Evidence rules to be changed
PNP objects, questions motives of gov’t
With criminal charges of former government officials
expected soon, the Attorney General is proposing
to change Turks and Caicos Islands law regarding
hearsay and documentary evidence.
On Oct. 18, members of the TCI Bar Association
were given seven days to comment on a bill which
is nearly identical to current U.K. criminal law on
hearsay and documentary evidence.
Several lawyers have criticized the brief consultation
period for such important changes in laws.
“This bill sets out the rules which allow evidence
other than first-hand evidence to be given in criminal
proceedings,” says an explanatory memorandum
in the draft bill. “The two main categories are
hearsay evidence and documentary evidence, but
within those categories there are various types of
evidence, including evidence given by signs, video
camera evidence and so on.”
His Excellency the Gov. Ric Todd said the AG
is consulting the Bar about “changing the laws of
evidence. It is not about allowing hearsay to be accepted.
It is simply allowing courts to hear more evidence
without unnecessary difficulties.
“But this is quite a serious consultation, and I will
be dismayed if people try to portray this as being
somehow directed against the interests or liberties
The Turks and Caicos Islands
desperately need a halfway house
to help non-violent drug offenders
and those released from prison
and drug treatment integrate
successfully back into jobs, families
and society to prevent them
from committing crimes and going
to prison, the Providenciales
Chamber of Commerce was told
at its meeting Oct. 17.
The plea came from several
members of a panel speaking on
the rising drug problem in the
country and its relationship to
crime.
Rev. John Malcolm, director of
the National Drug Unit, said past
studies in the TCI have shown
that 71 percent of offenders had
substance abuse problems from
both drugs and alcohol. He gave
some startling statistics about
young people interviewed in secondary
schools:
▶ 74 percent had experimented
with alcohol at least once
▶ 46 percent were regular users
of alcohol
▶ 26 percent had experimented
with marijuana at least once
▶ 14 percent were regular users
of marijuana
The findings go hand in hand
with increased improper behavior
in schools and crimes committed
by young people, Malcolm
said.
“Many of the students that
we worked with in secondary
schools are now persons that
we’re seeing in prison,” Malcolm
said.
“I’m convinced that the recent
increase in criminal activity in
the TCI is a direct result of the
increase of substance abuse,” he
said.
“We have spent thousands of
dollars sending persons off to
overseas rehabilitation centers,
and what we’ve discovered is
that when these persons come
back, they endeavor to do well,
but there is no re-entry program,
there is no reintegration program
… and so many of them
end up back in the same neigh-
of individuals. But it’s not. It’s all about achieving
the most effective possible justice system.”
The Progressive National Party (PNP) issued a
press statement Oct. 19 alleging that the changes are
specifically aimed at aiding cases being made by the
Special Investigation and Prosecution Team, which
the PNP suggests may have sought the changes.
“The draft bill is unwarranted and represents an
attempt by this administration to further erode an
accused person’s rights to a fair trial in these islands
and will deny accused persons of the protections
previously afforded under our laws,” the PNP statement
says.
Attorney General Huw Shepheard told the fp that
the bill has come up now in the course of his office’s
capacity for law drafting.
“Legislation allowing hearsay evidence to be given
is not designed to secure convictions against particular
individuals,” Shepheard said. “It is a statute of
general application that is intended to improve the
administration of criminal justice in the islands.”
“No one will be prosecuted on the basis of hearsay
evidence alone, but allowing hearsay evidence to be
given will, amongst other things, protect witnesses
from intimidation by enabling written statements
to be given if a witness is too frightened to come to
court,” he said.
The attorney general said he is keen to bring the
bill before the governor’s Advisory Council and the
Consultative Forum as quickly as possible, “given
that there is a considerable body of other legislation
Chamber hears plea for halfway house
borhoods or in a volatile family
environment that causes them to
go back to their old habits.”
A halfway house would help
those returning from treatment
and being released from prison
to go straight and become productive
members of society.
The country also needs an
alternative sentencing program
for first-time drug offenders
with non-violent backgrounds
so that they aren’t put in prison
with hardened criminals. They
to could be sent to the halfway
house where they could receive
counseling, and job training and
placement.
In 2006 the government gave
10 acres of land and $450,000 towards
the halfway house project,
which had planning approval but
was abandoned because of the
economic downturn. The Drug
Prevention Foundation took
over fundraising and has come
Noreane Lightbourne
named 2011 Unsung Hero
Special needs activist
and South Caicos resident
Noreane Lightbourne has
been named the 2011 Unsung
Hero by CIBC FirstCaribbean
International Bank.
