➥ European Competition Developments
Following the abolishment of the exemptions
for liner conferences and pooling agreements
in trades to and from Europe with effect from
18 October 2008, the Committee took the lead
in briefi ng members on measures individual
companies should take to ensure that they do
not inadvertently violate EU Competition law,
especially in light of
the severe penalties
that might be imposed.
The Committee further
encouraged members
to show due diligence
to ensure that any
market-related data
is compartmentalised,
both in terms of digital
data and physical
proximity between
various branches and
subsidiaries.
Following the release of Preliminary Draft
Regulations on consortia by the European
Commission, the Committee also submitted its
comments on the application of the Regulation
to certain categories of agreements, decisions
and concerted practices between liner shipping
companies (consortia).
➥ Enhancing Safety, Security & Environmental
Fund.
In particular, the Committee expressed its
willingness and strong commitment to participate
actively in the Cooperation Forum to enhance
Services Committee
The Services Committee is chaired by Councillor Mr
Aloysius Seow. This Committee oversees the activities
of the Bunkering Sub-Committee, the Cruise Sub-
Committee, the Ship Operations & Port Services
Sub-Committee and the Training & Development Sub-
Committee.
Provided below is a summary of the main issues
that were addressed by the Committee and its Subcommittees
during the period in review:
Bunkering Sub-Committee
The Bunkering Sub-Committee is chaired by Mr Kan
Hoi Yuen of Shell Eastern Trading (Pte) Ltd. It works
closely with the MPA to develop and enhance the
bunkering industry in Singapore.
➥ Material Safety Data Sheets
The Sub-Committee continued to contribute
actively to the IMO Bulk Liquids and Gases (BLG)
Correspondence Group on Material Safety Data
Sheets (MSDS). At the 13th session of the IMO BLG
held in March 2009, MSC resolution 150(77) on
MSDS was fi nalized and to be forwarded to MSC
86 for approval and adoption.
The revised MSDS is in line with Singapore’s
position and the Globally Harmonised System
(GHS). Effectively it would not require a separate
MSDS for each separate load/lifting.
Details of the requirements for MSDS under the
revised MSC res 150(77) have since been circulated
to all SSA members as part of the MPA’s Shipping
Circular No. 17 of 2009.
