NO BODY, NO PAROLE?
HAVE YOUR SAY: Should
convicted murderers be
paroled if they refuse to say
where they hid the body?
the debate
THAT’S THE question The Star
is asking readers today.
Murder victim Michael
McGrath’s loved ones finally have
a conviction, yet they don’t have
his remains, robbing family and
friends of an element of closure.
Former prison guard David
Benbow has refused to reveal
the whereabouts of his childhood
friend’s body, so should
New Zealand’s judicial system
introduce ‘no body, no parole’
legislation where a convicted
killer cannot apply for parole
unless they disclose their victim’s
location?
McGrath’s brother Simon
opened the debate after the
sentencing on Tuesday, when
Benbow was given life imprisonment
with a non-parole period
of 17 years.
Simon McGrath urged the
Government to follow the lead
of Australian states and introduce
a ‘no body, no parole’ law.
“I believe New Zealand needs
to strengthen the law to follow
Australian states – no body no
parole.”
The magnitude of the crime
and concealment of a body was
enough to warrant a law being
introduced.
No trace of McGrath has been
found since the 49-year-old went
missing from Halswell in May
2017.
The New South Wales
Government followed the lead
of Queensland, South Australia
and Victoria in October 2022
by passing a law to make
it impossible for convicted
murderers to be released on
parole if they refuse to cooperate
and divulge the location
of victims’ remains.
Te Whatu Ora Waitaha
group director of operations
people were being cared for in
the ED at 9.15pm on Tuesday.
“There is no single reason
for high numbers of patients
attending at present, but we are
range of complex conditions.”
Gibbs said from midnight
Monday to midnight Tuesday
the ED saw 357 patients.
“The usual number of attendances
370 people every day,” Gibbs
said.
“What made yesterday and
was the large number of
care at the same time – at
its peak there were 124 people
Successful test of
earthquake solutions
Canterbury University engineers
have been able to test earthquake
innovations under ‘real life’
conditions at a ground-breaking
laboratory in China. Tonji
University in Shanghai has
three-storey buildings and ‘shake
tables’ constructed to gauge the
effectiveness of engineering
solutions. “New Zealand is at
the cutting edge of earthquake
engineering, but we would never
be able to test our solutions on
a three-storey building in an
earthquake laboratory back home,”
said University of Canterbury
professor Greg MacRae. Testing
wraps up this month then data will
be analysed. Several innovations
to reduce building damage and
increase resilience were tested
along with some non-structural
construction elements like
partition walls, sprinklers and
ceilings.
Benbow ‘would
be treated as any
other inmate’
• From page 1
Talk of tougher laws come as
the Department of Corrections
vowed ex-staff member Benbow
would be treated as any other
inmate. He was a prison guard at
the of McGrath’s murder.
“Former Corrections staff
members who are sentenced to
imprisonment are managed the
same way as other prisoners. Like
other prisoners, their specific circumstances
and level of risk will
determine where they are placed,
and how they are managed,” a
Corrections spokesperson told
the New Zealand Herald.
Benbow could request to be
segregated from the general
population.
“We have policies and operational
procedures in place to support
the safe, secure and humane
management of all prisoners,” the
spokesperson added.
In accordance with the
Corrections Act:
• Prisoners can be lawfully
denied association with other
prisoners if their behaviour presents
a risk to the security of the
prison, the safety of others, or if
it is considered it is necessary to
assess or ensure their mental or
physical health.
• Prisoners in New Zealand
have the ability to request to be
placed in voluntary segregation
for the purpose of protective
custody. This may be due to the
prisoner fearing for their own
safety or in order to be removed
from gang members as they are
trying to rehabilitate away from
this lifestyle.
• A prisoner can withdraw
from voluntary segregation at
any time.
• A prison director can also
direct the prisoner into voluntary
protective segregation, without
the prisoner requesting it, if they
believe the safety of the prisoner
has been put at risk by another
person, and there is no reasonable
way to ensure the safety of
the prisoner otherwise than by
giving that direction.
• Segregated prisoners are
provided with minimum
entitlements set out in the
Corrections Act. They also have
regular and ongoing contact
with Corrections staff, including
health services staff and mental
health professionals as required.
Townhouse fire caused
by charging e-scooter
A SHIRLEY townhouse fire
which forced a mother to drop
her child to safety from a second
floor bedroom was caused by a
charging e-scooter.
Fire and Emergency New Zealand’s
investigation determined
the fire started accidentally
inside the unit on New Brighton
Rd, opposite The Palms shopping
centre, last Tuesday night.
When the e-scooter was
charging it went into ‘thermal
runway’, effectively an uncontrollable
increase in temperature
which often resulted in system
failure in electrical circuits and
battery cells.
A FENZ spokesperson
reminded the public it was important
to take care when using
these batteries as they are a fire
risk when not stored, charged,
used, or disposed of correctly.
“Only use chargers that are
supplied with the device, don’t
charge them on or near flammable
surfaces, and avoid leaving
lithium-ion batteries or devices
charging for prolonged periods
of time,” the spokesperson said.
Meanwhile, FENZ Canterbury
community risk manager Dean
Harker recommended all households
devise an evacuation plan,
BLAZE: Both levels of the townhouse were extensively
damaged.
ideally with three options to
escape a burning property.
“Pre-planning is very important.
If you have to break a
window do you keep anything
in those rooms capable of breaking
glass?
“Is there a tree outside your
window? Can you get out onto
your roof? What sort of windows
have you got? Some people
have rope ladders,” he said.
Harker said multi-storey
dwellings should also have a fire
BUILDING contractors for the
floundering new sports centre
have abandoned an appeal of
last year’s High Court decision
which prevented the firm from
pulling out from the project.
It follows a legal standoff between
contractors CPB and the
Government’s delivery agency
Rau Paenga and a mammoth
cost blowout for the plagued
Parakiore Recreation and Sport
Centre in the central city.
Construction on the longawaited
facility began six years
ago and was initially set for
completion by October 2021.
But the project has been
burdened by constant delays,
ballooning costs, and precarious
ground conditions.
It all came to a head last
year when the contractors and
project managers Rau Paenga
ended up in court, much to the
chagrin of local sports groups
and authorities.
CPB launched a bid to
terminate the contract in the
High Court, after Rau Paenga
rejected claims of sizeable cost
variations.
The firm estimated the total
cost for Parakiore was $696m,
more than triple the original
contract price agreed on.
The contractors requested extensions
to the project, but this
was declined by engineers.
In September 2022, CPB
claimed for an additional
$212m, which ballooned to
$439m in 12 months.
Both parties initially agreed
on a contract price of $220m.
Justice Geoffrey Venning
ruled in favour of Rau Paenga
last October, barring CPB
from suspending on-site
construction works based on its
“unsubstantiated claims”.
BUDGET
BLOWOUT:
The
Parakiore
Recreation
and Sport
Centre in
2022.
“The parties ultimately blame
each other for various breaches
of obligations resulting in the
delay and increased costs,” the
court ruling stated.
“Resolution of a number
of CPB’s claims through the
contractual dispute resolution
process is ongoing.”
Earlier this week, Rau Paenga’s
chief executive John O’Hagan
confirmed CPB had applied to
the Court of Appeal over the decision
but had since withdrawn
its application.
“CPB has continued work on
site throughout these proceedings,
but putting the legal action
behind us allows everyone to
refocus on getting Parakiore
completed as soon as possible.”
