En el rotlle núm. 199/2012 d’aquesta Secció, corresponent al recurs d’apel·<strong>la</strong>ció<br />
<strong>de</strong> les actuacions <strong>de</strong> judici verbal núm. 169/2009 <strong>de</strong>l JUTJAT PRIMERA INS-<br />
TÀNCIA 3 BLANES, promoguts per GAS NATURAL DISTRIBUCIóN SDG,<br />
S.A., contra Alex Forts Baches, s’ha dictat en data 8 <strong>de</strong> maig <strong>de</strong> 2012 <strong>la</strong> resolució<br />
que conté l’encapça<strong>la</strong>ment i <strong>la</strong> part dispositiva següents:<br />
“SENTENCIA Nº 198/2012<br />
MAGISTRADO<br />
Don FERNANDO FERRERO HIDALGO<br />
En Girona, ocho <strong>de</strong> mayo <strong>de</strong> dos mil doce<br />
VISTO el Rollo <strong>de</strong> ape<strong>la</strong>ción nº 199/2012, en el que ha sido parte ape<strong>la</strong>nte GAS<br />
NATURAL DISTRIBUCIóN SDG, S.A., representada esta por <strong>la</strong> Procuradora<br />
DÑA. ESTHER SIRVENT CARBONELL, y dirigida por el Letrado D. TOMÁS<br />
MARTÍNEZ LOZANO; y como parte ape<strong>la</strong>da D. ALEx FORTS BACHES, no<br />
comparecido en esta alzada.<br />
F A L L O<br />
Que <strong>de</strong>bo estimar el recurso <strong>de</strong> ape<strong>la</strong>ción formu<strong>la</strong>do por GAS NATURAL<br />
DISTRIBUCIóN SDG, S.A. contra <strong>la</strong> sentencia dictada por el JUZGADO DE 1ª<br />
INSTANCIA Nº 3 DE BLANES, en los autos <strong>de</strong> JUICIO VERBAL Nº 169/2009,<br />
con fecha 11/12/2009.<br />
Debo REVOCAR <strong>la</strong> misma en el sentido <strong>de</strong> estimar íntegramente <strong>la</strong> <strong>de</strong>manda<br />
interpuesta por GAS NATURAL DISTRIBUCIóN SDG, S.A. contra D. ALEx<br />
FORTS BACHES, con<strong>de</strong>nándole a pagar <strong>la</strong> cantidad <strong>de</strong> 1.882,40 euros, más los<br />
intereses <strong>de</strong>s<strong>de</strong> <strong>la</strong> <strong>de</strong>manda y <strong>la</strong>s costas <strong>de</strong> primera instancia<br />
No proce<strong>de</strong> pronunciamiento sobre <strong>la</strong>s costas <strong>de</strong> esta alzada.<br />
Devuélvase el <strong>de</strong>pósito constituido para recurrir.<br />
Líbrense testimonios <strong>de</strong> <strong>la</strong> presente resolución para su unión al Rollo <strong>de</strong> su razón<br />
y remisión al Juzgado <strong>de</strong> proce<strong>de</strong>ncia, junto con <strong>la</strong>s actuaciones originales.<br />
Así por esta mi sentencia, <strong>de</strong>finitivamente juzgando, <strong>la</strong> pronuncio, mando y<br />
firmo”<br />