Lightbourne thanked CIBC
FirstCaribbean for the volunteerism
award and assured
the bank that the $6,000
prize would go towards her
many projects throughout
the community.
“Ms. Lightbourne has made
a significant mark throughout
the TCI and has played
an instrumental role in the
development of the Wellness
Centre of South Caicos’ Special
Needs Programme and
has also been part of establishing
the Concerned Citizens
of South Caicos movement,”
said Sherma Hercules,
the bank’s country manager.
“Our research has shown
that Ms. Lightbourne never
hesitates to invest physically
or financially and always
gives her services voluntarily
when it comes to projects
that involve the community
of South Caicos.”
“Due to lack of funding
after a few years of being in
operation, Ms. Lightbourne
pushed for the government of
the Turks and Caicos Islands
to take over the management
of the Wellness Centre, in
order to continue fighting
for the cause. To date, (government)
finances the daily
operations and Ms. Lightbourne
continues to manage
and execute the many tasks.”
Hercules noted that Lightbourne’s
award was the first
to a resident outside Providenciales
since the awards
were begun in 2004 in the
Turks and Caicos Islands.
“We are truly honoured to
be here on South Caicos and
are very excited to recognise
and honour a very deserving
individual as our 2011 Unsung
Hero,” Hercules said.
“CIBC FirstCaribbean’s Unsung
Heroes’ programme
has without a doubt made
its mark here in the TCI and
throughout the Caribbean as
the flagship of volunteerism.”

Government proposes
changing hearsay rules
hearsay from page 1
to be considered in order to meet
the milestones for the return to
elected government”. He said it
is part of his effort for a complete
codification of all criminal law
and a uniform system of criminal
procedure for all courts, work
that is funded by the U.K.“When
I took up my appointment, I was
dismayed to learn that the criminal
law of the islands had not (save
for some few areas) been kept up
to date for very many years, and
my chambers have been working
hard to introduce much-needed
reforms,” Shepheard said.
Most of the Criminal Justice
(Hearsay And Documentary
Evidence) Bill [2011] is based on
current U.K. law enacted in 2003,
but it also includes provisions
that are current practice in TCI
courts.
The proposed bill says hearsay
evidence is admissable if it is
contained in public documents
or published works dealing with
matters of a public nature, which
is allowed under current law.
It also allows hearsay evidence
if all parties in the case agree, or
if a judge is “satisfied that it is in
the interests of justice for it to be
admissible.”
Earlier this year, the TCI Constitution
was revised to allow for
criminal trials without juries in
the Supreme Court, which is also
the case in the U.K.
A law setting out the conditions
for non-jury trials says
prosecutors, defendants or judges
can make the request on several
different grounds, and a judge’s
decision on the request can be
appealed to a three-member
court of appeal.
The chief financial officer of
the National Health Insurance
Board has tendered her resignation
effective Nov. 14.
“Although this was a difficult
decision, it was done as a matter
of principle and taken in the best
interest of the people of the Turks
and Caicos Islands, while at the
same time safeguarding and
protecting my integrity and professional
reputation as a Certified
Public Accountant,” Desiree
James said in a press release. She
did not elaborate.
Her announcement of her departure
after 2½ years helping set
up and administer the National
Health Insurance Plan (NHIP)
comes during the same week
that the interim government announced
that the country’s health
care system is unaffordable and
RIChARd GREEN/STAFF
What started as a one-man protest on the morning of Oct.
19 grew into a small crowd of people holding signs objecting
to policies of the interim government and demanding the
governor’s Advisory Council be abolished.
Dr. Rufus Ewing, director of Medical Services for the Ministry
of Health and Human Services, and the group stood on
Leeward Highway at the road leading to a meeting of the
council. After the meeting, His Excellency the Gov. Ric Todd
stopped briefly on his way out to speak to Ewing.
Ewing has been outspoken on issues including public
service reform and the health care system, but he recently
announced his resignation effective in March so that he
could speak more freely on various important issues.
NHIB chief financial
officer James resigns
must be changed, including
changes in the NHIP.
“The NHIB has made tremendous
strides in its quest to provide
residents of the TCI with the best
health care possible,” James said.
“However, there is much left to be
done to ensure that this country
maintains a health care system
that is affordable to its residents.
