<br />

Innovation and Employment<br />

(MBIE), and Crown Law.<br />

Henderson’s current case<br />

has been described as a<br />

“low-priority” by the Deputy<br />

Solicitor-General and the charges<br />

“relatively trivial” by the Court of<br />

Appeal.<br />

<strong>The</strong> penalties involve a maximum<br />

jail term of two years, but<br />

other people convicted of similar<br />

offences have typically received<br />

sentences ranging from community<br />

work to home detention.<br />

<strong>The</strong> case has already eaten<br />

up enormous amounts of court<br />

time. It took 13 hearings over two<br />

years before a district court judge<br />

determined there was sufficient<br />

evidence for a jury to hear.<br />

As the accused, Henderson was<br />

entitled to disclosure – to see the<br />

evidence that Crown Law would<br />

rely on.<br />

over long-delayed insolvency case<br />

Because of his past battles,<br />

there were thousands of documents,<br />

leading to ongoing arguments<br />

and delays.<br />

When the proceedings came<br />

back before Judge Raoul Neave in<br />

the district court in 2019, he said<br />

the case had gone on longer than<br />

it should have.<br />

“<strong>The</strong> amount of money, taxpayers’<br />

money, that has been wasted<br />

on this case is astronomical,”<br />

Judge Neave said.<br />

In a minute issued shortly after<br />

that, Judge Neave asked Crown<br />

lawyers to reflect on continuing<br />

the prosecution given the “vast<br />

amount of State resources” being<br />

consumed.<br />

But by 2020, the Crown still<br />

believed there was enough<br />

evidence, the prosecution still<br />

had public interest, and the only<br />

reason counting against it was<br />

the time it had taken.<br />

Crown lawyers maintained this<br />

was not their fault.<br />

When the case came back<br />

before Judge Neave, he again said<br />

that “we’ve got better things to be<br />

doing to be quite frank”, but he<br />

would let the case take its course.<br />

He gave the Crown a month<br />

to provide details of the vast<br />

case file to a court-appointed<br />

“amicus” or third-party reviewer.<br />

<strong>The</strong>n the 2020 Covid lockdown<br />

intervened.<br />

put even more pressure on the<br />

court system, the Chief Justice<br />

asked prosecutors to consider<br />

whether cases should proceed.<br />

In 2020, the Deputy Solicitor-<br />

General, who at that time was<br />

Brendan Horsley, then stayed the<br />

Henderson proceedings.<br />

This means the charges won’t<br />

come to court, but instead go into<br />

a legal limbo where questions<br />

of guilt or innocence are never<br />

determined.<br />

“<strong>The</strong>y didn’t consult me. If<br />

they had said, ‘we’re either going<br />

to stay these [charges] or we<br />

might have to delay it a few more<br />

months’, I would have said ‘just<br />

delay it a few more months’.<br />

“I want my day in court,”<br />

Henderson said.<br />

“We all know there is a whole,<br />

lame, metaphor that where there<br />

is smoke there’s fire.<br />

“So, everyone is left with a<br />

view that ‘you know, he did do it,<br />

whatever it is, he’s just lucky’.<br />

“I’m not interested in being<br />

lucky. I know my hands are clean<br />

and I want my day in court. Or<br />

withdraw the charges.”<br />

Henderson made an application<br />

to the High Court to have<br />

the stay removed so he could<br />

have that day in court. That<br />

failed, so he took the matter to<br />

the Court of Appeal.<br />

“Mr Henderson seeks to be<br />

tried before a jury of his peers,”<br />

noted the Court of Appeal judgment.<br />

It also turned down his request<br />

to have the stay removed.<br />

It found the public interest, not<br />

the interests of a particular defendant,<br />

is the only “mandatory<br />

consideration” in whether or not<br />

to grant a stay of prosecution.<br />

Henderson said he would now<br />

seek leave to take the matter to<br />

the Supreme Court.<br />

Part of Henderson’s argument<br />

is that the charges were stayed so<br />

the Crown could avoid criticism,<br />

public shaming and embarrassment<br />

about the way the prosecution<br />

had been conducted.<br />

When asked for comment,<br />

Crown Law emailed a statement,<br />

citing the Court of Appeal<br />

judgment which said the appeal<br />

judges were “readily satisfied<br />

there is no proper basis for these<br />

assertions”.<br />

Asked to explain why the<br />

charges were stayed rather than<br />

withdrawn, Crown Law drew<br />

attention to paragraphs in the<br />

judgment which said the Deputy<br />

Solicitor-General and a District<br />

Court judge had found there<br />

was sufficient evidence on which<br />

a properly directed jury could<br />

convict.<br />

<strong>The</strong> judgment said matters<br />

