86. Retention period – early termination<br />

86.1. Where the Secretary is satisfied that there is insufficient productive work available for the<br />

employee within the <strong>Department</strong> during the remainder <strong>of</strong> the retention period and that<br />

there is no reasonable redeployment prospects in the APS, the Secretary, with the<br />

agreement <strong>of</strong> the employee terminate the employee’s employment under s.29 <strong>of</strong> the Public<br />

Service Act 1999 ; and upon termination, the employee will be paid a lump sum comprising:<br />

o the balance <strong>of</strong> the retention period (as shortened for the National Employment<br />

Standards under sub-clause 92.2) and this payment will be taken to include the<br />

payment in lieu <strong>of</strong> notice <strong>of</strong> termination <strong>of</strong> employment, plus<br />

o the employee’s NES entitlement to redundancy pay.<br />

87. Involuntary termination <strong>of</strong> employment at the conclusion <strong>of</strong> the retention<br />

period<br />

87.1. In accordance with s.29 <strong>of</strong> the Public Service Act 1999 , the Secretary may involuntarily<br />

terminate the employment <strong>of</strong> an excess employee at the end <strong>of</strong> the retention period.<br />

87.2. An excess employee’s employment will not be involuntarily terminated without being given<br />

notice <strong>of</strong> termination under clause 90. Wherever possible, this notice period will be<br />

concurrent with the retention period.<br />

87.3. An excess employee’s employment will not be involuntarily terminated if the employee has<br />

not been invited to elect for retrenchment with the payment <strong>of</strong> a redundancy benefit or has<br />

elected for retrenchment but the Secretary has refused to approve it.<br />
