Kultej Singh vs Circle Inspector of Police & others*,<br />
The petiti<strong>on</strong>er Kultej Singh through this petiti<strong>on</strong> under Article 226 of the C<strong>on</strong>stituti<strong>on</strong>,<br />
has sought for issue of a Writ in the nature of Habeas Corpus directing the resp<strong>on</strong>dent<br />
to produce his brother, Sri Hardeep Singh Resp<strong>on</strong>dents in their counter-affidavit averred<br />
that Sh. Hardeep Singh was arrested <strong>on</strong> 28.09.1990 and was produced before the<br />
J.F.M.C. Savanur <strong>on</strong> 29.09.1990 without any loss of time, however they did not dispute<br />
that Sh. Hardeep Singh was kept in Savanur Police Stati<strong>on</strong> from the morning of<br />
27.0'9.1990' until he was !)roduced before, the Magistrate as Savanur <strong>on</strong> 29.0'9.1990 at<br />
10'.30 a.m.<br />
From a reading of sub-secti<strong>on</strong> (1) of Secti<strong>on</strong> 46 of the Cr.P.C.it is clear that a police<br />
officer while making arrest even if he actually touches the body of the pers<strong>on</strong> to be<br />
arrested, he can be said to have arrested the pers<strong>on</strong>. If a pers<strong>on</strong> is c<strong>on</strong>fined or kept in<br />
the police stati<strong>on</strong> or his movements are restricted within the precincts of a police stati<strong>on</strong>,<br />
it would undoubtedly be a case of arrest. In the instant case, the FIR specifically states<br />
that Hardeep Singh was kept in the police stati<strong>on</strong> from the morning of 27.9.1990.<br />
Secti<strong>on</strong> 57 of the Cr.P.C. provides that no police officer shall detain in custody a pers<strong>on</strong><br />
arrested without warrant for a l<strong>on</strong>ger period than under all the circumstances of the case<br />
is reas<strong>on</strong>able and such period shall not, in the absence of a special order of a<br />
Magistrate under Secti<strong>on</strong> 167, exceed twenty-four hours exclusive of the time<br />
necessary for the journey from the place of arrest to the Magistrate's court. Thus<br />
resp<strong>on</strong>dents 1 and 2 were required to produce Hardeep Singh within 24 hrs. from the<br />
time he was kept in the police stati<strong>on</strong> as Savanur.<br />