taken into account in making the<br />

decision to stay the proceedings<br />

included the length of time the<br />

case had taken, the “intervention”<br />

of the Covid-19 pandemic,<br />

stresses on the courts, likely<br />

further delays, the impact on<br />

Henderson, and the “relatively<br />

trivial nature of the charges”.<br />

“<strong>The</strong>re is in our view nothing<br />

to suggest that the Deputy<br />

Solicitor-General failed to take<br />

into account relevant considerations,<br />

or took into account irrelevant<br />

considerations,” the appeal<br />

judges said.<br />

Crown Law added as Henderson<br />

had said he intended to seek<br />

leave to appeal to the Supreme<br />

Court, “we do not propose to<br />

comment any further”.<br />

and will fund its construction,”<br />

But Broughton, who has<br />

previously called for the<br />

discussion to be Canterburywide,<br />

reiterated that in a<br />

responding letter to Mauger.<br />

“We believe this conversation<br />

about the operations of a<br />

regional facility needs to be with<br />

the whole region in the first<br />

instance, rather than just with<br />

Selwyn and Waimakariri.”<br />

Mauger said Selwyn and<br />

Waimakariri were chosen<br />

because they are direct<br />

neighbours to Christchurch.<br />

“<strong>The</strong>ir level of interest will<br />

be crucial in any discussion,<br />

including any potential<br />

discussion at a regional level,”<br />

Mauger said.<br />

“This is only a very early first<br />

step on formal discussions and<br />

suggested a levy could be placed<br />

on users of the stadium from<br />

outside of the city.<br />

Broughton said he was open<br />

to receiving the conversational<br />

proposal, but has not committed<br />

to funding it.<br />

“We do not have any funds<br />

currently set aside and have no<br />

plans in our future budgets to<br />

start contributing.”<br />

He said any funding<br />

assistance would be consulted<br />

on with residents.<br />

“Any future decision to<br />

contribute or not also needs<br />

to be put to the community<br />

through proper<br />

consultation to<br />

understand their<br />

desire and ability to<br />

pay. This has been my<br />

commitment to the<br />

Selwyn community<br />

which I have reinforced<br />

every time I have been<br />

asked about the topic,”<br />

Broughton said.<br />

Mauger said Te Kaha is<br />

expected to open in mid-2026<br />

and operational costs are<br />

forecast to start in the 2026-27<br />

financial year.<br />

Council spokesperson<br />

confirmed the letter had been<br />

received and the council would<br />

meet in the coming weeks to<br />

consider it.<br />

“Currently, there is no<br />

funding put aside or anticipated<br />

in our Long Term Plan for this.<br />

would need to be subject to full<br />

community consultation before<br />

that. But what I would say<br />

also is where it’s happened in<br />

other areas it has been capital<br />

regionally rather than operating<br />

expenditure.”<br />

At this stage, all Mauger said<br />

he is asking for is whether the<br />

councils will receive a funding<br />

proposal.<br />

“This is not asking you to<br />

make a binding decision, only<br />

whether you would be willing to<br />

“athlete” – is facing two charges<br />

in the district court.<br />

An interim suppression order<br />

prevents the reporting his name<br />

and any other identifying details.<br />

He has pleaded not guilty to<br />

both charges and has elected a<br />

A PROMINENT far-right<br />

activist has been sentenced to<br />

community detention with<br />

supervision after he was found<br />

in possession of a prohibited<br />

firearm despite not holding a<br />

firearms licence.<br />

Kyle Chapman, the former<br />

leader of the far-right National<br />

Front white nationalist group,<br />

was arrested following a search<br />

warrant at a Christchurch<br />

address on September 8.<br />

<strong>The</strong> 52-year-old was charged<br />

with the unlawful possession of<br />

firearms and ammunition.<br />

He was sentenced in the district<br />

court by Judge Tom Gilbert<br />

on Tuesday,<br />

According to the summary<br />

of facts, police found a Norinco<br />

7.62mm rifle stored in the wardrobe<br />

of his bedroom.<br />

He was also in possession of<br />

a 7.62mm magazine, which was<br />

kept in a camo-print bag under<br />

his bed. Three other 7.62mm rifle<br />

rounds, 46 .<strong>22</strong> calibre rounds,<br />

three 12-gauge shotgun shells<br />

and two .<strong>22</strong> magazines were also<br />

in the bag.<br />

In the garage was a zip-lock<br />

bag containing 82 .<strong>22</strong> rounds of<br />

ammunition and one 7.62 round<br />

responsibilities as a father and he<br />

has pulled back from activism.<br />