“I wish to thank the government
of the TCI and the board of
directors of the NHIB for the opportunity
to have served as CFO
in particular and my country in
general. At the same time, I wish
to implore the NHIB and interim
administration to make decisions
that are totally in the best interest
of the health of the people of
the Turks and Caicos Islands, especially
during these economic
times.”
local
The proposed new Hearsay
Evidence Bill, if enacted, will
bring about a fundamental
change to the administration of
justice in these Islands. For the
first time it would allow a person
to be convicted on the basis of
hearsay evidence.
As the law now stands, a witness
can only give evidence of
what he or she saw but not what
someone else told him or her that
he or she saw. The reason why
such evidence is excluded is that
it is not reliable and can be easily
manufactured and often difficult
to assess. If a person who
states that he or she witness an
act is not called to give evidence,
it will be difficult to challenge
the statement of the person who
is merely reciting what he or she
has been told. A person should
not be convicted on this kind of
evidence.
The problems of hearsay evidence
have been identified in numerous
rulings. In Al -Khawaja v
UK and T v UK [2009] 49 EHRR1
the European Court of Human
Rights held that a conviction
based solely or to a decisive degree
on written statements made
by a person whom the defendant
has had no opportunity to examine
or have examined restricted
the rights of the defendant to a
degree that is incompatible with
the guarantees provided by a
right to a fair trial. This right is
enshrined in the TCI constitution.
Many at the TCI Bar would
accept that criminal procedures
should be reviewed from time
to time in a dispassionate and
informed way in a consultative
process. If the process is rushed,
however, it can result in grave
injustice. A consultation process
would normally be a matter of
months.
When the law changed in
hearsay from page 1
The idea is to raise enough
money to complete the halfway
house as planned or buy
a building to renovate and
repurpose.
Malcolm asked the chamber
to partner in an effort to
make the halfway house a reality,
but he understood that
it’s hard asking for money
during these tough economic
times. “But you need to recognize
that if left unchecked,
this thing is going to continue
to spiral out of control, and
we’re all going to be affected
by it,” Malcolm said.
▶ Chamber President Tina
Fenimore and Vice President
E. Jay Saunders pledged to
work with the Drug Unit to
find a way to make the halfway
house a reality.
Among other suggestions
from the panel were:
▶ More safe, supportive environments
are needed where
children can gather for recreation
and advice on how to stay
away from drugs and crime.
▶ Parents need to be more involved
with their children.
lETTER To THE EDIToR
Proposed change in hearsay law
the U.K. in 2003 it was after a
long consultation process and
when the law passed it did not
come into force for a number of
months so as to allow lawyers
and judges to become familiar
with it. This was to make sure
that mistakes were not made and
high standards would be maintained.
It is important that all
who take part in a trial process:
the judiciary, the prosecution
and the defence lawyers are fully
familiar with new legislation and
have been properly trained in its
implications.
The Criminal Justice Act 2003
was considered by many at the
English Bar to be rushed and
poorly drafted. An English High
Court Judge Lord Justice Rose
probably put it best in a judgement
in 2005:
“So, yet again, the courts are
faced with a sample of the deeply
confusing provisions of the Criminal
Justice Act 2003, and the satellite
statutory instruments to
which it is giving stuttering birth.
The most inviting course for this
Court to follow, would be for its
members, having shaken their
heads in despair, to hold up their
hands and say: “the Holy Grail of
rational interpretation is impossible
to find”. But it is not for us to
desert our judicial duty, however
lamentably others have legislated.
But, we find little comfort or assistance
in the historic canons of
construction for determining the
will of Parliament which were
fashioned in a more leisurely age
and at a time when elegance and
clarity of thought and language
were to be found in legislation
as a matter of course rather than
exception.” (Crown Prosecution
Service (Applicant) v. South East
Surrey Youth Court (Respondent)
and Milad Leon GHAN-
The TCI Bar has been given
Chamber hears plea for halfway
house drug treatment
▶ People in the community
need to trust the police and to
report drug activity and other
crimes when they see them.
Prison Superintendent Ian
Sargent said part of his mission
is making sure that drugs
don’t find their way into Her
Majesty’s Prison on Grand
Turk. While in prison, inmates
can get drug counseling
and job training, but he
said that a drug court that
specifically deals with firsttime
drug offenders could
help fight the problem.
New Supreme Court Justice
Margaret Ramsay-Hale was
instrumental in working on
creating drug courts in the
Cayman Islands where she
formerly served as chief magistrate.
Police Deputy Commissioner
Brad Sullivan said his
job is not only to catch those
with drugs but to work with
other agencies to stop the
flow of drugs into the country.
