Artikel 49<br />
Rechnungsprüfung<br />

(1) Die Rechnung über alle Einnahmen<br />
und Ausgaben des Haushaltsplans<br />
sowie eine Übersicht über das Vermögen<br />
und die Schulden der Organisation<br />
werden von Rechnungsprüfern<br />
geprüft, die volle Gewähr für ihre Unabhängigkeit<br />
bieten müssen und vom<br />
Verwaltungsrat für einen Zeitraum von<br />
fünf Jahren bestellt werden; die Bestellung<br />
kann verlängert oder erneuert<br />
werden.<br />
(2) Die Prüfung erfolgt anhand der Rechnungsunterlagen<br />
und erforderlichenfalls<br />
an Ort und Stelle. Durch die Prüfung<br />
wird die Rechtmäßigkeit und Ordnungsmäßigkeit<br />
der Einnahmen und<br />
Ausgaben sowie die Wirtschaftlichkeit<br />
der Haushaltsführung festgestellt. Nach<br />
Abschluss eines jeden Haushaltsjahrs<br />
erstellen die Rechnungsprüfer einen<br />
Bericht, der einen unterzeichneten<br />
Bestätigungsvermerk enthält.<br />
(3) Der Präsident des Europäischen<br />
<strong>Patent</strong>amts legt dem Verwaltungsrat<br />
jährlich die Rechnungen des abgelaufenen<br />
Haushaltsjahrs für die Rechnungsvorgänge<br />
des Haushaltsplans und die<br />
Übersicht über das Vermögen und die<br />
Schulden zusammen mit dem Bericht<br />
der Rechnungsprüfer vor.<br />
(4) Der Verwaltungsrat genehmigt die<br />
Jahresrechnung sowie den Bericht der<br />
Rechnungsprüfer und erteilt dem Präsidenten<br />
des Europäischen <strong>Patent</strong>amts<br />
Entlastung hinsichtlich der Ausführung<br />
des Haushaltsplans.<br />
Artikel 50<br />
Finanzordnung<br />
Die Finanzordnung regelt insbesondere:<br />
a) die Art und Weise der Aufstellung und<br />
Ausführung des Haushaltsplans sowie<br />
der Rechnungslegung und Rechnungsprüfung;<br />
b) die Art und Weise sowie das Verfahren,<br />
wie die in Artikel 37 vorgesehenen<br />
Zahlungen und Beiträge sowie die in<br />
Artikel 41 vorgesehenen Vorschüsse<br />
von den Vertragsstaaten der Organisation<br />
zur Verfügung zu stellen sind;<br />
c) die Verantwortung der Anweisungsbefugten<br />
und der Rechnungsführer<br />
sowie die entsprechenden Kontrollmaßnahmen;<br />
d) die Sätze der in den Artikeln 39, 40<br />
und 47 vorgesehenen Zinsen;<br />
Article 49<br />
Auditing of accounts<br />
(1) The income and expenditure account<br />
and a balance sheet of the Organisation<br />
shall be examined by auditors whose<br />
independence is beyond doubt,<br />
appointed by the Administrative Council<br />
for a period of five years, which shall be<br />
renewable or extensible.<br />
(2) The audit shall be based on vouchers<br />
and shall take place, if necessary, in situ.<br />
The audit shall ascertain whether all<br />
income has been received and all<br />
expenditure effected in a lawful and<br />
proper manner and whether the financial<br />
management is sound. The auditors<br />
shall draw up a report containing a<br />
signed audit opinion after the end of<br />
each accounting period.<br />
(3) The President of the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong> shall annually submit to the<br />
Administrative Council the accounts of<br />
the preceding accounting period in<br />
respect of the budget and the balance<br />
sheet showing the assets and liabilities<br />
of the Organisation together with the<br />
report of the auditors.<br />
(4) The Administrative Council shall<br />
approve the annual accounts together<br />
with the report of the auditors and shall<br />
discharge the President of the <strong>European</strong><br />
<strong>Patent</strong> <strong>Office</strong> in respect of the implementation<br />
of the budget.<br />
Article 50<br />
Financial Regulations<br />
The Financial Regulations shall lay down<br />
in particular:<br />
(a) the arrangements relating to the<br />
establishment and implementation of the<br />
budget and for the rendering and<br />
auditing of accounts;<br />
(b) the method and procedure whereby<br />
the payments and contributions provided<br />
for in Article 37 and the advances<br />
provided for in Article 41 are to be made<br />
available to the Organisation by the<br />
Contracting States;<br />
(c) the rules concerning the responsibilities<br />
of authorising and accounting<br />
officers and the arrangements for their<br />
supervision;<br />
(d) the rates of interest provided for in<br />
Articles 39, 40 and 47;<br />
Article 49<br />
Vérification des comptes<br />
2007<br />
(1) Les comptes de la totalité des<br />
recettes et dépenses du budget, ainsi<br />
que le bilan de l’Organisation, sont<br />
examinés par des commissaires aux<br />
comptes offrant toutes les garanties<br />
d’indépendance, nommés par le Conseil<br />
d’administration pour une période de<br />
cinq ans qui peut être prolongée ou<br />
renouvelée.<br />
(2) La vérification a lieu sur pièces et au<br />
besoin sur place. La vérification a pour<br />
objet de constater la légalité et la régularité<br />
des recettes et dépenses et de<br />
s’assurer de la bonne gestion financière.<br />
Les commissaires établissent après la<br />
clôture de chaque exercice un rapport<br />
qui contient une certification des<br />
comptes signée.<br />
(3) Le Président de l’<strong>Office</strong> européen<br />
des brevets soumet chaque année au<br />
Conseil d’administration les comptes de<br />
l’exercice écoulé afférents aux opérations<br />
du budget, ainsi que le bilan de<br />
l’actif et du passif de l’Organisation,<br />
accompagnés du rapport des commissaires<br />
aux comptes.<br />
(4) Le Conseil d’administration approuve<br />
le bilan annuel ainsi que le rapport des<br />
commissaires aux comptes et donne<br />
décharge au Président de l’<strong>Office</strong> européen<br />
des brevets pour l’exécution du<br />
budget.<br />
Article 50<br />
Règlement financier<br />
Le règlement financier détermine notamment<br />
:<br />
a) les modalités relatives à l’établissement<br />
et à l’exécution du budget ainsi<br />
qu’à la reddition et à la vérification des<br />
comptes ;<br />
b) les modalités et la procédure selon<br />
lesquelles les versements et contributions<br />
prévus à l’article 37, ainsi que les<br />
avances prévues à l’article 41, doivent<br />
être mis à la disposition de l’Organisation<br />
par les Etats contractants ;<br />
c) les règles et l’organisation du contrôle<br />
et la responsabilité des ordonnateurs et<br />
comptables ;<br />
d) les taux d’intérêts prévus aux<br />
articles 39, 40 et 47 ;