He said Chapman was “fairly<br />

self-motivated” in addressing the<br />

needs he had.<br />

Judge Gilbert said there was no<br />

suggestion the firearms he was in<br />

possession of were used or taken<br />

into the public.<br />

Chapman had some previous<br />

convictions but they were from<br />

more than 30 years ago.<br />

“<strong>The</strong>y are now so old that in<br />

my view that can’t have a material<br />

bearing on the sentence I<br />

impose on you today,” Judge<br />

Gilbert said.<br />

<strong>The</strong> judge had read the<br />

pre-sentence report including<br />

letters from his children and his<br />

partner.<br />

“It’s apparent you’ve been<br />

involved as an activist over the<br />

years for various causes, including,<br />

at times, far-right groups.<br />

“<strong>The</strong> pre-sentence report says<br />

that you have told the writer that<br />

you have decided to give those<br />

activities away and focus primarily<br />

on your family.”<br />

Judge Gilbert said he would<br />

ordinarily be “somewhat sceptical”,<br />

but the material he had<br />

read did suggest this is what has<br />

happened.<br />

<strong>The</strong> pre-sentence report writer<br />

said he was at a “low risk of reoffending”.<br />

He sentenced Chapman to<br />

six months of home detention<br />

with supervision. <strong>The</strong> various<br />

firearms and ammunition would<br />

be forfeited to the Crown.<br />

Chapman earlier posted on<br />

Facebook that he “got raided and<br />

arrested”.<br />

“Thank (sic) a miracle from<br />

God I was not held in custody.<br />

But I am looking at jail in the<br />

future.”<br />

Rapist allowed to<br />

appeal verdict at<br />

Supreme Court<br />

A MAN who continues to claim<br />

sexsomnia made him rape a woman who<br />

was passed out after a night of drinking<br />

has been given the green light to have his<br />

case heard by the Supreme Court.<br />

Damin Peter Cook is currently behind<br />

bars after a jury rejected he was asleep<br />

or unconscious at the time of the 2019<br />

offending.<br />

Cook, who is in his mid-40s, argued at<br />

trial that he has no memory of the incident<br />

and that he suffers sexsomnia, a type of<br />

parasomnia or movement disorder that<br />

occurs during sleep.<br />

In September 20<strong>22</strong>, he was sentenced in<br />

the district court to eight years in prison<br />

on one charge of sexual violation by unlawful<br />

sexual connection and one charge<br />

of sexual violation by rape.<br />

Both convictions relate to the sexual<br />

assault of a woman three years prior. Cook<br />

had been partying with the victim<br />

one evening in September 2019<br />

at a house in Christchurch. She<br />

had passed out in a bedroom and<br />

around 7am, she was woken by<br />

Cook who was having sex with her.<br />

<strong>The</strong> woman was afraid and<br />

pretended to be asleep but, shortly<br />

after, she left the bedroom and told<br />

a friend what happened, and the<br />

police were alerted.<br />

Last year, Cook took his case to<br />

the Court of Appeal, challenging<br />

his convictions and sentence.<br />

While his appeal against conviction<br />

was dismissed, his sentence was<br />

quashed and replaced with a jail term of<br />

seven years after the appeal court found<br />

the sentencing judge’s starting point was<br />

too high.<br />

Cook has now turned to the Supreme<br />

Court to have another go at having his<br />

convictions overturned.<br />

On Monday, the Supreme Court – the<br />

court of last resort – released a judgment<br />

granting his application for leave to appeal<br />

the Court of Appeal’s ruling.<br />

<strong>The</strong> judgment stated the Supreme Court<br />

would consider whether the Court of Appeal<br />

was correct to treat Cook’s defence as<br />

insane automatism.<br />

According to the Court of Appeal decision,<br />

the trial judge’s directions to the jury<br />

applied the law as held by the Court of Appeal<br />

from the earlier, relevant case of Tony<br />

In that case, the court held Cameron’s<br />

sexsomnia was a form of insane<br />

automatism.<br />

“As a result, the defendant had the<br />

burden of showing that he suffered from<br />

a disease of the mind to the extent that he<br />

did not understand the nature and quality<br />

of his act.”<br />

But the court did not hold that sexsomnia<br />

generally is insane automatism and<br />

stated the classification depends on the<br />

evidence in the particular case.<br />

Cook submitted to the trial judge that<br />

the Cameron case was wrongly decided<br />

and that he should not follow it.<br />

He wanted the judge to rule<br />

that sexsomnia is a form of sane<br />

automatism.<br />

“That would mean that, where<br />

there is an evidential foundation<br />

