36. Miscellaneous leave with and without pay<br />

36.1. The Secretary may approve miscellaneous leave with or without pay for a purpose not<br />

provided for elsewhere in this <strong>Agreement</strong>. The intention <strong>of</strong> miscellaneous leave is to provide<br />

flexibility to managers and employees by providing leave that may be made available, either<br />

with or without pay, for a variety <strong>of</strong> purposes. Leave may be granted by the Secretary,<br />

having regard to the operational needs <strong>of</strong> the <strong>Department</strong>, including for purposes that the<br />

Secretary considers to be in the interests <strong>of</strong> the <strong>Department</strong>.<br />

36.2. Miscellaneous leave to count as service with pay may be granted as follows but is not limited<br />

to:<br />

o enable employees to attend to consequences <strong>of</strong> natural disasters that affects them.<br />

Leave may be up to five days for each occurrence;<br />

o for recognised ceremonial purposes, cultural or NAIDOC activities, leave <strong>of</strong> up to five<br />

days may be granted each calendar year;<br />

o participate in culturally significant events;<br />

o attendance at industrial proceedings when summonsed as a witness;<br />

o to attend for jury service, for the period(s) required. An employee who is on<br />

miscellaneous leave with pay to undertake jury service is not eligible to receive<br />

juror’s fees;<br />

o To enable employee to undertake charity or community work. Employees may take<br />

up to one day per year for such purposes;<br />

o donate blood, for the period required;<br />

o participate in recognised international sporting events, as a competitor or <strong>of</strong>ficial,<br />

for the period required;<br />

o move house, up to one day per calendar year;<br />

o to enable an employee to attend their graduation ceremony, for up to one day; and<br />

o to enable an employee to attend their citizenship conferring ceremony, for up to<br />

one day.<br />

36.3. Miscellaneous leave without pay may be granted by the Secretary in, but not limited to, the<br />

following circumstances:<br />

o study purposes;<br />

o accompanying a partner on a posting;<br />

o non APS employment in the interests <strong>of</strong> the Commonwealth; and<br />

o leave for personal reasons.<br />

36.4. Miscellaneous leave without pay will not count for service for any purpose with the<br />

following exceptions:<br />

o leave for study purposes; and<br />

o leave for non APS employment which is in the interests <strong>of</strong> the Commonwealth.<br />

36.5. In order for absence on other leave without pay to count as service for personal and long<br />

service leave, the employee must resume duty with DCCEE at or before the expiration <strong>of</strong> the<br />

leave.<br />
