12. THE FUTURE PROSECUTION OF<br />

CRIMES UNDER INTERNATIONAL LAW<br />

<strong>Amnesty</strong> <strong>International</strong> considers that if EULEX is mandated to implement the measures set<br />

out so far in this report, it would be able to make a significant contribution to<strong>war</strong>ds ending<br />

impunity <strong>for</strong> <strong>crimes</strong> under international law.<br />

However, EULEX cannot and will not remain in Kosovo <strong>for</strong> the decades it will take to address<br />

the vast backlog of cases. Immediate steps must be taken within the period of the 2012-14<br />

mandate to move to<strong>war</strong>ds the development of a long-term, comprehensive plan to build a<br />

sustainable justice system <strong>for</strong> the investigation and prosecution of <strong>war</strong> <strong>crimes</strong>.<br />

<strong>Amnesty</strong> <strong>International</strong> believes that urgent consideration should be given to<strong>war</strong>ds exploring<br />

the possibilities of a long-term judicial mechanism to ensure the future prosecution of the<br />

remaining legacy of <strong>war</strong> <strong>crimes</strong> cases. Such an undertaking should be carried out in<br />

consultation with the Ministry of Justice, and members of the Kosovo prosecutorial and<br />

judicial bodies, and involve consultation with civil society. Such a mechanism should take<br />

into account both Kosovo’s particular situation and the experience of other post-conflict<br />

countries in the region.<br />

Consideration should be given to balancing the continued necessity of an internationalised<br />

element with the need to establish an independent and impartial body of local police<br />

investigators, prosecutors and judiciary specialising in <strong>war</strong> <strong>crimes</strong>. Such a mechanism should<br />

ensure the highest standards of protection and support <strong>for</strong> witnesses and victims, and <strong>for</strong><br />

prosecutors and judges involved in such cases.<br />

Working in conjunction with other European Union institutions, EULEX should help to<br />

establish long term institutions and structures to ensure continuity of its work. The<br />

organization is a<strong>war</strong>e of the launch of a structured dialogue between the European<br />

Commission and the Kosovo government on the rule of law in Kosovo, to focus on organized<br />

crime and corruption, and on visa liberalization. <strong>Amnesty</strong> <strong>International</strong> considers that<br />

measures to address impunity <strong>for</strong> <strong>war</strong> <strong>crimes</strong> should <strong>for</strong>m an essential component of this<br />

dialogue.<br />

ACROSS THE REGION<br />

Across the region, several different mechanisms have been established <strong>for</strong> the prosecution of<br />

<strong>war</strong> <strong>crimes</strong>. They include so-called hybrid courts, which maintain an internationalized<br />

presence, special chambers <strong>for</strong> the prosecution of <strong>war</strong> <strong>crimes</strong> and other serious <strong>crimes</strong> under<br />

international law, and the conduct of proceedings in local domestic courts.<br />

The War Crimes Chamber (WCC) at the State Court of Bosnia and Herzegovina was<br />

established in March 2005, under the Law on the Court of BiH, with the aim of increasing<br />

the capacity of the judiciary in BiH to investigate and prosecute cases of <strong>war</strong> <strong>crimes</strong>. 169 The<br />

Special Department <strong>for</strong> War Crimes of the Prosecutor's Office was established at the same<br />