for the defence, it would be for the<br />

Crown to exclude the reasonable<br />

possibility that a defendant acted<br />

without conscious volition.”<br />

But the trial judge followed the<br />

Cameron case, as he was bound to<br />

do, the Court of Appeal decision<br />

stated.<br />

<strong>The</strong> court was ordinarily bound<br />

by its earlier decisions and would<br />

only depart from them in rare cases where<br />

there was cogent reason to do so.<br />

At the appeal, Cook’s counsel repeated<br />

submissions that the Cameron case was<br />

wrongly decided and that Cook’s convictions<br />

should be quashed accordingly.<br />

But the Court of Appeal said it had no<br />

reason to depart from the Cameron case<br />

and dismissed the appeal against conviction.<br />

“<strong>The</strong> issue of whether sexsomnia can be<br />

a form of sane automatism or insanity was<br />

central to the Court’s decision,” the decision<br />

stated.<br />

“<strong>The</strong> Court conducted a review of the<br />

common law history of the defences of<br />

sane automatism and insanity. <strong>The</strong> Court’s<br />

analysis was orthodox and did not result<br />

in a radical or striking change to the law.”<br />

A date is yet to be set for Cook’s appeal.<br />

IN thE EYE<br />

Recently Steve saw a cool 10 month old<br />

hearding dog called Kip with a swollen<br />

bulging right eye. Kip had been treated<br />

by his primary veterinarian for this eye<br />

issue 2 months before Steve saw Kip.<br />

Being a valuable working dog, it was very<br />

important Kip didn’t lose sight in this eye,<br />

so Kip was referred to Steve.<br />

Clinically Kip was working normally. His<br />

owner noticed he was struggling to eat<br />

comfortably, had gone off dry food and<br />

was shying away from anything near<br />

the right side of his face. His oral cavity<br />

and teeth were all normal. His eye was<br />

inflamed and there was a crusty bloody<br />

discharge seen. His cornea was normal.<br />

Richard Lucy ultrasounded the eye and<br />

suspected a foreign body, most probably<br />

a grass seed.<br />

Steve then anaesthetised Kip and went<br />

in surgically, saw a draining sinus tract<br />

at the inside cornea of his eye- the tract<br />

travelled up between the eye and orbital<br />

rim. Steve probed with a long pair of<br />

curved forceps and removed a large<br />

barley grass awn. Hugely satisfying and a<br />

fantastic outcome for Kip.<br />

Kip stayed a few days in our hospital. One<br />

morning the hospital nurse came in and<br />

found Kip on the top of our kennels. A<br />

Mosquito warning issued<br />

after warmer weather<br />

gives boost to breeding<br />

DANGEROUS exotic<br />

mosquitoes’ ability to breed in<br />

Lyttelton is increasing due to<br />

climate change.<br />

After a hot summer, residents<br />

are being urged to check their<br />

properties for potential mosquito<br />

breeding habitats due to the close<br />

proximity of homes to the port.<br />

“If exotic mosquitoes were to<br />

sneak through, breed, and infect<br />

people, the results could be disastrous.<br />

<strong>The</strong> diseases they carry<br />

cause severe illness and can be<br />

fatal,” said Dr Matt Reid, medical<br />

officer of health for the National<br />

Public Health Service.<br />

Health protection officers monitor<br />

the area around the port for<br />

evidence of foreign mosquitoes,<br />

particularly those which could<br />

threaten public health.<br />

money for everyday essentials,<br />

including food, a new study<br />

shows.<br />

Researchers at the city’s Otago<br />

University campus surveyed<br />

more than 370 people, comprising<br />

of public housing tenants<br />

and senior residents, all of whom<br />

faced “transport difficulty”.<br />

Half price bus fares ran for 14<br />

months in Christchurch before<br />

ending in June 2023.<br />

<strong>The</strong> scheme reduced an adult<br />

single fare zone in Christchurch<br />

to $1.30 with a MetroCard, or<br />

$2.10 cash.<br />

Other centres around the<br />

country phased out half price<br />

fares last year, including in both<br />

Auckland and Wellington where<br />

it was wrapped up in July and<br />

September, respectively.<br />

<strong>The</strong> study found almost half of<br />

participants were able to afford<br />

additional trips, with more than<br />

a third able to spend money on<br />

food and other essentials as a<br />

result.<br />

Dr Angela Curl, a senior<br />

lecturer at Otago’s department<br />

of population health, said research<br />

found those experiencing<br />

“transport poverty” benefited in<br />

terms of accessibility and easing<br />

financial stress.<br />

“We know that public housing<br />

residents, including those in our<br />

study, experience transport difficulties<br />

related to affordability<br />