But Rau Paenga suggested
the projected timelines remain
a bone of contention with the
agency pushing for construction
to be completed before 2025.
“The facility is now about
75 per cent complete, but as
reported at the end of last year, a
gap remains between our desire
to see construction finished at
the end of this year and CPB’s
mid-2025 projection,” O’Hagan
said.
“We will continue to work
with CPB to try and close this
gap.”
One thing that remained unclear
was how much the project
was ultimately going to cost.
CPB had been paid $220m by
the time the matter ended up
in court last year and the city
council had contributed $147m
to the project.
Rau Paenga could not provide
a figure on what the project was
estimated to cost in total.
“We expect to also be able
to provide an update on cost
around the end of May.”
Preventative
for child sex
offender
A CHILD SEX offender with
more than 40 convictions for
crimes spanning more than three
decades has been sentenced to
preventive detention for abusing
a boy while on an extended
supervision order.
David Keith Morgan was
sentenced in the High Court at
Christchurch by Justice Melanie
Harland.
She said his offending was “escalating
and getting worse”.
A pre-sentencing report said
there was a “high” risk of reoffending.
Preventative detention means
he has an indeterminate prison
sentence. He can be released on
parole, but would remain managed
by Corrections for the rest
of his life and can be recalled to
prison at any time.
Judge Harland ordered he serve
a minimum period of imprisonment
of five years.
Morgan, 59, had earlier pleaded
guilty to one charge of sexual
connection with a male under
the age of 16 and two charges of
breaching the conditions of an
extended supervision order.
Businessman shells out extra $275k
• By Nikki Preston
A BUSINESSMAN hopeful he
had bought a tired but spacious
townhouse for $1.2m ended
up having to shell out an extra
$275,000 to beat off stubborn
competition at the broughtforward
auction.
The four-bedroom, two-bathroom
townhouse on Clare Rd,
Merivale, had only been on the
market for four days when a man
who had been looking for a lockand-leave
in central Christchurch
made a pre-auction offer on the
townhouse.
But the plan to grab the house
before too many people saw it
backfired when a few days later
he found himself in a bidding
war with another buyer who
also desperately wanted the
standalone townhouse. A third
buyer was also in the Harcourts
Holmwood auction room earlier
this month, but failed to bid.
The auction opened at the
accepted brought forward offer
of $1.2m and steadily rose
in $10,000 bids. Several bolder
bids of $20,000 bids made in an
attempt to get rid of the competition
were also unsuccessful.
By the time the price hit
$1.445m bidding had slowed and
a few smaller $5000 bids were
placed before it eventually sold
for $1.475m to the person who
started it off with the offer that
brought the auction forward.
Harcourts salesperson Kathryn
Picton-Warlow, who had been
working with the
successful buyer,
said she had no
idea how much
he had planned
to bid.
“It got to the
point where he
didn’t want to
lose it.”
The businessman
was
Kathryn
Picton-
Warlow
downsizing from a much larger
Christchurch home and had
viewed about six other centrally
located properties ranging from
apartments to new townhouses.
The Clare Rd townhouse ticked
all the boxes in terms of location
and size, she said. It was also a
corner section that could not be
built out.
“He basically just wanted to
own it. He wanted that location,
he wanted proximity to the
Hagley Park and the cafes in
Victoria St and really was just
downsizing out of a large family
home in Christchurch.”
The rooms were much larger
than in newer townhouses, she
said, but would be getting a complete
makeover including a new
kitchen and bathrooms.
“The spaces in these 2005 to
2010 properties – because the
build costs weren’t so astronomical
– the spaces are really generous
and the living proportions
are usually very good.”
Harcourts listing agent Paul
Nichols said it was a tightly
MUST HAVE: The tired
townhouse on Clare
Rd, Merivale, sold in a
competitive broughtforward
auction for
$1.475m.
fought auction by what he could
only assume were well-healed
and experienced bidders.
“They weren’t small bids, which
tells you there are
people out there
that have capacity.
They weren’t
necessarily using
all the budget
they had for a
property on
that particular
property,” he
said.
DESIRABLE AREA: Last month a three-bedroom, one-bathroom 1950s
brick house on Wai-iti Tce, Fendalton, exceeded expectations when it sold
for $1.1m.
PHOTO: NZ HERALD
“They were essentially looking to say,
‘look no I’m going to have it’, ‘I’m going to
have it’.”
The elderly owner had lived in the home
for almost 20 years and had moved into
a retirement village. Her family, who had
been selling it on her behalf, had been
happy with the result which saw them
walk away with a “significant” $275,000
more than they had been banking on
when they accepted the pre-auction offer
of $1.2m, Nichols said.
The impressive auction result comes as
several homes in suburbs such as Merivale
and Fendalton have smashed expectations
at auction, selling for several hundred
thousand dollars more than expected. Last
month a three-bedroom, one-bathroom
1950s brick house on Wai-iti Tce, Fendalton,
exceeded expectations when it sold for
$1.1m.
Nichols said the reason these top
suburbs could be getting exceptional
results could be because the type of people
buying in those areas might have extra
cash reserves and once they decided they
would buy it were prepared to fight until
the end.
The average house values in Fendalton
and Merivale are $1.747m and $1.577m
respectively, well above Christchurch’s
average value of $790,000.
Nichols said the $1.47m price fetched
for the Clare Rd home was considered
only mid-range for those areas. It was not
uncommon for homes to sell in the $2m to
$3m plus range.
Three brothers claimed by war and
Kirwee is an anomaly
on the Canterbury
Plains. It was named
after Karwi, a town in
northern India, by an
Irish-born British army
colonel, politician and
farmer, De Renzie
James Brett, who
introduced irrigation to
the province. And there
is no war memorial.
Chris Barclay reports
on manoeuvres to
belatedly honour the
fallen, and those who
returned home
AS YOU enter Kirwee from
Christchurch along State
Highway 73, a water feature
honouring Brett has pride
of place, rather than the 44
men who enlisted for the New
Zealand Expeditionary Force.
Paul Jarman’s great great great
grandfather purchased what is
still the family’s pastoral land
in 1863, so the fifth generation
crop, sheep and dairy farmer
at Greendale, near Darfield, is
acutely aware of the importance
of irrigation.
Yet the 73-year-old also
appreciates the sacrifice his
predecessors made in the Great
JARMAN BROTHERS: Harry Nesslea (back left), James
Herbert (front left) and Frank Elworthy (front right) were
casualties of WW1.
Right – Descendent Paul Jarman has donated to the
fundraising campaign for a war memorial in Kirwee.
War, hence his interest in Kirwee
finally making concrete plans for
a war memorial at Anzac Lane
by the cemetery and behind the
rugby fields on the rural settlement’s
reserve.
After prolonged negotiations
with the Selwyn District Council
to secure a suitable location, a
fundraising campaign is gathering
momentum to raise around
$30,000.
When the memorial is eventually
in place, Paul Jarman’s
grandfather and two great uncles
will be remembered side by side
for the first time in public view.
Jarman is among the donors
– no surprise given his family
connection to a conflict which
counted Frank Elworthy Jarman
and Harry Nesslea (Ness) Jarman
among the World War 1 dead at
Gallipoli and in France respectively.
Of the 44 men who left the
settlement to fight for King and
Country, 11 were killed.
James Herbert (Bert) Jarman,
Paul’s grandfather, returned to
the family farm from Palestine
in 1919 but was still essentially a
casualty of war.
