ASCAP is inspecting Funeral Homes<br />
without Music Licenses<br />
BROOKFIELD,WI— A funeral<br />
home in a small town<br />
in South Dakota recently<br />
opened the door to an unwelcome<br />
visitor during a funeral<br />
service – an ASCAP<br />
inspector who was checking<br />
up on funeral homes that do<br />
not have music licenses. AS-<br />
CAP, along with BMI and<br />
SESAC, are the three musiclicensing<br />
organizations in the<br />
United States.<br />
After determining that the<br />
South Dakota funeral home<br />
was allowing copyrighted<br />
music to be performed during<br />
the funeral service, the<br />
ASCAP inspector gave the<br />
funeral home a choice: pay<br />
for an ASCAP license for<br />
2009 or face a copyright infringement<br />
suit with penalties<br />
of up to $30,000. Th e<br />
funeral home had no choice<br />
but to pay for the ASCAP<br />
license for the final four<br />
months of 2009.<br />
Th at individual license cost<br />
more than the annual music<br />
license fee available through<br />
the National Funeral Directors<br />
Association, which gives<br />
a funeral home a blanket<br />
license for all music in the<br />
ASCAP, BMI and SESAC libraries.<br />
Not surprisingly, the<br />
South Dakota funeral home<br />
that alerted NFDA about the<br />
inspection quickly signed-up<br />
for the NFDA music license<br />
for 2010.<br />
When NFDA contacted<br />
ASCAP officials about the<br />
inspection, ASCAP verifi ed<br />
that it has targeted funeral<br />
service for enforcement after<br />
discovering signifi cant numbers<br />
of funeral home locations<br />
that were not licensed. Several<br />

of Pittsburgh, PA and its Trustee Debora S. Foster, and<br />
Magee-Women’s Hospital of University of Pittsburgh Medical<br />
Center and its President Leslie Davis were recipients of the<br />
Adiago Health 2009 Tempo Award.<br />
Th e presentations were made by Sandra T. Tomlinson and the<br />
Adiago Health Board of Directors during the VIP party that<br />
preceded Hot Pink Pittsburgh. Elleanor and her son, Pitts-<br />
burgh Steeler Max Starks, have been honorary chairs of this<br />
Pittsburgh event that features<br />
a sizzling evening of music<br />
and dance to fi ght breast cancer<br />
and cervical cancer for the<br />
past fi ve years.<br />
Eden Hall Foundation is<br />
a private foundation established<br />
pursuant to the will of<br />
Sebastin Mueller, a Pittsburgh<br />
philanthropist and vice president<br />
and director of the H.J.<br />
Heinz Company. During his<br />
lifetime, Mr. Mueller gave<br />
substantial support to im-<br />

the support of health facilities and projects. Today, the trustees<br />
of the Eden Hall Foundation continue his stewardship in<br />

Elleanor Davis Starks, CFSP is the founder and Executive<br />
Director of the 100 Black Women of Funeral Service. Founded<br />
in 1993, this organization has provided a strong network for<br />
leadership development, continuing education opportunities,<br />
mentoring, leadership and scholarships making quality education<br />
a priority. A native of Detroit, MI, Ms. Starks has studied<br />
at Kentucky State University, Xavier University, Emory University,<br />
University of Florida and Gupton Jones College of Funeral<br />
Service. She is a licensed funeral director and embalmer<br />
in the state of Florida. She has served on the Board of Directors<br />
of the Florida Morticians Association and is past Education<br />
Director, past Director of Public Relations and past Programming<br />
Director for the Children’s Jr. FMA Program, Regional<br />
Vice President of Epsilon Nu Delta Mortuary Fraternity, Inc<br />
Alpha Gamma Chapter, and currently is a member of the Al-<br />

receiving letters from<br />
ASCAP regarding federal<br />
copyright law and the music<br />
license requirement. If a<br />
member has all of its locations<br />
licensed through NFDA, they<br />
should disregard the letter; if<br />
they are not licensed through<br />
NFDA, they should contact<br />
NFDA immediately to renew<br />
their license.<br />
Members of NFDA are eligible<br />
to purchase a comprehensive<br />
music license covering<br />
all three music-licensing<br />
organizations, ASCAP, SES-<br />
AC and BMI, at the lowest<br />
price available anywhere. A<br />
license must be purchased<br />
annually for each funeral<br />
home location in order for<br />
the business to be properly<br />
licensed and comply with<br />
federal copyright law.<br />

Annual Charity Bowl for Cancer along with her support of the<br />
annual Adiago Health Hot Pink. Elleanor is also involved in<br />
many education and literary causes with her son and the Max<br />
Starks Charitable Fund at the Pittsburgh Foundation. She is<br />
an ambassador of the American Heart Association Go Red<br />
Campaign and is an American Stroke Association advocate<br />
for better health for African Americans around the nation- this<br />
year promoting the Power to End Stroke Program through her<br />
funeral directors association.<br />
Eleanor Starks aff ectionately known around the Pittsburgh<br />
Steelers Organization players and staff , as “Mama Starks,” has<br />
served as the NFL Steeler Team Mom and the TV Chunky<br />
Campbell Soup Mom Celebrity of the Super Bowl Champion<br />
Pittsburgh Steelers. She lends her support to the Professional<br />
Football Players Mothers Association, Th e National Mom<br />
Squad and serves the NFL Moms Organization as their President.<br />
Each NFL Mothers organization is involved with many<br />
philanthropic causes and charities both locally and nationally<br />

ALBANY,NY— Randy L. McCullough, Deputy Executive Director<br />
of the New York State Funeral Directors Association<br />
(NYSFDA), was elected as a member of the Board of Directors<br />
of the Public Aff airs Council at the Board’s meeting this month.<br />
Th e Council, based in Washington, DC, is the leading international<br />
association for public aff airs professionals and is comprised<br />
of over 600 member companies and associations. Its mission is<br />
to advance the fi eld of public aff airs and to provide tools and<br />
resources that enable public aff airs executives and managers to<br />
achieve their business and professional goals.<br />
Th e volunteer Board of Directors, which governs the Public Affairs<br />
Council, is comprised of leaders in the public aff airs arena.<br />

senior staff member /committee director for former New York State<br />
Assemblyman Paul D. Tonko, who now represents the region as a<br />
Member of Congress in the U.S. House of Representatives (NY-21).<br />
McCullough graduated from Hartwick College (Oneonta, NY)<br />
with a B.A. in Political Science, earning Departmental Distinction<br />
honors. He also undertook graduate studies in international aff airs<br />
at Th e George Washington University, Washington, DC.<br />
McCullough also serves on the Board of Directors of the Albany-based<br />
Empire State Society of Association Executives (ES-<br />
SAE). He has also been a member of the board of directors for<br />
several organizations, including the American Red Cross (Northeastern<br />
New York Chapter) and the Hartwick College Alumni<br />
Association, where he served on its Executive Committee, and<br />
headed the Albany-area Alumni Chapter for several years.<br />
Founded in 1889, NYSFDA’s mission is to promote the highest<br />
standards of funeral service to the public and to enhance the<br />
environment in which its members operate. Over 900 member<br />
fi rms and their 3000 licensed funeral directors who practice<br />
across the state belong to the Association.<br />