and accessibility, with Statistics<br />

New Zealand figures showing the<br />

lowest income households spend<br />

more than a quarter of their incomes<br />

on transport,” she said.<br />

“Our findings show that for<br />

many who live in public housing,<br />

access to reduced fares on public<br />

transport reduces their financial<br />

stress, gives them the ability to<br />

get to places they need, removes<br />

anxiety, and improves their wellbeing<br />

and social contact.”<br />

Participants were asked about<br />

awareness, use and impact of half<br />

Climate Action Campus will<br />

have its lease and scope extended<br />

despite opposition from residents<br />

concerned about the state of the<br />

red zone component.<br />

<strong>The</strong> campus, which occupies<br />

the old Avonside Girls’ High<br />

School site and 1.8 hectares<br />

of red zone land bordered by<br />

Cowlishaw and Patten Sts, can<br />

stay for another three years<br />

providing upkeep issues are<br />

addressed.<br />

When the lease extension<br />

application was advertised,<br />

city council staff received two<br />

complaints from neighbours<br />

unhappy about a BMX track<br />

being added to the campus.<br />

<strong>The</strong>y were also upset about the<br />

deteriorating appearance of the<br />

area.<br />

One resident of 36 years in<br />

the area described the red zone<br />

site as an eye sore with broken<br />

wooden pallets, plastic chairs<br />

and rubbish strewn over the area.<br />

<strong>The</strong>y had noticed a “dramatic<br />

decline” in the appearance and<br />

wellbeing of the area since the<br />

campus opened in 2021, claiming<br />

planted gardens were overgrown<br />

with weeds.<br />

Former mayor Vicki Buck, a<br />

driving force behind establishing<br />

the campus, said the BMX track<br />

had been removed but<br />

disputed claims the<br />

red zone land was in<br />

disrepair.<br />

“For a very brief time<br />

there was a bike track and<br />

it wasn’t quite far enough<br />

from residents so we’ve<br />

taken it away,” she said.<br />

doing here, is so much<br />

bigger than two residents<br />

complaining about some<br />

<strong>The</strong> new lease<br />

conditions also allow the<br />

campus, which is officially<br />

part of Ao Tawhiti Unlimited<br />

Discovery in the central city, to<br />

add beehives and hut building to<br />

its educational programme.<br />

A community solar farm may<br />

be added in the future.<br />

“<strong>The</strong> concept of it is kids come<br />

here to take action on climate<br />

change with their teachers,” Buck<br />

said.<br />

“A lot of the kids enjoy<br />

growing vegetables, horticulture,<br />

composting, all those sorts of<br />

things.<br />

“This is about environmental<br />

concerns, this is about<br />

environmental education and<br />

taking action on climate change.”<br />

A council report said the<br />

lease would be approved on the<br />

basis the issues raised will be<br />

addressed ongoing, particularly<br />

around rubbish and the general<br />

upkeep and appearance of the<br />

area.<br />

Campus staff did agree to<br />

be more vigilant in removing<br />

broken pallets plus increase site<br />

maintenance and sweeps for<br />

rubbish. <strong>The</strong> campus, which<br />

is used on a daily basis and is<br />

believed to be the first of its<br />

kind in Australasia, originally<br />

involved eight schools but the<br />

number has now ballooned to 23<br />

educational institutions.<br />

Merivale<br />

bridges<br />

to be<br />

replaced<br />

TWO BRIDGES in Merivale will<br />

be demolished and rebuilt, as the<br />

structures have reached the end of<br />

their design life.<br />

<strong>The</strong> bridges at Poynder Ave and<br />

Garden Rd will be rebuilt to new<br />

structural standards.<br />

Works start on March 4 with<br />

each bridge expected to take<br />

about four months to complete.<br />

<strong>The</strong> Poynder Ave bridge will be<br />

built first.<br />

City council transport planning<br />

and delivery manager Jacob<br />

Bradbury said the bridges have<br />

reached the end of their design<br />

life and need to be upgraded for<br />

safety reasons.<br />

“We appreciate this project will<br />

be disruptive to nearby residents<br />

and to road users, but we are aiming<br />

to minimise this by doing one<br />

bridge at a time,” he said.<br />

“Our contractors will be doing<br />

their best to have these works<br />

completed as quickly as possible,<br />

but there will be increased trucks<br />

and machinery in the area while<br />

the works are going on.”<br />

<strong>The</strong> design for the new<br />

bridges includes the addition of<br />

pedestrian footpaths.<br />

YOUNG LOCK Liam Jack is<br />

following in the footsteps of<br />