Stricken by malaria, he never
truly recovered and died in hospital
in 1922 following complications
from an appendectomy.
Because he did not die on foreign
fields, Bert was not remembered
with his brothers, who are
memorialised at the Darfield War
Memorial Obelisk and the gates
at Greendale Domain.
“They’re going to put all three
on (the memorial), I’m pleased it’s
happening. Kirwee was probably
their centre of life in those days,”
Paul Jarman said.
REUNITED: James Herbert ‘Bert’ Jarman with wife Lottie
and son Jimmie after his return from the Middle East in
February 1919. Right – the couple’s grave.
Bert is buried in the same
Greendale Cemetery plot as his
wife Lottie, who died, aged 90,
in 1978. They are at rest near
Essendon, the farm where Paul
Jarman lives.
He has also gone farther afield
to visit the resting places of
Frank and Ness.
Frank, the first Jarman lad
to volunteer, and the second
of Thomas and Annie’s eight
children, enlisted with the
Canterbury Mounted Rifles as a
trooper and headed for Egypt in
October 1914.
He was killed in action, aged
28, during the assault on Chunuk
Bair on August 6, 1915 and
is buried at the No 2 Outpost
Cemetery on the Turkish
peninsula.
Undeterred by his brother’s
death, Ness, the youngest of the
five boys, also enlisted when he
joined the Canterbury Infantry
Regiment, C Company in
October 1916.
He left for France the following
May and was killed on August
25, 1918 when the Canterbury
Infantry Regiment, 1st Battalion
fought the Germans at Bapaume.
The 25-year-old Lance
Corporal is buried at the
Grevillers British Cemetery at
Pas-de-Calais.
“It’s very touching to see your
family name there in those
places. It’ll be nice to see them in
Kirwee too,” Paul Jarman said.
Conscription was introduced
in August 1916; Bert was selected
and reported for duty with the
New Zealand Expeditionary
Force 33rd Reinforcements,
Mounted Rifles Brigade, in
March 1917, after getting the
harvest in.
He arrived in Egypt four days
before Christmas 1917, and
although he survived Turkish
onslaughts in Palestine, Trooper
Jarman fell seriously ill with
malaria, which continued to
linger.
When he returned to Essendon
Bert was perpetually blighted
by the mosquito-borne disease,
though it was surgery for
appendicitis which proved fatal
for the 32-year-old father of
three.
He succumbed to chloroform
poisoning on May 25, 1922 – his
beloved Lottie’s birthday.
Paul Jarman’s father Keith
was three-weeks-old when Bert
died, but his correspondence
home – and the letters written
by Frank and Ness ensures their
wartime exploits are known by
generations.
A cache of about 50 letters
were found in the 1980s and
were used as the basis of a
family history, In Foreign Fields,
published in 2015. Copies of the
letters are archived at Te Papa
and the National Army Museum
in Waiouru.
Although the brothers describe
death and destruction, there was
also an interesting agricultural
element to their ordeals.
“They all talk about where
they visited from a farming
perspective. Farming on the
banks of the Nile in Egypt, and
other places,” Paul Jarman said.
“It was nice they had some
good experiences along the way.
They took leave in England and
went up through Scotland.
“They got to see things in the
days where travel was pretty
limited for anyone.”
On Anzac Day, Paul Jarman
attends the Darfield dawn
service or the remembrance for
the 20th Armoured Regiment in
Riccarton, because Keith fought
within it in Italy, returning home
safe after World War 2.
‘This memorial will consolidate everything’
• From page 9
He is now looking forward to a
third option on April 25.
“Kirwee? Yes, indeed. That’ll be
very good when it’s opened.”
The Selwyn District has several
prominent public-facing war
memorials at locations including
Leeston, Springston, Tai Tapu
and Darfield.
West Melton was the latest
addition when a memorial on the
school grounds was unveiled in
2014.
So why had Kirwee been overlooked?
“It was a pretty small place until
recently, Kirwee. It’s a decent
size now and it wasn’t always that
way,” Paul Jarman thought.
Kirwee covers only 3.62 sq km
and the settlement was home to
603 people in 2006, according to
Statistics New Zealand.
The latest population estimate
was 966 in 2018.
Kirwee Community Committee
member and memorial
project co-ordinator David Stott
offered another explanation: “No
one sort of asked for it before.”
Stott has accumulated 123
names of Kirwee men who
fought in both world wars, from
rolls of honour in the Kirwee
Community Hall, St George’s
Anglican Church, Kirwee School
and a hall at Halkett, about 12km
east on the outskirts of West
Melton.
SITE: Kirwee’s war
memorial is planned for
this location on Anzac Lane
in the reserve. Below – an
architect’s impression.
“Some names are on more than
one, some aren’t. This memorial
will consolidate everything in a
public place,” he said.
Committee chair Stu Begg
said the memorial would finally
allow residents to attend their
own Anzac Day commemoration
rather than troop to Darfield, a
seven-minute drive away.
“Everyone else seems to have
their own services like Sheffield
and Springfield. West Melton has
one down at the school,” Begg
said.
“The only recognition we have
is some honours boards in our
local community hall but it’s not
open to the public all the time, no
one can just wander in there.”
The committee made a presentation
to the Malvern Community
Board last week in an
attempt to secure funding for a
project floated four years ago.
They have about $10,000
thanks to donors and a charity
bowls tournament. A pub quiz
and garage sale is also planned.
When Kirwee’s memorial is
set in stone and unveiled, it will
be a sombre occasion for Paul
Jarman, a cause for reflection, not
celebration.
He retrieves a bottle of Moët &
Chandon Brut Imperial Champagne
from a locked cabinet in
the lounge, which will remain
unopened for evermore.
Thought to have been gifted
to Lottie by Mr Knight from
Racecourse Hill – considered
one of the few gentlemen with
the means to import champagne
in those days – it was meant to
be uncorked to mark the end of
hostilities.
The gesture fell rather flat when
Bert wrote to his mother Annie
from Port Suez on December 10,
1918, a month after the Armistice.
“Mum, I don’t want a lot of
fuss made when I land home, no
parties or anything like that. If
there’s any public welcome home
or anything like that I won’t be
there.
“If poor old Ness could have
been there to share the joy it
might have been different, so
please do nothing.
“I know it will be mighty hard
knowing our dear old Frank and
Ness will never come back again
so make it as easy as possible.
“Today I picked up an Otago
Witness in a tent and whose
photo should be there but the
poor kids. It was a lovely photo
but the words killed in action
were cruel.”
During peacetime the Moët
has lost its effervescence. It is
undrinkable, in more ways than
one.
SOBERING: This bottle
of Moët & Chandon was
meant to be opened at the
end of World War 1, but the
only one of three brothers
in arms who returned home
insisted there was nothing
to celebrate.
How killer’s texts to journalist
ended up in a High Court trial
On Tuesday, former
prison guard David
Benbow was sentenced
to life imprisonment
with a minimum nonparole
period of 17
years for murdering
his childhood friend
Michael McGrath nearly
seven years after he
disappeared. New
Zealand Herald senior
crime
reporter
Sam
Sherwood
reports
on how a
series of
text messages from a
man who called himself
‘Nigel’ led to him being
called as a Crown
witness in a murder trial
“HELLO, SAM. You inquired
about a witch-hunt of a good
friend of mine,” the conversation
began shortly after I arrived
home from work.
