to drug addicts, <strong>the</strong> protection <strong>of</strong> employees from <strong>the</strong> effects<br />

<strong>of</strong> <strong>the</strong> 24-hour economy, joining <strong>the</strong> United Nations, support<br />

for environmentally safe agriculture, <strong>the</strong> 1994 provision<br />

that trans-Alpine freight must be transported by train with<br />

effect from 2004, <strong>the</strong> inclusion <strong>of</strong> an anti-racism article in<br />

<strong>the</strong> Swiss Constitution, an increase in <strong>the</strong> tax on petrol, making<br />

rape within marriage a punishable <strong>of</strong>fence, restrictions<br />

on <strong>the</strong> genetic modification <strong>of</strong> organisms, <strong>the</strong> creation <strong>of</strong> a<br />

civilian service alternative to compulsory military service, a<br />

moratorium on <strong>the</strong> building <strong>of</strong> nuclear power stations, several<br />

taxes on <strong>the</strong> use <strong>of</strong> cars <strong>and</strong> lorries, <strong>and</strong> <strong>the</strong> abolition<br />

<strong>of</strong> <strong>the</strong> death penalty also in wartime. Conservatives obtained<br />

approval for measures which include <strong>the</strong> following: lifelong<br />

prison sentences for sex <strong>of</strong>fenders considered by experts to<br />

be extremely dangerous <strong>and</strong> untreatable, several rules for reducing<br />

budgetary deficits, <strong>the</strong> termination <strong>of</strong> several government<br />

grants, as well as <strong>the</strong> rejection <strong>of</strong> several progressive<br />

proposals coming from <strong>the</strong> government or from citizens’ initiatives<br />

(Butler <strong>and</strong> Ranny, 1994; Kaufmann et al., 2005).<br />

In recent decades, ‘progressive’ groups in California have<br />

successfully used referendums for proposals including those<br />

for better environmental legislation, <strong>the</strong> legalised use <strong>of</strong> marihuana<br />

for medical purposes, raising <strong>the</strong> minimum wage,<br />

limiting <strong>the</strong> effect <strong>of</strong> campaign funding in elections, increasing<br />

<strong>the</strong> tax on cigarettes, prohibiting various toxic substances,<br />

securing several measures for <strong>the</strong> protection <strong>of</strong> animals,<br />

setting minimums for school budgets, <strong>and</strong> introducing various<br />

freedom-<strong>of</strong>-information disclosure requirements for <strong>the</strong><br />

benefit <strong>of</strong> consumers <strong>and</strong> voters. ‘Conservatives’ obtained<br />

majorities for, among o<strong>the</strong>r things, reducing income tax <strong>and</strong><br />

real-estate tax, stricter sentences for recidivists, termination<br />

<strong>of</strong> bilingual education, termination <strong>of</strong> ‘positive discrimination’,<br />

<strong>the</strong> closing down <strong>of</strong> certain government services for<br />

illegal immigrants, allowing paid work for prisoners, <strong>and</strong> introducing<br />

a compulsory referendum for proposed increases<br />

in local taxes <strong>and</strong> tariffs (Allswang, 2000). Hajnal <strong>and</strong> Louch<br />

(2001, p. vii) concluded that during <strong>the</strong> 1980s, supporters<br />

<strong>of</strong> <strong>the</strong> Democrats <strong>and</strong> <strong>the</strong> Republicans both had exactly <strong>the</strong><br />

same chance (62%) <strong>of</strong> being on <strong>the</strong> winning side in popular<br />

votes; in <strong>the</strong> 1990s, Republican supporters were on <strong>the</strong> winning<br />

side only 2% more frequently than supporters <strong>of</strong> <strong>the</strong><br />

Democrats. Thus <strong>the</strong>y keep each o<strong>the</strong>r virtually in balance.<br />

The reverse claim that committed activists can hijack direct<br />

democracy to get <strong>the</strong>ir extremist proposals put through has<br />

equally little substance. Swiss <strong>and</strong> American practice makes<br />

it clear that <strong>the</strong> voters are extremely cautious. If activists<br />

want to get a proposal adopted, <strong>the</strong>y have to use <strong>the</strong> citizens’<br />

initiative. We already saw in chapter 5 that in Switzerl<strong>and</strong><br />

only 10% <strong>of</strong> citizens’ initiatives are approved by <strong>the</strong> voters;<br />

in California, <strong>the</strong> figure is 40%, but since a lot <strong>of</strong> citizens’<br />

initiatives are subsequently struck down by <strong>the</strong> courts, <strong>the</strong><br />

final number also comes down to around 10%. When <strong>the</strong>y<br />

are unsure, voters tend to vote against citizens’ initiatives.<br />

In some respects, small, passionate groups actually have greater<br />

chances in strictly representative systems. After all, in those<br />

systems <strong>the</strong>y only have to persuade a small number <strong>of</strong> politicians.<br />