The problem is that with
so many islands, the country
has a “porous border” that
is difficult to defend against
traffickers.
f
p
a week for consultation on the
new proposed ordinance which
is wholly inadequate. The timing
would suggest that it is being
brought in specifically for the
upcoming SIPT prosecution. To
change the fundamentals of a
criminal justice system in order
to help secure a number of specific
convictions doe not seem
the best basis for a legislative system
or a criminal justice system.
That is not to say that everything
in the proposed legislation
is all bad - it is not. For an elderly
witness who might have given a
statement to the police and then
deceased; with the right safeguards
it might well assist justice
to be done.
The real concern is that the
Hearsay Ordinance is the ‘tip of
the iceberg’ and that it will be the
first of several new laws designed
to make prosecutions of individuals
easier and taking away hard
won liberties that protect the innocent
as well as the guilty. The
problem with giving away hard
won liberties is that they are very
hard to get back.
It is much better to consider
new legislation ‘at leisure and
with clarity’ and make sure it is
fit for purpose before bringing
it into law; rather than rush it in
for a short term goal and then
get unsafe convictions which
will lead to guilty defendants
being released on appeal as they
received unfair trials.
The Turks and Caicos Islands interim government has
announced that the present health care system is no longer
The government is seeking public comment on the following
questions until Oct. 31:
1. Should the government aim to renegotiate the contract
with Interhealth Canada Ltd.?
2. Should the present National health Insurance Program
(NhIP) financial imbalance be addressed by increasing contribution
rates, or reducing benefits, or both?
3. Should NhIP contributors with dependants pay higher
contributions than those without dependants, if they can afford
4. Should co-payments on pharmaceuticals, dental and optical
care be increased for those that can afford them?
5. Should co-payments be introduced for all health care
TCI tennis youth
serve up big wins
Youth tennis is heating up in
the TCI as children of all ages
warm up for a lifelong love of the
game.
Over the Oct. 14-16 weekend,
the Graceway Sports Center
hosted a juniors singles and doubles
tournament that showcased
some of the finest tennis talent
in the nation. Players as young
as eight aced their competition
in the most competitive tournament
the center has seen to date.
“The tennis level was incredible,”
says Graceway Sports Center
tennis coach Reinaldo Garcia.
“We are so happy to see so many
great young players getting more
and more involved in the sport.”
The three-day event saw 26
players playing a total of 134
matches, vying for titles in five
categories.
For the first time, the tournament
included a beginner minitennis
category where Tal Levy
placed first ahead of second place
Myles Cox.
“We are so excited to see more
and more kids joining the tournament,”
Garcia said. “We encourage
them to participate for
the experience and fun, but also
to give them motivation to continue
to practice and improve.”
The competition was tremendous
in all categories, including
the up to 11-year-olds, where
Cole Nickson placed first and
Matthew Danics landed in second
place.
Rodrigo Vazquez edged ahead
of Ben Levy for the first place
trophy in the up to 13-year-old
class. In the 15-year-old category,
the champion was Elijah Delancy,
sponsored by The Hartling
Group, and second place went to
Tristan Greene.
Raul Vazquez took home a first
place trophy in the up to 17-yearolds,
with second place going to
Gievelli Williams.
The champions in the junior
doubles were Rodrigo Vazquez
and Tristan Greene, who defeated
Elijah Delancy and Chemar
Millington.
“I want to thank Amanyara for
sponsoring the mini-tennis and
the Hartling Group who sponsor
Elijah Delancy in the Provo Elite
tennis team,” Garcia said.
The Provo Elite Tennis team
was created by Garcia, who selected
the group of eight youths
with a high potential in the sport.
The group trains several times
per week in hopes of representing
the TCI in International Competitions.
The team training is possible
thanks to sponsors PTS Equipment,
AIB, Turquoise Construction
Company Ltd. and Yoshi’s
Sushi Bar.
26 youth players participated in the Juniors tournament.
DECR hosts Migratory
Bird Day observance
Students and volunteers recently
joined the Department
of Environment and Coast Resources
and the Society for Conservation
and Study of Caribbean
Birds in observing International
Migratory Bird Day.
Groups of students and teachers
assembled Oct. 14 at the Bight
Park on Providenciales and visited
wetlands to see migratory and
resident birds with binoculars
provided by SCSCB.
While bird watching, they
also collected seeds to be dried,
cleaned and later sent to the
U.K.’s Royal Botanic Garden
Kew Millennium Seed Bank for
storage. Many of the native plants
grown in the nursery are important
food and habitat plants for
birds.
On Oct. 15, people including
members of the TCI Environmental
Club (TCIEC) met at the
Bight Park to conduct bird monitoring
and seed collection activities.
