ARTICLE 20<br />

Relati<strong>on</strong> between <strong>the</strong> Protocol and <strong>the</strong> law <strong>of</strong> <strong>the</strong> competent court<br />

1. Subject to paragraph 2, nothing in <strong>the</strong> Protocol shall be c<strong>on</strong>strued<br />

as limiting or derogating from any rights <strong>of</strong> pers<strong>on</strong>s who have suffered<br />

damage, or as limiting <strong>the</strong> protecti<strong>on</strong> or reinstatement <strong>of</strong> <strong>the</strong> envir<strong>on</strong>ment<br />

which may be provided under domestic law.<br />

2. No claims for compensati<strong>on</strong> for damage based <strong>on</strong> <strong>the</strong> strict liability<br />

<strong>of</strong> <strong>the</strong> notifier or <strong>the</strong> exporter liable under Article 4, paragraph 1, or <strong>the</strong><br />

importer liable under Article 4, paragraph 2, <strong>of</strong> <strong>the</strong> Protocol, shall be<br />

made o<strong>the</strong>rwise than in accordance with <strong>the</strong> Protocol.<br />

ARTICLE 21<br />

Mutual recogniti<strong>on</strong> and enforcement <strong>of</strong> judgements<br />

1. Any judgement <strong>of</strong> a court having jurisdicti<strong>on</strong> in accordance with<br />

Article 17 <strong>of</strong> <strong>the</strong> Protocol, which is enforceable in <strong>the</strong> State <strong>of</strong> origin and is<br />

no l<strong>on</strong>ger subject to ordinary forms <strong>of</strong> review, shall be recognized in any<br />

C<strong>on</strong>tracting Party as so<strong>on</strong> as <strong>the</strong> formalities required in that Party have<br />

been completed, except:<br />

(a) Where <strong>the</strong> judgement was obtained by fraud;<br />

(b) Where <strong>the</strong> defendant was not given reas<strong>on</strong>able notice and a fair<br />

opportunity to present his case;<br />

(c) Where <strong>the</strong> judgement is irrec<strong>on</strong>cilable with an earlier judgement<br />

validly pr<strong>on</strong>ounced in ano<strong>the</strong>r C<strong>on</strong>tracting Party with regard to<br />

<strong>the</strong> same cause <strong>of</strong> acti<strong>on</strong> and <strong>the</strong> same parties; or