Looking at my phone, I knew
instantly the message from the
unknown number related to
an approach I’d made two days
earlier to David Benbow.
It was nearly 300 days since
his childhood friend Michael
McGrath went missing and
Benbow had just put his family
home on Candys Rd, Halswell,
up for sale a second time.
He’d tried selling it several
months earlier with another real
estate agent, but following media
coverage of the listing, they
decided to pull out as it was “too
much hassle”.
McGrath had done some work
on the property, helping Benbow
work on a deck and also making
a playhouse for his children.
McGrath’s disappearance on
May 22, 2017 made national
headlines, with several police
press conferences being held as
detectives appealed for sightings
of the 49-year-old.
However, to date, Benbow,
whom police said was a “person
of interest”, was yet to make
any public comment aside from
telling a reporter from The Press
he was the victim of a witchhunt.
I had spent many hours
looking for another way to
contact Benbow. I couldn’t find
a Facebook account, and he was
not in the phone book. I had
tried calling his mum, but she
did not want to comment.
It was not until March 2018,
when his house was listed for sale
a second time, that I got what I
was after. I went online and the
real estate agency had uploaded
TEXTS: At the first trial, David Benbow admitted being the person behind the text
messages sent to journalist Sam Sherwood.
PHOTO: KURT BAYER/NZ HERALD
several documents related to
the house. As I scanned the
documents, I spotted one which
included Benbow’s cellphone
number. Finally, I had an
avenue through which I could
communicate with him.
I wasn’t under any impression
he would agree to an hourlong
interview but felt it was
important, given I was intending
on writing a story, that I give him
a chance to comment.
I called on March 14, the
phone rang and Benbow
answered. He wasn’t interested in
talking.
I then sent him a text saying
I wanted to give him the
opportunity to talk about how
the last 300 days had been for
him. I said I had some questions
for him, including how he
believed he was the victim of a
“witch-hunt”.
I got no response and thought
that was the end of it.
Then, two days later on March
16, 2018, I received the first
message from an unknown
number.
Another text followed saying
Joanna Green, Benbow’s expartner,
had “triggered the
investigation”. They claimed
Green had a “chronic drinking
problem”.
“Confirmed is in new
relationship with Michael,” they
said before alleging Green “can
be violent on occasions”.
I asked who I was speaking
to, and they said their name
was Nigel. I was immediately
suspicious about who was really
behind the texts – in the back of
my mind, I wondered, ‘What’s
this man, whom I believe to be
Benbow, going to tell me? Will he
slip up?’
“The police have never
searched her rental house . . . or
her car,” the messages continued.
“She is a person of interest, but
In the back of my mind, I wondered, ‘What’s this man, whom I believe to be Benbow,
going to tell me? Will he slip up?’ – Sam Sherwood
you don’t put her photo in the
press and occupation.”
I asked Nigel whether Benbow
would be happy to speak to me,
hoping I would finally get an
interview with him. Nigel said he
would ask him the next day.
I told Nigel at the time I was
not in possession of a photo of
Green, which was why we had
not published any.
“Because your 1 dimensional
eg witchhunt, getting the idea
now (sic),” Nigel said.
The word witch-hunt, which
Michael McGrath was last
seen at his Halswell home
in May 2017.
by now Nigel had used twice,
piqued my suspicions further,
given it was the term I had used
in my text to Benbow.
He then told me to go to
Green’s workplace the following
Monday morning to get a photo
of her, supplying her number
plate to make it easier to find her.
I then asked Nigel how his
good friend was coping, hoping
I might be able to use these
comments later down the track
if I were ever able to confirm
Benbow was behind the phone
number.
“Ask yourself the question.
David has had his life turned
upside-down, all the press
coverage, 300 days of no
evidence. I don’t think David is
that clever. But I bet you publish
another article in the morning.”
Nigel then tells me two young
girls were sitting in the gutter
opposite McGrath’s house in the
early hours of the morning over
the period in question, which
was reported by a neighbour but
had not been mentioned.
“A commotion and loud voices
reported about 2.45am over that
period by three neighbours. One
neighbour witnessed a vehicle
driving off. It wasn’t David’s
vehicle and he wasn’t present.
But the police still promoted his
vehicle on (Police Ten 7).”
• From page 13
Keen to see what more “Nigel”
would tell me, I asked why he
thought police were treating
Benbow the way they were and
whether he thought McGrath was
still alive.
“It’s not just the police, look at
the way you are treating David.
As outlined, they have not looked
outside the box and explored
all other options. One would
presume vital evidence has now
been lost if anything untoward
has happened to McGrath.”
I replied it must be hard for
Benbow not knowing what happened,
considering they were
“good friends”.
“They were good friends and
he hasn’t been given a chance
to grieve over a missing friend.
Also, information circulating
(suggests) Michael McGrath
(was) not a complete angel as
displayed,” he replied.
I asked what sort of information
he was referring to, and
Nigel replied: “Maybe (we’ll)
talk next week. You have enough
to go on for now. See what you
deliver. Cheers, Nigel.”
I saved the number in my
phone as “Benbow’s friend” and
sent three more texts to Nigel
COURTROOM: Crime journalist Sam Sherwood giving
evidence at the Michael McGrath murder trial.
with questions, but I never heard
back.
I also texted Benbow on March
21, saying I had been talking to
“Nigel”, and wanted to see if he
wanted to talk. There was no
response.
After about a week, I informed
the officer in charge of the case
at the time about the messages,
believing I was likely talking
to Benbow and he was using
a phone number that may not
be known to police, thinking it
PHOTO: POOL
might be of use.
Nearly five years on, I sat in
the High Court at Christchurch
reading the messages in open
court. Asked by the Crown why
I was confident I was speaking to
Benbow, I said the term “witchhunt”
and the amount of information
the person had about
Green’s car and when she left
work had piqued my suspicions.
After I left the courtroom, a
police officer gave evidence about
how police were able to identify
the Sim card for the number belonging
to “Nigel” that had been
used in Benbow’s cellphone.
It also emerged Benbow actually
admitted to sending me the
text messages. However, the exact
reason why remains unknown.
The trial ended with the jury
unable to reach a verdict and a
retrial was ordered.
About a week before the retrial,
I was advised by police the
defence had opposed the admissibility
of my evidence and the
judge had ruled in their favour,
meaning I would not be called for
the second trial.
Benbow’s defence argued the
jury could find him using the alias
Nigel and a new Sim card was
“unusual conduct”, and gave risk
the jury would draw an “adverse
inference” as to his character.
They believed such an inference
would be wrong and unfair
as Benbow was “simply responding
to persistent media requests
that he comment on the police
investigation”.
Alternatively, the defence suggested
the text messages could
be admitted as evidence, but the
Crown should not be allowed to
mention that Benbow used a false
name and a new Sim card.
In reply, the Crown said the
evidence was another strand of
its circumstantial case.
They said in referring to “grieving”,
a jury would be entitled to
infer Benbow knew McGrath was
dead rather than missing.
They also argued the “disparaging
comments” about Green
were “probative of guilt” and reflected
an attempt by Benbow to
distance himself from the police
investigation.
Justice Jonathan Eaton did not
accept the Crown’s arguments
and said the fact Benbow used
an alias and a different phone
number was of “low probative
value”.