To further give impetus to
the No-Single-Use Plastic Bag
Campaign which was supported
by the TCIEC during the Environment
Day in June, TCIEC
hosted a picnic at the park after
the bird monitoring and seed collection.
A certain percentage of the total
seed collection stock will be
sown at the DECR’s Native Plant
Nursery to be planted in selected
sites such as the Botanical Gardens
or on school premises.
A consultant for the Pan American Health Organization
and World Health Organization recently
visited the Turks and Caicos Islands to review
and advise the country on its programme to
control mosquitos and mosquito-borne diseases.
Vibert Stroom was invited by Dr. Rufus Ewing,
director of Health Services within the Ministry of
Health and Human Services, to assess the country’s
Vector Control Programme. A disease such
as dengue fever that is transmitted to humans or
other animals by an insect or other arthropod is
called a vector-borne disease.
Stroom visited all the inhabited islands and
worked closely with the Environmental Health
Department. He reviewed the operation of the
vector control unit, assessed its readiness for the
prevention and control of dengue fever within
the islands, and plans to provide guidelines in
improving the department programme, where
necessary.
The visit also included field inspections in
communities within the islands. Stroom also met
with the staff involved in vector control and held
discussions with the head of department on his
findings.
TCI gets advice on
mosquito, dengue control
Chief Environmental Health Officer Lorne
Robinson said Stroom’s forthcoming advice and
any recommendations would help the vector control
programme.
“In the Ministry of Health, we are truly appreciative
of the Pan American Health Organisation
for proving technical assistance in the area of Vector
Control which will go a long way in improving
our mosquito control programmes,” Ewing said.
“It will help immensely in preventing an increase
in the mosquito population, and in the prevention
of dengue and other mosquito-borne diseases.”
A handful of cases of dengue fever have been
detected in the TCI in people who travelled here
from other countries. Not all mosquitoes in the
TCI can transmit dengue, which is spread only by
the bite of an infected Aedes mosquito.
Symptoms of dengue fever include a sudden fever
with headache, muscle and severe joint pains
and rash. Most dengue infections result in relatively
mild illness that can last up to 10 days, but
complete recovery can take as long as a month.
Older children and adults are usually sicker than
young children.
October 2011, at the Thrift Store/Office at
7.00 pm
The meeting is open to all TCI RC members
and those interested in joining.
Members are reminded that their membership
Provo Ryder Cup golf rivals to hit the green
Provo’s golfing community is gearing up
to the much anticipated and most popular
golfing event of the year, the Hugh G.
O’Neill and Co/Caribbean Snow Removal
Ryder Cup.
The event will be staged at the Provo
Golf Club over the Oct. 29-30 weekend.
The golf tournament is played between
the Provo-based North American team
versus the international team and much
resembles the popular Professional Golfers’
Association-sponsored biennial golf
competition between teams from Europe
and the United States.
The Provo Ryder Cup will be the 19th
staging of the competition, with the North
Americans trailing 12-6.
“This is the big one when it comes to club
members — the one they all want to win,”
said Dave Douglas, director of golf. “The
professional Ryder Cup between America
and Europe is packed full of tension and
excitement, and our version is no different.
“The Turks and Caicos Islands are a
multicultural place with residents from all
over the world. Our membership reflects
that too, and it’s why this competition
proves so popular.
“The international team ran out good
winners last year to extend their overall
lead, and I know that hurt the North
Americans. They will be going all out for
revenge this year, and it should be a fantastic
two days golf.”
“One thing is certain — I wouldn’t want
to bet either way on the outcome of this
one.”
Both sides will include 20 male and
six female players of various abilities and
handicaps, with the North Americans
captained by Mike Adamo and assistant,
Fraser Dods, and the international team
skippered by Chris Bruno and his assistant,
Will Shoreman.
“Spectators are very welcome”, added
Douglas. “It’s free to watch, and we have a
great restaurant serving food and refreshments.
A big crowd will give the players a
huge boost, and it will certainly be an entertaining
two days.
Provo Golf Club
The Ryder Cup will take place Oct. 29 - 30 at the Provo Golf Club.
“The singles take place on the Sunday,
and they can be dramatic affairs, and the
buzz around the 18th green is fantastic.
“Anyone who has watched the professional
Ryder Cup will know what I mean,
and I can guarantee the TCI version is
just as tense and as meaningful as the real
thing.”
The action gets underway on both days
at around 8 a.m. with the pairs best ball
matches on Saturday and the singles on
f
p
Sunday. The competition will be decided
by the exciting match play format with golf
fans urged to come and support their side.