his father and uncle – he is<br />

on a pathway to becoming a<br />

Crusader.<br />

Liam is the son of former<br />

Crusader Graham Jack, who<br />

made four appearances in the<br />

victorious 1998 season and<br />

played 21 times for Canterbury,<br />

and nephew of Chris Jack who<br />

played more than 100 times for<br />

the Crusaders and earned 67<br />

caps for the All Blacks.<br />

Liam, 19, who toured the UK<br />

and Ireland with the Crusaders<br />

during their pre-season matches<br />

against Munster and Bristol, and<br />

played against the Highlanders<br />

in Methven last week, said it was<br />

an ‘awesome experience’.<br />

“It was cool to be a part of that<br />

environment, with all the professionals<br />

and stuff like that.<br />

“Yeah, they’re really friendly<br />

and really inviting in that space.<br />

It was really cool to see how they<br />

did things.”<br />

He said it was a goal to follow<br />

in his father’s and uncle’s<br />

footsteps.<br />

“Yeah, it’s pretty cool to hopefully<br />

have the same experience as<br />

they did one day with putting on<br />

the same jersey as them.”<br />

Graham said Liam had worked<br />

hard to be where he’s at.<br />

“He’s put in a huge amount of<br />

work to get there.<br />

“It’s a factor of years of work<br />

through his schooling, and a lot<br />

of support from a lot of different<br />

coaches over the years.<br />

This is Liam’s second year<br />

in the academy and he juggles<br />

his rugby commitments with<br />

academics – he is studying a<br />

Batchelor of Architecture at Ara.<br />

“It takes quite a bit of communicating<br />

between the managers<br />

of the academy and the the tutors<br />

at Ara,” he said.<br />

“But you can get around it<br />

pretty easy and just get a good<br />

schedule going and things go<br />

pretty smoothly after that.”<br />

Liam only found out he was<br />

travelling to the UK two days<br />

before the team left - which lead<br />

to a bit of a mad rush.<br />

“Yeah, it was a quick turnaround,”<br />

he said.<br />

“Had to get a passport sorted,<br />

which was good fun.”<br />

He said he leans on his dad<br />

and uncle for advice often.<br />

“Having them there to help<br />

me when I need it, yeah. <strong>The</strong>y’re<br />

pretty open to helping me out<br />

and always there for me if I need<br />

“When he (Graham) did his<br />

thing with the Crusaders he was<br />

doing full time work being an<br />

engineer, so he had that balance<br />

real nailed down between the<br />

two, and he’s able to help me out<br />

with just trying to get my study<br />

done and as well as trying to<br />

make a rugby career.”<br />

Graham agreed and said he<br />

tries to stay out of the way when<br />

it comes to proper coaching.<br />

“I don’t really get too involved<br />

in the technical side. I just talk<br />

more at a level about what he’s up<br />

to, and show an interest, but I’m<br />

not really that active in what he’s<br />

doing day to day.”<br />

Graham said he’s very proud of<br />

his son’s achievements so far.<br />

“To see your kids succeed in<br />

whatever they’re choosing to<br />

pursue is very exciting and it<br />

just happens to be something<br />

that myself and my brother had<br />

previously been a part of, so that<br />

makes it pretty cool as well.”<br />

‘Tough’ final likely for<br />

Burnside and Park<br />

BURNSIDE WEST Uni are<br />

looking to avenge last year’s<br />

loss in the Christchurch Metro<br />

premier one-day competition<br />

final when they face Lancaster<br />

Park on Sunday.<br />

It is Burnside’s third final in<br />

as many years, after winning the<br />

trophy in 20<strong>22</strong> but losing to Old<br />

Boys Collegians last season.<br />

Captain Matt Hay said the<br />

team isn’t worrying about what<br />

happened last year.<br />

“We’ve got quite a young<br />

group and guys are just really<br />

excited, more so about this<br />

weekend rather than worrying<br />

too much about last year, just<br />

excited to be in the final again,<br />

have it at home – looking<br />

forward, I suppose, rather than<br />

looking back.”<br />

By virtue of topping the table<br />

in the round-robin stage, the<br />

final will be held at Burnside<br />

Park. Hay said it was a big bonus<br />

for the team.<br />

“<strong>The</strong> guys really enjoy playing<br />

at Burnside because it probably<br />

is the biggest ground on the<br />

circuit too, so yeah it’s nice to be<br />

at home.<br />

“We’ve got a good club, obviously<br />

good facilities and it’s just<br />

nice to be in a familiar place,<br />

and for our members and stuff<br />

to come down and watch and<br />

enjoy Burnside Park.”<br />

In Burnside’s 20<strong>22</strong> victory,<br />

they beat Lancaster Park in the<br />

final, but Park captain Angus<br />

