C<strong>on</strong>vinced that States should take measures for <strong>the</strong> proper exchange<br />

<strong>of</strong> informati<strong>on</strong> <strong>on</strong> and c<strong>on</strong>trol <strong>of</strong> <strong>the</strong> transboundary movement <strong>of</strong><br />

hazardous wastes and o<strong>the</strong>r wastes from and to those States,<br />

Noting that a number <strong>of</strong> internati<strong>on</strong>al and regi<strong>on</strong>al agreements have<br />

addressed <strong>the</strong> issue <strong>of</strong> protecti<strong>on</strong> and preservati<strong>on</strong> <strong>of</strong> <strong>the</strong> envir<strong>on</strong>ment<br />

with regard to <strong>the</strong> transit <strong>of</strong> dangerous goods,<br />

Taking into account <strong>the</strong> Declarati<strong>on</strong> <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s C<strong>on</strong>ference<br />

<strong>on</strong> <strong>the</strong> Human Envir<strong>on</strong>ment (Stockholm, 1972), <strong>the</strong> Cairo Guidelines and<br />

Principles for <strong>the</strong> Envir<strong>on</strong>mentally Sound Management <strong>of</strong> Hazardous<br />

Wastes adopted by <strong>the</strong> Governing Council <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s<br />

Envir<strong>on</strong>ment Programme (UNEP) by decisi<strong>on</strong> 14/30 <strong>of</strong> 17 June 1987,<br />

<strong>the</strong> Recommendati<strong>on</strong>s <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s Committee <strong>of</strong> Experts <strong>on</strong><br />

<strong>the</strong> Transport <strong>of</strong> Dangerous Goods (formulated in 1957 and updated<br />

biennially), relevant recommendati<strong>on</strong>s, declarati<strong>on</strong>s, instruments and<br />

regulati<strong>on</strong>s adopted within <strong>the</strong> United Nati<strong>on</strong>s system and <strong>the</strong> work and<br />

studies d<strong>on</strong>e within o<strong>the</strong>r internati<strong>on</strong>al and regi<strong>on</strong>al organizati<strong>on</strong>s,<br />

Mindful <strong>of</strong> <strong>the</strong> spirit, principles, aims and functi<strong>on</strong>s <strong>of</strong> <strong>the</strong> World<br />

Charter for Nature adopted by <strong>the</strong> General Assembly <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s<br />

at its thirty-seventh sessi<strong>on</strong> (1982) as <strong>the</strong> rule <strong>of</strong> ethics in respect <strong>of</strong> <strong>the</strong><br />

protecti<strong>on</strong> <strong>of</strong> <strong>the</strong> human envir<strong>on</strong>ment and <strong>the</strong> c<strong>on</strong>servati<strong>on</strong> <strong>of</strong> natural<br />

resources,<br />

Affirming that States are resp<strong>on</strong>sible for <strong>the</strong> fulfilment <strong>of</strong> <strong>the</strong>ir<br />

internati<strong>on</strong>al obligati<strong>on</strong>s c<strong>on</strong>cerning <strong>the</strong> protecti<strong>on</strong> <strong>of</strong> human health<br />

and protecti<strong>on</strong> and preservati<strong>on</strong> <strong>of</strong> <strong>the</strong> envir<strong>on</strong>ment, and are liable in<br />

accordance with internati<strong>on</strong>al law,<br />
