into an allocation formula to avoid disputes<br />

on what constitutes appropriate testing of<br />

wells. You may propose an allocation<br />

formula other than the commonly used one;<br />

however, you should offer detailed<br />

justification as to why the ERCB should<br />

deviate from its consistent practice in<br />

determining an allocation formula.<br />

15) If you are requesting, pursuant to Section<br />

53(5)(b) of the OGCA, that the ERCB, in<br />

order to give effect to the common processor<br />

declaration, direct the total amount of gas to<br />

be processed by the common processor from<br />

the pool or pools subject to the common<br />

processor declaration,<br />

a) a statement of why you believe such a<br />

total volume should be set,<br />

b) a discussion and documentation<br />

indicating what negotiations were carried<br />

out in regard to the total amount of gas to<br />

be processed by the common processor<br />

from the pool or pools subject to the<br />

common processor declaration and where<br />

the impasse lies, and<br />

c) a statement of the total amount of gas<br />

you propose be processed by the<br />

common processor from the pool or<br />

pools subject to the common processor,<br />

together with a discussion of how the<br />

volume was determined.<br />

16) If you are requesting, pursuant to Section 56<br />

of the OGCA, that the proposed order be<br />

effective prior to the date the order is issued<br />

but not prior to the date the application for<br />

the order was made to the ERCB, a<br />

discussion as to why the order should be<br />

effective on the requested date, including<br />

above the minimum rate. If a well falls below<br />

the minimum rate, other wells are restricted<br />

only to their minimum rates and not below.<br />
