10:<strong>122</strong>-9.5 Vehicle-related safety practices<br />
4. The vehicle owner possesses vehicle liability insurance at least at the<br />
minimum amounts required by New Jersey State insurance law, pursuant to N.J.S.A.<br />
17:28-1.1a, or at least at the minimum amounts required by a state other than New<br />
Jersey in which the vehicle is legally registered;<br />
5. The center maintains transportation records on each vehicle, as specified in<br />
N.J.A.C. 10:<strong>122</strong>-9.7(b); and<br />
6. The center ensures that the driver and/or additional adults apply the safety<br />
practices, as specified in N.J.A.C. 10:<strong>122</strong>-9.5(a) through (d) and (g) through (m).<br />
SA (g) For school-age <strong>child</strong> <strong>care</strong> programs, the center may use an autobus under<br />
the jurisdiction <strong>of</strong> the Department <strong>of</strong> Transportation when chartered <strong>for</strong> scheduled<br />
center field trips, outings or special events, provided that the driver and/or additional<br />
adults apply the safety practices, as specified in N.J.A.C. 10:<strong>122</strong>-9.5(a) through (e),<br />
(h), and (j) through (m).<br />
GEN (h) A center that provides or arranges transportation <strong>for</strong> physically disabled<br />
non-ambulatory <strong>child</strong>ren shall meet the additional vehicle <strong>requirements</strong> specified by<br />
the MVC.<br />
10:<strong>122</strong>-9.4 Driver licensing <strong>requirements</strong><br />
GEN (a) If a center uses a Type I School Bus, Type II School Bus or Type S School<br />
Vehicle, the center shall:<br />
1. Meet all applicable rules <strong>of</strong> the Motor Vehicle Commission (MVC),<br />
Department <strong>of</strong> Education and/or Department <strong>of</strong> Human Services;<br />
2. Ensure that each driver <strong>of</strong> such a vehicle possesses a valid Commercial<br />
Driver License (CDL) in at least Class B or Class C, with a passenger endorsement,<br />
as required by the MVC <strong>for</strong> the gross vehicle weight rating (GVWR) <strong>of</strong> the vehicle,<br />
or an out-<strong>of</strong>-State equivalent license, as approved by the MVC; and<br />
3. Submit a list <strong>of</strong> all drivers to the MVC when the vehicle is inspected by the<br />
MVC.<br />
10:<strong>122</strong>-9.5 Vehicle-related safety practices<br />
GEN (a) Children shall never be left unattended in a vehicle.<br />
(b) Children shall be accepted and discharged from the curbside <strong>of</strong> the vehicle.<br />
(c) The interior and exterior <strong>of</strong> each vehicle shall be maintained in clean and safe<br />
condition, with clear passage to operable doors.<br />
(d) All vehicles that are utilized to transport <strong>child</strong>ren shall be equipped with car<br />
seats (<strong>child</strong> passenger restraint systems) and/or booster seats that meet Federal motor<br />
vehicle safety standards, as appropriate <strong>for</strong> the age and weight <strong>of</strong> the <strong>child</strong>ren
