12 DÍA DEL MAESTRO LA EDUCACIÓN: ESTRUCTURA DEL SISTEMA DOMINICANO Situación actual El sistema educativo de la República Dominicana se estructura en torno a cuatro niveles: inicial, primario, secundario y superior. La educación inicial está destinada a niños de 0 a 5 años; el nivel primario, de 6 a 11 años, y la secundaria está orientada a los adolescentes de entre 12 y 17 años. El Sistema de Información de Tendencias Educativas en América Latina de la UNESCO, plantea que en República Dominicana, el tramo de escolarización obligatoria se extiende por 13 años. El país, junto con Argentina, Bolivia, Brasil, Chile, Costa Rica, Ecuador, Honduras, México, Paraguay, Perú, Uruguay y Venezuela forma parte del grupo de países latinoamericanos donde la educación media es obligatoria en toda la extensión del nivel. La brecha de escolarización se amplía en los niños y adolescentes que vienen de familias de menor nivel socioeconómico y de quienes residen en áreas rurales. SAIURY CALCAÑO Santo Domingo, RD La niñez está salvaguardada bajo leyes especiales que los protegue y los ampara, y que a la vez los separa de los adultos para darles prioridad. La abogada Catalina Encarnación, especialista en Derechos Humanos con experiencia en la niñez, entiende que esto ocurre porque desde tiempos muy antiguos se dieron acontecimientos que vulneraban los derechos de la infancia y los países se vieron en la necesidad de establecer normas o leyes para garantizar los derechos de los niños y niñas. La educación es precisamente uno de los derechos fundamentales de los menores de edad, que les permite desarrollar sus habilidades, adquirir conocimientos que contribuyen a su desarrollo integral para alcanzar una vida plena. Protección legal En el artículo 28 de la Convención sobre los Derechos del Niño establece que los Estados partes reconocen el derecho del niño a la educación, destacando que se pueda ejercer progresivamente y en condiciones de igualdad de oportunidades. En el país, la educación es fundamental, establecido en el Artículo 63 de la Constitución dominicana, el cual establece que “toda persona tiene derecho una educación integral, de calidad , permanente, en igualdad de condiciones y oportunidades, sin más limitaciones que las derivadas de sus aptitudes, vocación y aspiraciones”. La edad mínima de acceso a educación es a partir de los 3 años de edad, educación inicial. La enseñanza básica es obligatoria y gratuita. de acuerdo a la Ley 136-03. El tramo de escolarización obligatoria se extiende por 13 años. “La educación básica es obligatorio y gratuita. Tanto los padres como el Estado son responsables de garantizar los medios para que todos los niños y niñas completen su formación primaria básica”, enfatiza la abogada. En ningún caso podrá negarse la educación a los niños, niñas y adolescentes alegando razones como: la ausencia de los padres, representantes o responsables, la carencia de documentos de identidad o recursos económicos o cualquier otra causa que vulnere sus derechos. Un responsabilidad compartida Asimismo la Carta Magna establece que es una responsabilidad del Estado y la Familia el cumplimiento de este derecho. Competen al Estado las siguientes funciones en materia de educación, ciencia y cultura: Promover, establecer, organizar, dirigir y sostener los servicios educativos, científicos, tecnológicos, culturales y artísticos de acuerdo con las necesidades nacionales. Además, el Artículo 20 de la Ley 66-97 establece que la familia tiene la obligación de escolarizar a sus hijos en la edad escolar e interesarse por el avance de sus hijos en la escuela, apoyar los esfuerzos de los maestros para que reciban una buena educación y crear en ellos una actitud positiva hacia el estudio y de respeto por el conocimiento. “Los padres y la comunidad tienen el deber de ayudar a la escuela, de acuerdo con sus posibilidades y capacidades intelectuales, humanas y económicas, dentro de un espíritu de cooperación y solidaridad. La familia a de asumir fuera de la escuela la mayor responsabilidad posible en cuanto la educación moral y ciudadana”, precisa Encarnación. Sanciones La Ley 136-03 especifica medidas para los padres cuando estos no están enviando a sus hijos a la escuela, se establecen procedimientos que van desde visita a la familia para saber los motivos por la no asistencia a la escuela, hasta tomar medida judiciales por el director del cent r o educativo o por la Junta Local de Protección y Restitución de Derechos para obligar a los tutores a que envíe el niño a la escuela. Estas normas podrían traer para los padres que no atiendan a las recomendaciones sanciones penales por vulneración del derecho a la educación de la niñez. Todas las personas tienen el deber de comunicar al Consejo Nacional para la Niñez y la Adolescencia (CONANI), si algún niño, niña o adolescente está desvinculados de la escuela. CONANI es la entidad responsable de vincular, por todos los medios posibles a niños, niñas y adolescentes que se hayan ausentado o desertado de un centro educativo.
