10:<strong>122</strong>-5.2 Physical plant <strong>requirements</strong> <strong>for</strong> all <strong>centers</strong><br />
playgrounds operated by any governmental entity, nonpr<strong>of</strong>it entity or private <strong>for</strong>pr<strong>of</strong>it<br />
entity to meet the specifications <strong>for</strong> resilient surfacing and all other elements set<br />
<strong>for</strong>th in the Handbook <strong>for</strong> Public Playground Safety <strong>of</strong> the United States Consumer<br />
Product Safety Commission (CPSC).<br />
i. Centers that use an on-site playground constructed on or be<strong>for</strong>e April 18,<br />
2000 shall comply with the following time limits <strong>for</strong> upgrading playground surfacing<br />
and other elements, as specified by N.J.A.C. 5:23-11.4:<br />
(1) The center shall ensure that resilient playground surfacing that<br />
complies with the Playground Safety Subcode is installed by October 18, 2004;<br />
(2) Each center operated by a governmental entity or a private <strong>for</strong>-pr<strong>of</strong>it<br />
entity shall ensure that all playground elements other than surfacing comply with the<br />
Playground Safety Subcode by October 18, 2007; and<br />
(3) Each center operated by a nonpr<strong>of</strong>it entity shall ensure that all<br />
playground elements other than surfacing comply with the Playground Safety<br />
Subcode by October 18, 2014.<br />
ii. The center shall ensure that all newly constructed playgrounds and all<br />
new and replacement playground equipment comply with the Playground Safety<br />
Subcode upon installation.<br />
iii. Centers that take <strong>child</strong>ren to a community playground shall ensure that<br />
the playground surfacing and all other elements comply with the Playground Safety<br />
Subcode within the applicable time limits be<strong>for</strong>e being used by the <strong>child</strong>ren.<br />
(c) Lighting <strong>requirements</strong> are as follows:<br />
1. All fluorescent tubes and incandescent light bulbs shall have protective<br />
covers or shields.<br />
2. During program activities, at least 20 foot-candles <strong>of</strong> natural or artificial<br />
light shall be provided in all rooms used by the <strong>child</strong>ren. This illumination shall be<br />
measured three feet above the floor at the farthest point from the light source.<br />
3. Parking areas, pedestrian walkways, or other exterior portions <strong>of</strong> the<br />
premises subject to use by center occupants at night shall be illuminated to provide<br />
safe entrance to and egress from the center.<br />
(d) Heating <strong>requirements</strong> are as follows:<br />
1. A minimum temperature <strong>of</strong> 68 degrees Fahrenheit shall be maintained in all<br />
rooms used by the <strong>child</strong>ren.<br />
2. Steam and hot water pipes, radiators, and electrical space heaters shall be<br />
protected by screens, guards, insulation or any other suitable, non-combustible<br />
protective device.<br />
3. The center shall not use portable liquid fuel-burning or wood-burning<br />
heating appliances.<br />
(e) All floor and window fans that are accessible to the <strong>child</strong>ren shall have a<br />
grille, screen, mesh or other protective covering.<br />
(f) Toilet facility <strong>requirements</strong> are as follows:<br />
1. A supply <strong>of</strong> soap, toilet paper, and individual hand towels or disposable<br />
paper towels shall be provided.