“Whilst I do not consider
the evidence would have a
significant prejudicial effect on
the proceedings, it is likely to lead
the jury to consider Mr Benbow’s
behaviour to have been odd.
“There is a risk the jury would
equate odd behaviour with guilt.
That would give rise to unfair
prejudice.”
In the end, it did not matter.
Benbow was convicted of
McGrath’s murder.
Gay bashing victim goes public:
Five youths have
been sentenced for a
series of unprovoked
attacks on gay men
across Christchurch,
filming the assaults.
Sam Sherwood speaks
to one of the victims
about the night he
thought he was going
to die
IT SEEMED innocent enough at
first. It was late on April 17 last
year and Kelly Hopkins was at
his home chatting with a man
on Grindr, a dating app popular
with gay men.
The man said he wanted
to meet Hopkins at a park in
Avonhead.
“It wasn’t that unusual because
you would generally meet
somewhere public and it was late
at night,” Hopkins recalls.
Hopkins, who doesn’t drive,
got an Uber to the park. Once
outside he messaged the man
asking him to come out on to the
street.
“He was quite insistent I go
into the park which I felt was a
bit dodgy.”
He told the man he wasn’t
going to go into the park, and
the man gave him an address for
a house nearby where he said he
lived.
Hopkins then got a Lime bike
and went to the address thinking
if something did go wrong he
could just bike off.
Once he got down to the end
of the street he saw someone
shining what appeared to be a
torch.
“He said ‘are you the guy from
Grindr’ and I said yes and he
said ‘my house is just over here
follow me’ and he just went to
like half turnaround and I said
no, I’m just going to go.
“I turned around on the bike
and he yelled something out
and all these figures in black just
came at me out of the dark.”
Hopkins isn’t sure exactly
how many people there were but
thinks it might have been about
eight.
ASSAULTED: Kelly Hopkins was one of 10 people attacked by the group.
PHOTO: GEORGE HEARD
“I just took off down the street
and I actually came off the bike
and that’s when they got on me
and beat the s*** out of me.
“I thought I was going to die.
I thought they were going to kill
me.”
The group kicked and punched
Hopkins while he was on the
ground, not saying anything to
him.
“I was yelling help me, call the
police. I was screaming bloody
murder. . . I was screaming for
my life. People in the houses
around started to yell out and
one of them turned on their
lights but nobody came outside.
The last thing he could
remember from the attack was
a rock hitting him in the head
before the group fled.
Once the offenders fled,
Hopkins yelled out for someone
to bring him a torch so he could
try to find his phone in the dark.
After waiting to see if someone
would come, he decided to get
back on the bike and head home,
worried the offenders might
come back.
West Coasters
Are you living off the Coast and would like to
keep up with the local news and events?
“I biked all the way back into
the city, it was about 45 minutes.
They’d broken my glasses so I
couldn’t really see anything and
it was about 1am.
“Every car that came I thought
was them coming after me.”
Once he got home he made an
online police report and called
a friend who came and helped
clean him up and put a bandage
on his head. A few hours later
he went with a colleague to
the scene and found his phone
“smashed to pieces”.
He also spoke to police about
the ordeal and worked from
home after telling his colleagues
he’d had a scooter accident.
That evening he went to the
after hours clinic to get looked at.
“I had an abrasion on my
elbows and knees and a massive
gash on my head, but I didn’t
know at the time because I was
still so in shock but I also had
bruised ribs. . . I couldn’t twist
or turn or sit down properly for
days.”
As the days turned into weeks,
Hopkins tried putting it all
behind him and moving on with
life.
“I tried to pretend it didn’t
happen.”
About six weeks after the
incident he got a call from police
asking if he could come in to
make a formal statement. Two
weeks later he got another call
from police to say they were
looking at some suspects they
had brought in following another
incident.
“[Police] said they’d found
videos on their phones and that’s
how they’d found these guys.”
Hopkins says police told him
the groups had filmed several
assaults and uploaded them to a
private group.
He says it was “horrific” to find
out his ordeal had been filmed.
Last week five youths were
sentenced in the Youth Court by
Judge Quentin Hix.
The sentencing began with
two of the victims reading their
victim impact statements.
The first of the two men, who
was 32 at the time, told the court
how he suffered “severe trauma”
to his face as a result of the
offending.
His cellphone was never
recovered, and he had to pay an
excess of $500.
“This offending caused
me a lot of physical pain, but
psychologically the pain is
ongoing.”
He hardly uses the app now, he
shelters himself away at home.
When he puts the bins out at
night he fears he will be attacked
and has regular flashbacks of the
offending.
His pants were pulled down
with his genitals exposed on
film.
He found it “too painful” to
talk about what happened with a
health professional and fears he
has PTSD.
The man said he now hid his
sexuality in fear of being beaten.
“It’s so upsetting to be
dehumanised, treated like an
object.”
The second man said the
impact of the attack continued
today physically and emotionally
and he had not told his family
what had happened.
He was scared of anyone
wearing hoodies on the street
and no longer felt safe, forcing
him to move several times since
the incident.
Judge Hix thanked both men
for reading their statements.
He said the catalyst for the
offending appeared to come from
social media videos depicting
violence against people in the US.
“The group has decided to
engage in copycat offending.”
He described the offending,
involving 10 attacks between
March and June last year, as
“extremely serious”.
Not all of the youths in court
were involved in all of the
offending.
The victims were “lured”
to areas late at night and then
attacked by members of the group.
One of the victims had arranged
to meet someone at a park. Once
he arrived he was punched and
kicked and called a paedophile
as the group demanded his
money and phone. Footage of the
incident was shared on social
media.
NEWS 17
‘I thought I was going to die’
Judge Hix said there were several
key factors in dealing with the
offending including the group
nature of it, the premeditation,
the seriousness of the violence
and that it was recorded.
He said from reading the
paperwork it appeared the
offending was related to a social
media influence and some form
of “vigilante action”.
Other evidence indicated the
motive was in relation to money.
He said there was no proof that
the victims’ sexual orientation
was a motivation for the group.
At the beginning of sentencing
crown prosecutor Penny
Crown said the 10 attacks
were “extremely violent” on
vulnerable people between
March and May last year.
“Not only were they
premeditated and repeated, they
were filmed and the attacks
shared on social media.”
Each of the five young men was
sentenced one at a time.
Two of the youths were given
six months of supervision and
150 hours community work.
Three other youths were given
six-month informal plans and 50
hours of community work.
• By Chris Barclay
THE ACTIONS of five teenagers
who filmed a series of assaults on
gay men in Christchurch have
resonated with family of Allan
Aberhart, the victim of a fatal
homophobic attack in Hagley
Park 60 years ago.
Nicole Skews-Poole might be
a distant cousin of Aberhart, but
last week’s proceedings in the
Christchurch Youth Court still
felt close to home.
Aberhart’s killers were six
teenagers aged 15-17, who
admitted to setting out to attack a
gay man on January 23, 1964.
The 37-year-old from
Blenheim, who was in town to
drive his mother to a wedding,
was felled by a punch at a toilet
block in the park.
SHOCK: Kelly Hopkins says it was ‘horrific’ to learn the attack on him was filmed.
The last of the youths to be
sentenced read a letter of apology
saying he had “an extreme sense
of remorse for my actions.
“I apologise for the harm
I’ve caused, I deeply regret my
involvement.”
