a. General applicability. These rules apply in all proceedings in the courts <strong>of</strong> this state, including<br />

proceedings before magistrates and court-appointed referees and masters, except as otherwise<br />

provided by rules <strong>of</strong> the <strong>Iowa</strong> Supreme Court.<br />

b. Rules <strong>of</strong> privilege. Rule 5.501, with respect to privilege, applies at all stages <strong>of</strong> all actions,<br />

cases, and proceedings.<br />

c. Rules inapplicable. These rules, other than rule 5.501, with respect to privilege, do not apply<br />

in the following situations:<br />

(1) Preliminary questions <strong>of</strong> fact. The determination <strong>of</strong> questions <strong>of</strong> fact preliminary to the<br />

admissibility <strong>of</strong> evidence when the issue is to be determined by the court under rule 5.104(a).<br />

(2) Grand jury. Proceedings before grand juries.<br />

(3) Summary contempt. Contempt proceedings in which an adjudication is made without prior<br />

notice and a hearing.<br />

(4) Miscellaneous proceedings. Proceedings for extradition or rendition; preliminary hearings<br />

in criminal cases, sentencing, and granting or revoking probation; issuance <strong>of</strong> warrants for arrest,<br />

criminal complaints, and search warrants; and proceedings with respect to release on bail or otherwise.<br />

Rule 5.1103 Title. The rules in this chapter shall be known as the <strong>Iowa</strong> Rules <strong>of</strong> Evidence and may<br />

be cited as <strong>Iowa</strong> R. Evid.<br />
