Kosovo: <strong>Time</strong> <strong>for</strong> EULEX to prioritize <strong>war</strong> <strong>crimes</strong><br />
DEVELOPING A CONFIDENT AND COMPETENT BODY OF PROSECUTORS AND JUDGES<br />
<strong>Amnesty</strong> <strong>International</strong>’s interviews with both international and local prosecutors and judges<br />
in Kosovo indicate strongly that EULEX should retain a role within Kosovo’s justice system<br />
beyond 2014, particularly in relation to <strong>crimes</strong> under international law. However, <strong>Amnesty</strong><br />
<strong>International</strong> – along with many local prosecutors and judges – recognises the necessity <strong>for</strong><br />
EULEX to adopt an exit strategy.<br />
<strong>To</strong> this end <strong>Amnesty</strong> <strong>International</strong> advocates that EULEX should be mandated to support the<br />
ongoing development of a competent, confident, impartial, independent and effective body of<br />
local prosecutors and judges with the capacity to prosecute and adjudicate on <strong>war</strong> <strong>crimes</strong><br />
cases, to work alongside EULEX as long as they remain in Kosovo.<br />
FROM MONITORING TO MENTORING AND ADVISING<br />
<strong>Amnesty</strong> <strong>International</strong> recommends that a gradual transition from the current model of<br />
monitoring local SPRK prosecutors to mentoring and advising them, should be adopted in the<br />
next mandate period.<br />
This provision fits neatly within the current Monitoring, Mentoring and Advice (MMA)<br />
framework, although it is clear that additional international experts, prosecutors and judges,<br />
with expertise in international criminal law and complex <strong>war</strong> <strong>crimes</strong> cases, will be needed to<br />
provide such mentoring and advice, leaving experienced international prosecutors with<br />
executive powers to continue their prosecutorial function .<br />
“As a prosecutor in district prosecutor’s office and here in the SPRK I have had very different<br />
experiences. In the District Court EULEX did not have an executive role, so it worked quite<br />
well. We had regular MMA meetings. On very sensitive cases, we had mixed teams– it worked<br />
very well. In the SPRK the international prosecutors have executive powers. The international<br />
prosecutors all have different experiences in different states, and it takes a long time <strong>for</strong><br />
them to get adjusted to the system here. They should ask the locals and get to know us<br />
better. A Finnish prosecutor told me, when he was leaving at the end of his contract, “I was<br />
not able to give you a lot of advice. I got more from you than I could give to you.” 141<br />

“ [e]f<strong>for</strong>ts will be evaluated by the degree to which local prosecutors are able or willing to assume<br />
controversial and significant cases in the absence of international assistance”. 142<br />
The Law on the SPRK enables local prosecutors within the SPRK to conduct prosecutions <strong>for</strong><br />
<strong>war</strong> <strong>crimes</strong>. Yet, to date, only two local prosecutors within the SPRK have undertaken such<br />
prosecutions: “There has been a general improvement in the SPRK: there are now 10 local<br />
prosecutors, and they have the competency and the courage to take on sensitive cases. Seven<br />
of them are ready to take on <strong>war</strong> <strong>crimes</strong> cases. In relation to <strong>war</strong> <strong>crimes</strong> cases we need more<br />
training, especially in relation to international law. EULEX is temporary and […] over time the<br />
local prosecutors need to adjust and take these cases”, <strong>Amnesty</strong> <strong>International</strong> interview with<br />
