SUBCHAPTER 9. TRANSPORTATION REQUIREMENTS<br />
10:<strong>122</strong>-9.1 Scope<br />
GEN (a) The provisions <strong>of</strong> this sub<strong>chapter</strong> shall apply to:<br />
1. Each center that provides or arranges <strong>for</strong> the provision <strong>of</strong> transportation <strong>for</strong><br />
<strong>child</strong>ren:<br />
i. To or from their homes or other prearranged sites and the center;<br />
and/or<br />
ii. In connection with an activity (such as a field trip) conducted by or<br />
through the auspices <strong>of</strong> the center; and<br />
2. Each person or agency other than the center that provides or arranges <strong>for</strong><br />
the provision <strong>of</strong> transportation <strong>for</strong> compensation <strong>for</strong> <strong>child</strong>ren to or from their homes<br />
and a center.<br />
(b) Each center, person or agency, as defined in (a) above, also shall comply with<br />
applicable provisions <strong>of</strong> New Jersey Motor Vehicle Commission (MVC) law,<br />
pursuant to N.J.S.A. 39:1-1 et seq., and the rules promulgated thereunder, as specified<br />
in N.J.A.C. 13.<br />
10:<strong>122</strong>-9.2 Vehicle definitions<br />
GEN (a) A Type I School Bus means a bus with a capacity <strong>of</strong> 17 to 54 passengers, as<br />
indicated by the vehicle manufacturer, which has been painted in the color <strong>of</strong> uni<strong>for</strong>m<br />
national school bus yellow, and is required by the Motor Vehicle Commission (MVC)<br />
to have New Jersey school vehicle Type I, "S1" designated license plates.<br />
(b) A Type II School Bus means a bus with a capacity <strong>of</strong> 10 to 16 passengers, as<br />
indicated by the vehicle manufacturer, which has been painted in the color <strong>of</strong> uni<strong>for</strong>m<br />
national school bus yellow if the bus was manufactured after April 1, 1977, and is<br />
required by the MVC to have New Jersey school vehicle Type II, "S2" designated<br />
license plates.<br />
(c) A Type S School Vehicle means a vehicle with a capacity <strong>of</strong> nine or fewer<br />
passengers, as indicated by the vehicle manufacturer, and a gross vehicle weight<br />
rating <strong>of</strong> 3,000 pounds or more, which is required by the MVC to have New Jersey<br />
school vehicle Type II, "S2" designated license plates.<br />
