• Unauthorized modifications made to the Product; altered serial numbers; failure to followmanufacturer’s instructions on installation, operation or maintenance; repairs performed by nonauthorizedrepairer; any items not affecting the function of the Products; image burn.• Software (including operating system and any stored data), defects resulting directly from softwareinstallation and or removal, computer virus, virus prevention, and other peripherals.• Repairs to hardware that has been added after the original purchase of the Product.• All batteries (including regular (non-chargeable) batteries) unless otherwise as covered above.• External faults such as wiring, electrical connection or fitting, realigning of signal receivers (poorreception), and consequential loss of any kind.• Repairs necessitated by accidental or intentional physical damage, spilled liquid unless otherwise ascovered above.• Burglary, theft, corrosion, animal and insect infestation, misuse, neglect and abuse.• Failure caused by a voltage converter and /or applying incorrect voltage to the Product.• Diagnosis where no defect has been found or noted.• Defects and on-site service charges not covered by the manufacturer's original written warranty,unless otherwise as covered above.• Shipping charges and damage, express service charges, transportation damage, removal, installationor reinstallation of the Product, products on loan during the repair process.• Commercial use (multi-user organizations), public rental, use for profit or communal use for multifamilyhousing.• Any loss or damage to the Product resulting from fire or flood howsoever caused.• Any loss or damage to the Product resulting from an act of God (including without limitation, eventssuch as earthquake, war, invasion, act of foreign enemy, hostilities or warlike operations, civil war,civil commotion).THIS EW SERVICE CONTRACT IS NOT AN INSURANCE POLICY. IT IS A SERVICE CONTRACTPROVIDING REPAIRS FOR COVERED DEFECTS. IT DOES NOT PROVIDE ANY GUARANTEE ORPROMISE RELATING TO THE NATURE OF THE MATERIAL, WORKMANSHIP OR PERFORMANCE OFTHE COVERED PRODUCT.LIMITATION OF LIABILITY• Coverage will not, under any circumstances, extend to any loss or injury to a person or loss ordamage to property or any incidental, contingent, special or any direct or indirect loss andconsequential damages including but not limited to losses incurred due to any delay in renderingservice related to this EW Service Contract and loss of use during the period that your Product is atan authorized repairer and/or while awaiting parts.• Maxis’ and/or Insurer’s liability for any one (1) repair visit shall in no event exceed the marketvalue of the Product at the time of said repair visit.• Replacement parts will be new, original or non-original manufacturer’s parts that perform to factoryspecifications of the product determined at Insurer’s discretion.• Insurer will replace your Product with one of like kind and quality if the Product is not repairable orbeyond economical repair. The replaced Product (the spoilt unit) shall become property of Insurer.Due to technological advances, the replacement product may be of lower retail value than theoriginal Product. Any such replacement will immediately terminate this EW Service Contract with norefund of the EW Service Contract fee and Maxis shall have no further obligations for the remainderof the term of this EW Service Contract.• The total of all benefits paid or payable under this EW Service Contract while it is in force shall notexceed the original purchase price paid by the EW Service Contract purchaser for the Productcovered by the EW Service Contract.
TERMINATIONThis EW Service Contract shall terminate immediately with no refund of the EW Service Contract fee inthe event of any of the following:• Subsequent sales of the Product when no written request to transfer this EW Service Contract to thenew owner has been received by Insurer;• Disposal or repossession of the Product;• Unauthorized repair, replacement or modification of the Product; or• If the Product is moved out of the country of purchase, it will not be covered by this EW ServiceContract.CANCELLATIONCancellation of this EW Service Contract is applicable only when the Product is returned to or exchangedby Maxis within seven (7) days from the date of the Maxis Sales Invoice / Receipt for the Product. Theoriginal Maxis Sales Invoice/Receipt together with the EW Service Contract must also be returned toMaxis for refund.USE OF PERSONAL DATAAny personal information collected and retained by Maxis and Insurer is for the purpose of affirming theextended warranty coverage and fulfill the obligations of the same as well as to update the purchaser onthe necessary services and awareness of the related products (if any). Kindly be informed that in order toprovide the extended warranty coverage, the purchaser’s personal information may be held, used anddisclosed by Maxis to Insurer or to any of Maxis’ contracted service provider in order to support back-endprocessing and collateral services associated with the extended warranty coverage. The Purchaserhereby expressly consents that Maxis, Insurer and Maxis’ contracted service provider may use thepurchaser’s personal information for any purpose which is necessary or related to this EW ServiceContract.ENTIRE AGREEMENTThis is the entire agreement between Maxis, the Insurer and the Purchaser of this EW Service Contractand no other oral or written representation is valid. In the event of any inconsistency between theEnglish text and text in other languages, the English version shall prevail.SERVIS KONTRAK JAMINAN LANJUTAN MAXIS (DIBAWA BERSAMA DENGAN CHARTIS MALAYSIAINSURANCE BERHAD (“SYARIKAT INSURANS”))TERMA-TERMA DAN SYARAT-SYARAT (VERSI BAHASA MALAYSIA)PERLINDUNGAN• Kontrak Servis Jaminan Lanjutan Maxis ini (Kontrak Jaminan Lanjutan) menyediakan perlindunganuntuk alat ganti dan kerja buruh bagi Produk yang dilindungi seperti yang tertera di dalamInvois/Resit Penjualan Maxis untuk kerosakan mekanikal dan elektrikal sahaja dan hanya setakatdisediakan oleh pihak pengeluar Produk tersebut, dan melanjutkan jangkawaktu perlindungantersebut yang akan berkuatkuasa apabila tarikh jaminan pihak pengeluar luput dan berakhir padaTarikh Luput Jaminan Lanjutan menurut kepada Kontrak Jaminan Lanjutan yang dipilih bagi Produktersebut.• Ini bermaksud, termasuk jaminan pihak pengeluar, Produk tersebut akan mendapat jaminansepenuhnya dari tarikh pembelian, bergantung kepada bayaran tertentu bagi Pelan Jaminan Lanjutanyang dipilih.