Detective Senior Sergeant
Damon Wells said police are
urging users of dating app
users to take steps to protect
Although they confessed to
police, and were charged with
manslaughter, the teenagers were
found not guilty by a Supreme
Court jury after a five-day trial.
Aberhart’s case was
subsequently considered a
miscarriage of justice, and a
touchstone for the gay rights
movement in New Zealand.
Skews-Poole would not be
drawn on the punishment
handed down to the teenagers
responsible for last year’s spate of
attacks on gay men, though the
case reopened old wounds.
“Obviously this is an echo of
what happened to Allan,” she
said.
“One of the recent victims
(Kelly Hopkins) spoke at Allan’s
memorial last month, and it’s
themselves when meeting up
with people they’ve only spoken
to online.
He said the victims showed
incredible courage and that
helped lead to convictions.
“The victims have done
nothing wrong. The offenders
made a choice to take advantage
of people’s trust and planned
these attacks with the intention
clear that while we’ve come far in
some regards, we haven’t come
far enough.
“Sixty years on, gay men
are still being subjected to
homophobic hate crimes using
planned, organised, predatory
methods by attackers.”
About 80 people attended the
memorial for Aberhart at the
scene of his death on January
23, during which a fund in his
name was announced to support
victims of hate crimes.
Details of the Allan Aberhart
fund created by his family and
the Christchurch Foundation
with support of rainbow
charity, the Rule Foundation
will be released during the city’s
LGBTQIA+ Pride celebrations,
which start next Friday.
of hurting people.
“While this sentencing brings
some closure, it won’t undo the
mental scars these victims have
endured, or the pain they’ve gone
through.”
Wells advised dating app users
to tell a close friend if meeting
someone for the first time.
“Arrange to catch up in a busy
location, and trust yourself; if
something doesn’t feel right,
don’t hesitate to take action to
keep yourself safe. The victims
of these crimes have gone
through an ordeal, but we can’t
thank them enough for their
bravery through this process.”
Nearly a year after he was
attacked, Hopkins says he’s lost
all of his enjoyment in life and
has been diagnosed with posttraumatic
stress disorder.
“If I hear the sound of a group
of people behind me it freaks me
out. I’m conscious I don’t know
who some of these offenders
are. I find it really hard to sleep,
I don’t really trust anybody or
anything now.”
The 48-year-old still can’t
believe it happened to him.
“To think we’ve made
progress in so many ways as a
society and as a world and then
this kind of thing still happens.”
He hopes that with sentencing
now over that he might be able
to regain some control of his
life.
“I’d just like to be able to put it
all behind me. I’d like to go back
to my life.”
Second chance for last little penguin
• By Dylan Smits
A PENGUIN chick at a
conservation colony has been left
alone by his parents after being
born too late in the breeding
season.
The little penguin or kororā is
six-weeks-old. Named Finistère,
he is the last chick being cared
for from the Pōhatu colony near
Akaroa.
Penguin rehabber Averil
Parthonnaud said Finistère is
in good physical health and eats
normally, despite being alone.
“He’s actually a really feisty
chick. Pecks at you, then gobbles
up the food, then doesn’t want
anything to do with you once
fed. He’s got an attitude.”
Little penguins are the world’s
smallest, standing between 35-
43cm. They are native to New
Zealand and are considered an
at risk and declining species by
DOC.
Pōhatu manager and Averil’s
husband, Kevin Parthonnaud,
said due to the chick’s late birth,
his parents had to return to sea
for foraging before maturity was
reached.
“They have a biological need
to leave and gain back the weight
lost during breeding, but this
means their chicks aren’t going
to make it without us.”
The species’ breeding season is
from September to December.
Finistère is being monitored
in the colony’s DOC-certified
Kororā Nursery, located at the
Parthonnauds’ home.
“My main job is cleaning
penguin poop,” said Averil.
“We also, once they have blue
feathers, give them swims. We
use an old bathtub.”
The rehab team will check
if Finistère’s feathers are
waterproof and once he weighs
about 1kg, he will be released.
‘He’s actually a really
feisty chick . . . He’s got an
attitude.’
– Averil Parthonnaud
Like all other penguins
released from the colony, the
chick will be microchipped so
he can be tracked and identified
upon a possible return.
“One day we will be able to
see if the fledglings have made it
back to the colony,” said Averil.
He will likely be mature
enough to go to sea in about two
weeks.
First, Finistère will be “soft
released” into a transition area
in the colony and will have the
choice of when to enter the wild.
“Most fledglings that have
Finistère is
for by
rehabber Averil
by his parents
at the Pōhatu
colony.
night and they are off to sea by
themselves under the cover of
darkness,” Averil said.
It is unknown where Finistère
will go when released.
Averil said no research has
been done into little penguin
foraging habits or their range of
travel.
Finistère was named by a
sponsor as part of the colony’s
‘adopt a penguin’ programme,
after the peninsula in north-west
France they come from. It means
to ‘end of the earth’.
Pōhatu is the largest little
penguin colony in mainland
New Zealand.
The colony was last surveyed
in 2020 and found 928 active
nest sites.
LETTERS 23
Concerns over safety of apartments
YOUR FRONT page fire story
(February 29) and photos have to
be a wake-up call for many.
Christchurch residents’
associations have long opposed
the proliferation of lower-end
multi-apartment developments,
on aesthetic grounds and
because of the destruction of
trees which provide shade and
bird habitat, plus the additional
stress they place on parking and
other infrastructure. These are
all valid concerns.
Association members have
been called selfish nimbys. I
never bought that label, but
we obviously didn’t see the fire
(literally) through the smoke
(screen) we conveniently created
for developers, investors and our
council, in fluffing about with
our first-world whinges.
We did not see the much
bigger and truly sinister picture.
How did we all miss this
significant safety and health
issue? And now we know about
it, we surely can’t unsee it, can
we?
It’s true these places are aimed
at the vulnerable. Three quarters
are owned by investors who
let them out at huge rentals to
people who can ill-afford them,
many being subsidised by the
taxpayer. They’re not long-term
homes; there’s no room to hang
out a decent load of washing,
let alone swing a cat or a tennis
racket. They’re stepping stones,
to nowhere some will say, and
they won’t age well.
But until we walked past the
scene of the fire on New Brighton
Rd, and imagined the terror – of
being on the high second level
while flames raged up the stairs
– we didn’t truly understand the
extent of that vulnerabilty.
Like other onlookers, we
shocked by the pitiful and futile
attempts a desperate mother
must have made to smash
double-glazed windows which
don’t open more than 15cms.
We saw buckled stays which
showed us how desperately she
must have tried to force them,
before dropping her baby from
such a height, and then smashing
her own way out. Most such
FIRE TRAP: Readers say property developers bear some responsibility for the recent fire at
a block of apartments on New Brighton Rd, Shirley.
apartments do not have secondfloor
doors or balconies.
In the days since, I’ve heard
of a man in his 60s who made a
rope ladder when he was housed
in a three storey unit in Salisbury
St. One could not get a more
third world solution, surely? And
of a profoundly deaf woman
who has been refused by her
landlord an upgraded fire alarm,
consequently sleeping in her
downstairs living area.
Is this what the Fire Service
means when it exhorts us all to
plan our escape routes in case
of emergency? Does it have any
say in the consenting process of
these developments?
I live next door to a block of
five, and although I am first to say
they are not the bogey houses we
feared, I now look at the tenants in
a new light.
