COmmiTTEES Our Annual Tax Newsletter was again a great benefit to our Members this year. It was published in the California Enrolled Agent magazine and made available in PDF format on the website. In an effort to reach out to local agencies and professionals, magazines are continuously sent out to support our PIA efforts. In addition to all of the above, the PIA Committee is currently working on a video production project that we hope to have completed before the end of this fiscal year. It has been a great undertaking but we are actively pursuing its completion. Circular 230 Task Force To protect the interests of CSEA Members, in August 2010 President Kastl charged CSEA Legislative Affairs Chair, Gary Anspach, EA with the formation of a task force to develop positions and compelling testimony on the proposed regulations to modify Circular 230 [REG- 138637-07]. As Chair of the “Circular 230 Task Force” I was privileged to work with a remarkable team of volunteers: Margy Dunn, EA, George van Buren, EA, Anne Arms, EA, and David Shaw, EA. The CSEA Officers and senior staff, as well as Mr. Anspach, served as supporting members, completing an abundant wealth of resources. The Task Force closely analyzed the proposed regulations and through copious email exchanges and a conference call, developed strategies and a timeline for a comprehensive response. Striving for inclusion of all CSEA Members, the Task Force emailed a call for comments and despite a very short timeframe, numerous Members rose to the challenge and added valuable input. One week and a dozen revisions later, our document was finalized for presentation to the CSEA Legislative Affairs Committee at their September meeting in Sacramento. After further revisions by the Committee, the CSEA Board of Directors approved the comments, which were submitted to the IRS and subsequently emailed to all CSEA Members. The final comments articulated CSEA’s chief concern; potentially disastrous changes to the qualifying continuing education (CE) rules. The proposed compliance rules for CE programs would have undermined how CSEA and its Chapters provide education, severely restricting the quantity and hampering the timeliness of qualifying CE available to Members (at the time of this writing, the Final Regulations have not been released, but this provision in Circular 230 is expected to be modified or eliminated). CSEA also suggested the definition of CE should be expanded to include state tax courses that contrast, or relate to, federal tax matters. Other significant issues involved distinctions in terminology. CSEA voiced strong opposition to identifying Regulated Tax Return Preparers (RTRPs) as “practitioners” and suggested adding restrictions on the use of the word “enrolled.” Finally, our commentary called attention to the shortcomings of “Limited Practice” rights and questioned one new sanction provision, advocating that failure to e-file returns should not constitute “disreputable conduct.” It was an honor and pleasure to chair the “Circular 230 Task Force,” and I thank all those who contributed their time and talent to this crucial undertaking.