Hamilton said there’s no bad<br />

blood.<br />

“It’s not really something we<br />

speak about too much with the<br />

group, I guess.<br />

“You never really need any<br />

extra motivation for a final, but I<br />

guess it’d definitely be nice to be<br />

going back.”<br />

Hamilton was there when<br />

Lancaster Park last won the<br />

competition in 2019, and played<br />

in the 20<strong>22</strong> final loss.<br />

He said he would try to help<br />

less experienced players who<br />

hadn’t played finals before.<br />

“Just trying to pass on to the<br />

younger guys, not to shy away<br />

from the occasion.<br />

“It’s obviously a pressure-filled<br />

match and it can be easy to get<br />

overwhelmed by it a bit and go<br />

into your shell.”<br />

Lancaster Park beat Burnside<br />

when the two teams met in the<br />

round robin, and Hamilton said<br />

they could take confidence from<br />

that result.<br />

“It was a pretty tight game and<br />

I guess probably the last couple<br />

of times before that, we’ve gotten<br />

into a similar situation and<br />

not been able to get across the<br />

line, like in the final a couple of<br />

years ago.”<br />

“So you’re always aware, even<br />

if they’re sitting right down<br />

there, you’ve still got to stay on<br />

the ball to make sure you knock<br />

Park’s team as well.<br />

“<strong>The</strong>y’ve got some matchwinners<br />

through their line up,<br />

and are a very good competitive<br />

“You know that they’re always<br />

up for a contest and a fight, so<br />

I think it’s gonna be a really,<br />

really good, tough game on<br />

Huyser joins 300 club<br />

Carl Huyser has become only<br />

the second person to play 300<br />

premier matches for the club.<br />

Huyser last week joined<br />

former fast bowler Scott Inglis,<br />

who took the most wickets for<br />

Burnside in their history with<br />

614, including best figures of<br />

9/49.<br />

Huyser signed up with<br />

Burnside in 2008 after moving<br />

to Christchurch from South<br />

Africa, and has become their<br />

third-highest run-scorer,<br />

behind Jack Kerr and Brian<br />

Hastings. He assisted the team<br />

in winning three trophies – the<br />

50 over competition in 2018<br />

and 20<strong>22</strong>, and the two-day<br />

competition last year.<br />

When asked about his<br />

achievements, he downplayed<br />

them.<br />

“For me, the things that are<br />

special are more the friendships<br />

you make and the connections<br />

and the people you play with,”<br />

he said.<br />

Under Huyser’s captaincy in<br />

2018 the club took their first<br />

trophy in 27 years, winning the<br />

one-day competition. He was<br />

captain from 2017–2021. Last<br />

year he helped the team to their<br />

first two-day title since 1991.<br />

HARNESS RACING New<br />

Zealand chief executive Gary<br />

Woodham has resigned, citing<br />

health issues.<br />

Woodham suffered a medical<br />

event while working at the HRNZ<br />

headquarters at Addington<br />

Raceway last April and underwent<br />

surgery.<br />

He subsequently took an<br />

extended period of medical leave<br />

before announcing his decision<br />

to stand down from the role last<br />

week.<br />

“I have recently experienced<br />

challenging health issues and<br />

have decided to resign to focus on<br />

recovery and spending time with<br />

my family,” Woodham said via a<br />

statement on the HRNZ website.<br />

Woodham, a lifelong harness<br />

racing fan who has been heavily<br />

involved in owning, breeding and<br />

racing a number of horses, started<br />

his Addington Raceway-based<br />

tenure in January 2021.<br />

“As well as spending more<br />

time with my family, work-wise<br />

I will be looking to step into<br />

more mentoring and directorship<br />

positions in the near future,” he<br />

said.<br />

Mauro Barsi, HRNZ’s chief<br />

operating officer, will also serve<br />

as acting chief executive until a<br />

replacement for Woodham is appointed.<br />

<strong>The</strong> recruitment process<br />

gets under way soon.<br />

thanked Woodham for his service.<br />

“Gary’s made a meaningful and<br />

long lasting contribution to our<br />

sport and while it’s never easy<br />

making decisions like he has, we<br />

wish him all the best for this new<br />

management team, former<br />

general manager – racing,<br />

marketing and communications,<br />

Catherine McDonald.<br />

She finished on <strong>February</strong> 2<br />

after HRNZ opted to separate<br />

the racing and the marketing/<br />

communications functions.<br />

McDonald, who joined HRNZ<br />

in 2020, was at the forefront of<br />

some of harness racing’s biggest<br />

changes including moving horses’<br />

birthdays to January 1 and the<br />

subsequent revamp of the racing<br />

calendar.