For the first time I’ve looked
at their window design and
configuration. I know I would
never be able to get out of those
in an emergency, and I sincerely
hope they have taken all possible
steps to protect themselves, until
someone in authority steps up
to the plate to look after them.
And I hope that is very soon, as
accidents will always happen.
– June Peka
Of course it’s good news no one
died at the fire at one of the flats
on New Brighton Rd opposite The
Palms.
Of course it’s good that the
firewalls in between the flats
stopped the fire from spreading.
However, there is no mention
of the fact that only a very small
part of the top-floor windows
can only be opened, making
it almost impossible to get out
quickly.
Why were these flats allowed
to be built with such a lack of
fire-safety planning?
Who is responsible, the
developers, council?
– Ann Vanschevensteen
Smart poles
I am firmly against the
installation of smart poles in our
city. These poles are promoted
as tools to enhance safety, yet
their actual effectiveness is
questionable.
First, the surveillance cameras
on these poles might merely shift
anti-social behaviours to areas
beyond their reach, failing to
address the underlying causes of
crime.
Furthermore, the effectiveness
of these cameras is dubious
without swift police intervention,
which appears to be waning.
Additionally, features such
as car and pedestrian counting
provoke concerns about the real
intentions behind these poles.
Are they truly aimed at security,
or do they serve a more sinister
purpose?
We must not overlook the
broader consequences of
perpetual surveillance. These
poles are a step towards
In truth, this is surveillance
Intrusive cameras have already
been installed at our intersections
THree smart poles are to be built
in Christchurch to keep us safe.
Pedestrian and vehicle counting
are part of the functions and
we are told they are completely
anonymous. I feel safer already.
Security cameras on the poles
will be linked to the police but as
understaffed police reportedly
didn’t even look at CCTV
camera footage of an attempted
abduction of a primary school
aged child in Lyttleton and
another in Woolston earlier this
year, I fail to see how this will
make anyone any safer.
TRAINING PROGRAMME
SuNdAy 17 MARch
12km, 6km Community Fun Run Event
www.city2surf.co.nz
The work is done. The only thing to do now is to freshen up. You do that by getting plenty of sleep and eating healthy foods this week. Nerves can get in the way
of a good taper. So try and “keep the lid on”. Nerves can also interfere with your eating. This is not the time to put on or lose weight. Keep focused on the plan.
You often hear top athletes talking about sticking to the process. That means they are not thinking of the final result at the finish line but they focus on their task
during the event. This also applies to you. It means that most of the time your thoughts will be with your rhythm, pace and technique. Your breathing will be a
good measure of your pace and if your breathing is more laboured than during your training sessions you are going too fast. Prepare yourself to run surrounded
by a large group of people. It can be quite unnerving for some people. Above all, run at your own pace from the start. Hold back a bit when the gun goes off
rather than trying to get ahead of the pack. If you start too fast there will be a price to pay later. If you have someone you can run with who is of a similar level you
can keep each other in check.
TIP OF ThE WEEK
The main tip is to enjoy yourself.
While you are “sticking to the
process” there is no reason why
you can’t take in the occasion at
the same time.
Run with a smile on your face.
Dilo Oil – The Remarkable
Skin Rejuvenator
Until Rachel Hunter’s popular TV series “TOUR OF BEAUTY,”
Dilo oil was relatively unknown, being one of the best-kept
secrets of the Pacific Islands. It may, however, be one of the best
natural beauty and healing oils available as it possesses potent
natural skin regeneration and healing properties.
According to ethnobotanist Chris Kilham, Dilo (pronounced
dee-lo) oil is a powerful skin regenerator as it is one of the most
effective agents in promoting the regeneration and formation of
new tissue, thereby accelerating wound healing and the growth
of healthy skin.
As early as 1918, French researchers discovered what the
people of the South Pacific Islands have known for hundreds of
years: Dilo oil has a rare and powerful ability to heal many skin
conditions. In French medical literature, they described how
the oil healed a gangrenous ulcer on a woman’s leg that was so
serious a condition it would have led to an amputation if the
Dilo oil hadn’t completely cured it.
Dilo oil has the unique ability to spur the formation of new
tissue, drastically speeding up the healing process. Studies show
it promotes cell proliferation and the production of collagen and
glycosaminoglycans or GAG’s. GAG’s are essential for creating
and maintaining healthy collagen and elastin. For this reason,
Dilo oil is fantastic at supporting the healing of wounds and
scars and smoothing fine lines and wrinkles.
Dilo oil is super-absorbing and can penetrate all three layers
of the skin, including the epidermis, dermis and hypodermis.
It offers exceptional cell hydration and regeneration. As well
as this, Dilo oil has potent anti-inflammatory, antimicrobial,
antifungal and antioxidant properties.
Traditionally, Dilo oil is used to keep the skin young and
youthful as well as for just about any skin complaint. Some of
the conditions for which it is considered helpful
include abrasions, cuts and cracks, acne and
acne scars, pimples, blemishes, stretch marks,
wrinkles, blisters, burns (including chemical and
radiation), diabetic sores, rashes, shaving irritation,
dry or scaly skin, eczema, psoriasis, dermatitis,
herpes sores (cold sores), insect bites and stings,
rheumatism, pain, sciatica, shingles, sunburn,
rosacea, athlete’s foot, skin eruptions, warts, skin
ulcers and sores, nappy rash and almost any other skin
ailment and often with incredible results. Dilo oil also
has a natural sun protection factor and is a natural insect
repellent.
Many beauty and skincare products on the market today
contain unnatural ingredients that can be toxic and may even
contribute to disease. Generally, the benefits are exaggerated
and often only temporary or camouflage. Marshall’s Dilo oil
is 100% pure and certified organic. It has been cold-pressed
from the Dilo nut and contains absolutely no additives.
Polynesians and Southeast Asians have revered Dilo oil
for centuries, believing it to be a sacred gift of nature and
the Gods. Dilo oil stimulates and supports the skin’s
natural healing process by growing new healthy skin
tissue. I personally believe it is a remarkable product
and highly recommend it to everyone. A 50ml
bottle is only $19.90 and 100ml is only $32.50.
Title defence a confidence boost for
Kaiapoi ahead of national champs
• By Sam Coughlan
FRESH OFF defending their title
as Canterbury champions, the
Kaiapoi Queens will head into
the national championship with
confidence on home soil.
Kaiapoi won the title last
weekend, beating Papanui in the
final 7-0 at Dynasty Ballpark –
where the nationals will be held
starting today, running through
to Sunday.
Five Canterbury sides are
in the 14-team competition –
Kaiapoi are joined by Riccarton,
Papanui, Halswell and PCU.
Kaiapoi coach Mike McDowell
said the Canterbury title puts
them in good stead.
“We definitely wanted to show
that we’re the same team as last
year.
“(We’re as) confident as we can
be, of course. There’s a few good
teams out there coming down
to try and win this down here,
but, look, it’d be good to give it a
good crack and take it out for the
local fans.”
McDowell said they are
looking to improve on last year’s
semi-final place.
“We choked at one of the last
hurdles. We went through top
seed going into the final round,
then lost the semi-final to a team
that we’ve beat seven times all
year (PCU).
“We’ve learnt from our
mistakes last year and hopefully
we’re not going to make that
mistake again this year.”
With the nationals being the
last competition of the season,
SOFTBALL
McDowell said the team will be
up for the challenge.
“They save their best for last,
and they throw everything at it.
