10:<strong>122</strong>-2.6 Complaints<br />
(e) Each license and each Certificate <strong>of</strong> Life/Safety Approval issued by the<br />
Bureau to a center is the property <strong>of</strong> the State <strong>of</strong> New Jersey. If the Bureau suspends<br />
or revokes a license or a Certificate <strong>of</strong> Life/Safety Approval, the center shall return<br />
the license or Certificate <strong>of</strong> Life/Safety Approval to the Bureau immediately.<br />
(f) If the Bureau determines to suspend, revoke or refuse to renew the center’s<br />
license or Certificate <strong>of</strong> Life/Safety Approval, the Bureau shall notify the parent <strong>of</strong><br />
each enrolled <strong>child</strong> <strong>of</strong> the action.<br />
1. Upon notification by the Bureau <strong>of</strong> an action against the center’s license or<br />
Certificate, the center shall provide to the Bureau the name and mailing address <strong>of</strong><br />
each <strong>child</strong>’s parent.<br />
2. Within 20 days after notifying the center <strong>of</strong> the action, the Bureau shall:<br />
i. Notify parents <strong>of</strong> the action against the center’s license or<br />
Certificate;<br />
ii. Advise parents <strong>of</strong> the center’s right to contest the action through an<br />
administrative hearing be<strong>for</strong>e the Office <strong>of</strong> Administrative Law;<br />
iii. In<strong>for</strong>m parents <strong>of</strong> the name, address and telephone number <strong>of</strong> the<br />
resource and referral services <strong>of</strong>fered by the appropriate State-contracted Unified<br />
Child Care Agency <strong>for</strong> assistance in finding alternative <strong>child</strong> <strong>care</strong> arrangements, if<br />
necessary; and<br />
iv. Notify the appropriate State-contracted Unified Child Care Agency<br />
<strong>of</strong> the action.<br />
10:<strong>122</strong>-2.5 Administrative hearings<br />
GEN (a) Be<strong>for</strong>e the Bureau's decision to deny an application or suspend, refuse to<br />
renew or revoke a center's license or Certificate <strong>of</strong> Life/Safety Approval becomes<br />
effective, the Bureau shall af<strong>for</strong>d the center an opportunity to request an<br />
administrative hearing, pursuant to the Administrative Procedure Act, N.J.S.A.<br />
52:14B-1 et seq., and the Uni<strong>for</strong>m Administrative Procedure Rules, N.J.A.C. 1:1.<br />
(b) As long as the Division determines that the <strong>child</strong>ren are not at risk and no<br />
serious or imminent hazards exist, the Bureau may permit a center that has requested<br />
an administrative hearing, as specified in (a) above, to continue to operate until a final<br />
decision is rendered as a result <strong>of</strong> the hearing.<br />
10:<strong>122</strong>-2.6 Complaints<br />
GEN (a) Whenever the Bureau receives a report questioning the licensing status <strong>of</strong> a<br />
program or center or alleging that a licensed center is violating provisions <strong>of</strong> this<br />
<strong>manual</strong>, the Bureau shall ensure that the allegation is promptly investigated to<br />
determine whether the complaint is substantiated.