Get a good feel for it because that is the pace you<br />

event. This is a key session. Try not to miss any<br />

least 3 sessions per week. If you do only 1 or 2 you<br />

might lose some of your hard gained fitness and<br />

To achieve this goal<br />

you need to develop<br />

some awareness around<br />

the basic requirements<br />

of exercising for health and<br />

do with 3 key principles:<br />

1. How often do you train? To improve your<br />

level of health and fitness you will need to<br />

aim for 4 sessions per week. 2 or 3 sessions<br />

per week will only maintain what you have<br />

and 1 session per week is definitely not<br />

sufficient.<br />

2. How long are your sessions? <strong>The</strong><br />

duration of your sessions will generally<br />

build towards between 30 and 50 minutes<br />

with one longer session of 60-120 minutes.<br />

3. What is the right intensity to train at?<br />

<strong>The</strong> good thing about the programme<br />

is that all your runs will be done at<br />

submaximal pace, also called conversation<br />

pace. That means a pace where you can still<br />

talk. If you can’t talk you are going too fast<br />

and you are likely to come to a grinding halt<br />

sooner or later.<br />

your health at any stage please undergo a health<br />

check with your GP.<br />

TIP OF ThE wEEK<br />

If your feet are sore and aching roll your<br />

feet over a frozen drink bottle after your<br />

run, it can do wonders. If your shoes are<br />

worn this is the time to replace them so<br />

you can still “run them in”. If the shoes feel<br />

good stick to the same brand and model.<br />

FORMER DAVIS Cup player and captain<br />

Alistair Hunt is loving playing alongside<br />

son Lachie for his home club Elmwood<br />

in the men’s premier tennis interclub<br />

competition.<br />

Hunt, 51, and Lachie, 18, were part of<br />

Elmwood’s close win against Bishopdale<br />

on Saturday, with Lachie back on court<br />

the following day for the Elmwood’s division<br />

1 team, winning both his singles and<br />

doubles where he teamed up with another<br />

Davis Cup veteran Glenn Wilson.<br />

“It was pretty special watching Glenn<br />

coaching and encouraging Lachie, who<br />

is always really open to advice on court,”<br />

said Hunt. He was on the sideline<br />

with his father, and Lachie’s grandfather,<br />

Colin.<br />

Hunt, who at the peak of his career was<br />

ranked 184 in the world, is now based<br />

in Arrowtown and has concentrated on<br />

coaching instead of playing competitive<br />

tennis in recent years.<br />

His son’s enthusiasm for the game has<br />

seen them team up for doubles at a number<br />

of tournaments over summer.<br />

“If I can continue to play well, I would<br />

like to keep competing with him in<br />

interclub and tournaments,” said Hunt,<br />

renowned for his formidable serve and<br />

devastating backhand when he played on<br />

the international tour in the 1990s.<br />

“It’s actually a real privilege to be on<br />

court with Lachie. He got into the game<br />

relatively late which is probably my fault,<br />

but I did not want to be a parent who<br />

put pressure their child to play and succeed.<br />

“It is all coming from him. He’s totally<br />

driven and working really hard.”<br />

Elmwood has home court advantage on<br />

Saturday against Burnside Park, who lost<br />

1-5 to competition leader Cashmere at the<br />

weekend.<br />

For the first time this season all three<br />

Meredith brothers were playing for unbeaten<br />

Cashmere.<br />

Burnside Park’s Emilio Gonzaga, who<br />

won the recent Canterbury secondary<br />

schools’ singles championship, was his<br />

team’s only winner.<br />

looks assured of making the playoffs.<br />

It is a reversal of form from the first<br />

round where, with only two of the roundrobin<br />

games played due to cancellations, it<br />

did not make the top four.<br />

Te Kura Hagley’s highly ranked players<br />

took the disappointment in their stride<br />

and captain Beth Williamson is delighted<br />

with her team’s performance this year.<br />

“We are now into the full swing of this<br />

round, all loving our tennis, hitting a lot<br />

more and definitely turning in more consistent<br />

performances,” she said.<br />

Te Kura’s Adele Orangi is close to<br />

achieving her 100th win in premier tennis,<br />

and this week her side plays Shirley away.
