State’s Rebuttal Evidence<br />
John Russell, Piatt County Sheriff’s Deputy, spoke to Florence Keller<br />
sometime after Karyn Slover’s body had been discovered. (Vol. LXXIV, R. 36)<br />
Keller told Russell that she had heard a total <strong>of</strong> four popping noises from a<br />
wooded area near her residence in Cerro Gordo. (Vol. LXXIV, R. 37) She made no<br />
mention <strong>of</strong> seeing anyone coming out <strong>of</strong> the woods following the noises. (Vol.<br />
LXXIV, R. 37) Russell purposely did not specifically ask Keller if she had heard<br />
gun shots or seen any unusual men. (Vol. LXXIV, R. 38-40)<br />
On October 14, 1996, Charles Dunlap spoke to Florence Keller. She<br />
described four gun shots she had heard with the first two being close together and<br />
the last two spaced evenly. (Vol. LXXIV, R. 42) Keller did not tell Dunlap about<br />
seeing two men coming from the woods, nor did Dunlap ask about any men. (Vol.<br />
LXXIV, R. 43)<br />
September 28, 1996<br />
Mike Mannix interviewed David Swann on May 17, 2000, at the Macon<br />
County State’s Attorney’s <strong>of</strong>fice regarding voice mails. Swann had told Mannix<br />
that on September 28, 1996, he had deleted five voice mails from his cell phone<br />
that were from Karyn Slover. (Vol. LXX, R. 120)<br />
Junior’s Whereabouts on September 28<br />
State’s Case-in-Chief<br />
The State <strong>of</strong>fered no evidence as to Junior’s whereabouts on September 28,<br />
1996. There were four phone calls placed from the residence <strong>of</strong> Junior and Trina<br />
to the residence <strong>of</strong> Senior and Jeanette at 3:14 p.m.; 5:00 p.m.; 6:00 p.m.; and<br />
9:25 p.m. – the duration <strong>of</strong> which were unknown.<br />