“So it’s going to be a very
exciting tournament.”
Papanui and Halswell will be
the first teams in action today at
9am, against Auckland Metro
and Waitakere, while Riccarton
start at 11am against Otahuhu.
Kaiapoi and PCU will be
the last teams to start their
tournament, against Auckland’s
Metro and Waitakere at 1pm.
Bishopdale into final after tight playoff
• By Diane Keenan
BISHOPDALE will play
Cashmere in the final of the
premier men’s tennis interclub
competition on Saturday after
the rule book determined its
qualification following a draw
with its neighbouring club
Burnside Park in the play-offs.
Bishopdale’s men’s captain
Grayson Cullen is delighted
with his team’s achievement in
reaching the final.
Their path to the final
culminated in them slugging it
out against Burnside Park for
more than five hours for a tie last
week. When the final ball was
played, the score was locked at
three matches, eight sets and 62
games each after a countback.
“It was just the closest and
craziest tie I’ve ever played,”
Cullen said.
“All the singles matches
went to three sets and several
featured some spectacular come
from behind wins in the super
tiebreaks.
“We each won two singles in
three sets and shared the doubles
with identical scores, 7-5 6-3.
Given it was a playoff and there
had to be a winner, we had to
ring Tennis Canterbury for them
to make a ruling on who went
through the final.
“Luckily it was us because we
went into the match on higher
points and we had beaten
Burnside Park in the roundrobin
match.”
Both Cullen and Bishopdale’s
No. 1 Will Schneideman were
down in the tie break before
clawing back to win, with
Schneideman saving four match
points. Burnside Park put up an
excellent fight with Jamie Poole
winning 17-15
in the tiebreak
against Bishopdale’s
club coach
Gareth Robb.
Emilio Gonzaga
continued
his winning form
winning in the Grayson
third set against Cullen
James Wilson.
Cashmere, a convincing
winner over Elmwood in the
semi-final, is seeking its third
season championship in a row
when it plays on its home courts
on Saturday. It also clinched
the title in the pre-Christmas
competition.
Cullen says his team faces
a difficult task against the
experienced Cashmere lineup
which includes all three Meredith
brothers, James, Tim and Matt,
Harry Weeds and Lucas Evans.
“Given the way they have
played this season they deserve
the home tie. We are looking
forward to it as we all get on well.
We will have some supporters
there too as our club is very
proud to be in the final,” he says.
In the women’s competition
Elmwood and Te Kura Hagley
are well deserved finalists with
both teams out-hitting and
outwitting their opponents,
Bishopdale and Cashmere
respectively, in last week’s semifinals.
Bishopdale captain Juliette Ma
won both her singles and doubles
with Aliyah Daly for her team’s
only wins against Elmwood
which took the tie with the other
three singles and a doubles win.
Te Kura Hagley were equally
dominant against Cashmere
whose top singles player Ruby
Young recorded her team’s
only success by winning her
singles and doubles with Jenny
Blackburne.
Elmwood, which also
won the women’s first round
championship, will host the
women’s final.
The club has been all class this
season having the luxury of three
highly-ranked players, Abby
Mason, Tessa McCann and Louise
Oxnevad, ably supported by Mia
Wardlaw, Holly-Jayne Feutz and
the consistent junior, Danielle
Scheepers.
Te Kura Hagley, also has
a formidable lineup. Beth
Williamson, Michele Kelsen, Petra
Belzova, Bailee Wison and Adele
Orangi will not be fazed by their
opposition as are all experienced
players who have competed at the
top level.
The finals get under way at 1pm.

Debutants shine with bat and ball
• By Sam Coughlan
MICHAEL RAE and Matt Rowe
have made an instant impact
on debut for Sydenham in their
match against Merivale-Papanui
at Edgar Macintosh Park.
Rowe, a bowler by trade,
scored 47 from number eight to
lift Sydenham from a perilous
104/6 to 222 all out, before Rae
took over with the ball.
The 28-year-old starred, taking
6/28 to skittle Merivale-Papanui
for 116 in an exhibition of seam
bowling in his first appearance
since moving from Dunedin last
year.
With six overs left in the day
and a lead of more than 100,
Sydenham enforced the followon
but could not pick up another
wicket before stumps with
Merivale-Papanui finishing the
day 12 without loss, trailing by
94 runs.
Burnside West Uni are in
a comfortable position for
an outright win against East
Shirley at Burnside Park and put
themselves in pole position for
back-to-back titles.
Captain Matt Hay took four
wickets as East Shirley were
bowled out for 135 before a
century from 20-year-old Scott
Jannett – scoring 110 off just 92
balls – took Burnside to 234.
Both Shirley openers then
went for golden ducks in their
second innings, Jackson Latham
doing the damage with 3/18 as
Shirley finished the day 33/4, still
66 runs behind Burnside’s firstinnings
total.
The Heathcote pair of Dan
Stanley and Talor Scott cut loose
against St Albans at Heathcote
Domain to secure a healthy firstinnings
lead.
Stanley picked up where he left
off in the one-dayers, scoring 63
runs off just 27 balls at the top
of the order, while Scott contributed
56 off 41 in Heathcote’s
total of 248.
St Albans had earlier been
bowled out for 134 with only
Nabil Moughal (41) offering any
resistance, and will resume their
second innings on Saturday at
79/3.
A confident showing from
Lancaster Park will likely see
them gain valuable first-innings
points – but an outright win
could be beyond them.
Park batted first and scored
226/9 – with skipper Angus
Hamilton facing the last ball of
the innings and hitting it for six
before declaring at the 60-over
mark to gain batting points.
IMPACT: Matt Rowe scored
47 on debut for Sydenham
to dig them out of a hole.
Hamilton was then destroyerin-chief
with the ball, taking
4/38 with his off-spin to leave
Old Boys 137/7, still 89 runs off
Park’s first-innings total.
Matches resume at 10:30am on
Saturday.
Points
Burnside 85.4; Lancaster
Park 70.1; Heathcote 68.3;
Sydenham 62.1; Old Boys
59.2; East Shirley 51.2; St
Albans 32.5; Merivale-
his first appearance of the
season. PHOTO: GETTY
THE CRUSADERS have opted
for experience over youth in their
starting team to face the Fijian
Drua in Lautoka on Saturday, as
they look to avoid an 0-3 start to
the season for the first time since
1996.
Willi Heinz comes in to start
at halfback over youngster Noah
Hotham, who was substituted
early in the second half in the
37-24 loss to the Waratahs last
Saturday in Melbourne, and
misses out entirely this week.
Experience favoured in Crusaders’ line-up against Drua
The only other change to the
run-on team sees Fijian winger
Manasa Mataele start on home
soil, replacing Macca Springer in
the No 11 jersey.
The remainder of the starting
15 is the same, with first-five
Taha Kemara retaining the No
10 jersey in the absence of Fergus
Burke and Rivez Reihana after a
nervy first start last week.
The bench has seen a big
re-shuffle. Only lock Jamie
Hannah and halfback Mitchell
Drummond keep their places
from the trip to Melbourne.
Lock Tahlor Cahill, first-five
Riley Hohepa and midfielder
Jone Rova – another born in
Fiji – are all in line to make their
Crusaders debuts if they get off
the bench.
The red-and-blacks lost the
corresponding fixture last year,
25-24 to the Drua in what would
become a familiar sight – the
Fijians tipping over visiting
teams in the heat and humidity.
