(c) The defendant has his habitual residence, or has his principal place<br />

<strong>of</strong> business.<br />

2. Each C<strong>on</strong>tracting Party shall ensure that its courts possess <strong>the</strong><br />

necessary competence to entertain such claims for compensati<strong>on</strong>.<br />

ARTICLE 18<br />

Related acti<strong>on</strong>s<br />

1. Where related acti<strong>on</strong>s are brought in <strong>the</strong> courts <strong>of</strong> different Parties, any<br />

court o<strong>the</strong>r than <strong>the</strong> court first seized may, while <strong>the</strong> acti<strong>on</strong>s are pending at<br />

first instance, stay its proceedings.<br />

2. A court may, <strong>on</strong> <strong>the</strong> applicati<strong>on</strong> <strong>of</strong> <strong>on</strong>e <strong>of</strong> <strong>the</strong> Parties, decline jurisdicti<strong>on</strong><br />

if <strong>the</strong> law <strong>of</strong> that court permits <strong>the</strong> c<strong>on</strong>solidati<strong>on</strong> <strong>of</strong> related acti<strong>on</strong>s and<br />

ano<strong>the</strong>r court has jurisdicti<strong>on</strong> over both acti<strong>on</strong>s.<br />

3. For <strong>the</strong> purpose <strong>of</strong> this Article, acti<strong>on</strong>s are deemed to be related where<br />

<strong>the</strong>y are so closely c<strong>on</strong>nected that it is expedient to hear and determine<br />

<strong>the</strong>m toge<strong>the</strong>r to avoid <strong>the</strong> risk <strong>of</strong> irrec<strong>on</strong>cilable judgements resulting<br />

from separate proceedings.<br />

ARTICLE 19<br />

Applicable law<br />

All matters <strong>of</strong> substance or procedure regarding claims before <strong>the</strong><br />

competent court which are not specifically regulated in <strong>the</strong> Protocol<br />

shall be governed by <strong>the</strong> law <strong>of</strong> that court including any rules <strong>of</strong> such law<br />

relating to c<strong>on</strong>flict <strong>of</strong> laws.<br />
