➥ European Competition Developments<br />

Following the abolishment of the exemptions<br />

for liner conferences and pooling agreements<br />

in trades to and from Europe with effect from<br />

18 October 2008, the Committee took the lead<br />

in briefi ng members on measures individual<br />

companies should take to ensure that they do<br />

not inadvertently violate EU Competition law,<br />

especially in light of<br />

the severe penalties<br />

that might be imposed.<br />

The Committee further<br />

encouraged members<br />

to show due diligence<br />

to ensure that any<br />

market-related data<br />

is compartmentalised,<br />

both in terms of digital<br />

data and physical<br />

proximity between<br />

various branches and<br />

subsidiaries.<br />

Following the release of Preliminary Draft<br />

Regulations on consortia by the European<br />

Commission, the Committee also submitted its<br />

comments on the application of the Regulation<br />

to certain categories of agreements, decisions<br />

and concerted practices between liner shipping<br />

companies (consortia).<br />

➥ Enhancing Safety, Security & Environmental<br />

Protection in the Straits of Malacca &<br />

<strong>Singapore</strong><br />

The Committee continued to promote active<br />

support amongst SSA members for the<br />

Cooperative Mechanism, which comprises a<br />

Cooperation Forum, a Projects’ Coordination<br />

Committee and the voluntary Aids to Navigation<br />

Fund.<br />

In particular, the Committee expressed its<br />

willingness and strong commitment to participate<br />

actively in the Cooperation Forum to enhance<br />

safety, security and environmental protection in<br />

the Straits of Malacca and <strong>Singapore</strong>.<br />

Services Committee<br />

The Services Committee is chaired by Councillor Mr<br />

Aloysius Seow. This Committee oversees the activities<br />

of the Bunkering Sub-Committee, the Cruise Sub-<br />

Committee, the Ship Operations & Port Services<br />

Sub-Committee and the Training & Development Sub-<br />

Committee.<br />

Provided below is a summary of the main issues<br />

that were addressed by the Committee and its Subcommittees<br />

during the period in review:<br />

Bunkering Sub-Committee<br />

The Bunkering Sub-Committee is chaired by Mr Kan<br />

Hoi Yuen of Shell Eastern Trading (Pte) Ltd. It works<br />

closely with the MPA to develop and enhance the<br />

bunkering industry in <strong>Singapore</strong>.<br />

➥ Material Safety Data Sheets<br />

The Sub-Committee continued to contribute<br />

actively to the IMO Bulk Liquids and Gases (BLG)<br />

Correspondence Group on Material Safety Data<br />

Sheets (MSDS). At the 13th session of the IMO BLG<br />

held in March 2009, MSC resolution 150(77) on<br />

MSDS was fi nalized and to be forwarded to MSC<br />

86 for approval and adoption.<br />

The revised MSDS is in line with <strong>Singapore</strong>’s<br />

position and the Globally Harmonised System<br />

(GHS). Effectively it would not require a separate<br />

MSDS for each separate load/lifting.<br />

Details of the requirements for MSDS under the<br />

revised MSC res 150(77) have since been circulated<br />

to all SSA members as part of the MPA’s <strong>Shipping</strong><br />

Circular No. 17 of 2009.