The European supranationalists are a typical example <strong>of</strong><br />

a small, activist group, which has had a much larger influence<br />

on <strong>the</strong> undemocratic development <strong>of</strong> <strong>the</strong> European Union by<br />

means <strong>of</strong> representative systems (evidenced in <strong>the</strong> project <strong>of</strong><br />

<strong>the</strong> European Constitution, for example) than <strong>the</strong>y would have<br />

had in a direct democracy. The only reason that <strong>the</strong> European<br />

Constitution has been provisionally shelved is as a result <strong>of</strong> <strong>the</strong><br />

referendums held in <strong>the</strong> Ne<strong>the</strong>rl<strong>and</strong>s <strong>and</strong> France.<br />

k. Better instruments than <strong>the</strong> referendum<br />

The first response <strong>of</strong> politicians when <strong>the</strong>y are confronted<br />

with <strong>the</strong> clamour for direct democracy is simply to ignore it.<br />

If <strong>the</strong> clamour continues <strong>and</strong> grows, however, <strong>the</strong>re comes a<br />

moment at which ignoring it no longer succeeds. Politicians,<br />

toge<strong>the</strong>r with those who identify with <strong>the</strong>m, <strong>of</strong>ten <strong>the</strong>n go on<br />

to propose alternative measures that, on <strong>the</strong> one h<strong>and</strong>, are<br />

intended to show that <strong>the</strong>y are not deaf to <strong>the</strong> public dem<strong>and</strong><br />

for more democracy, but, on <strong>the</strong> o<strong>the</strong>r, are not as threatening<br />

to those in power as citizens’ initiative referendums. This is<br />

<strong>the</strong>n presented as an attempt to find instruments that operate<br />

‘better’ than referendums. This was <strong>the</strong> case, for example,<br />

in Belgium, where direct democracy was placed high on <strong>the</strong><br />

political agenda under <strong>the</strong> pressure <strong>of</strong> massive demonstrations<br />

(<strong>the</strong> ‘white marches’) in <strong>the</strong> second half <strong>of</strong> <strong>the</strong> 1990s,<br />

but where politicians are currently returning to <strong>the</strong>ir old positions<br />

<strong>and</strong> withdrawing <strong>the</strong>ir previous support for citizens’<br />

initiative referendums.<br />

In this context, <strong>the</strong> journalist Filip Rogiers quotes <strong>the</strong> argument<br />

<strong>of</strong> Belgian politician Dirk Holemans for ‘dialogic‘ instead<br />

<strong>of</strong> `direct’ democracy: “Dialogic democracy”, says Holemans,<br />

“differs fundamentally from direct democracy. In <strong>the</strong><br />

latter, <strong>the</strong> market model enters politics. It starts out from <strong>the</strong><br />

idea that, if you conduct a survey, you also obtain an insight<br />

into what issues are current in a society – whereas democracy<br />

actually means that you provide people with an opportunity<br />

to question <strong>the</strong>ir own vision <strong>and</strong> possible change it. Only in<br />

this way do you create social support for necessary changes.”<br />

Dialogic democracy “is not direct democracy, it is a long way<br />

from noting <strong>and</strong> adding up opinions, yes’s <strong>and</strong> no’s. Nor is it<br />

a shamefaced way <strong>of</strong> giving representative democracy legitimacy.<br />

It is just a very prosaic word for democracy. A classic<br />

example is <strong>the</strong> formula for <strong>the</strong> citizens’ panels. In a city or<br />

a municipality, a representative group <strong>of</strong> citizens is brought<br />

toge<strong>the</strong>r around a specific issue. They are given all possible<br />

opportunities <strong>and</strong> resources to form a thoroughly considered<br />

judgement. They can hear witnesses <strong>and</strong> experts. At <strong>the</strong> end<br />

<strong>of</strong> <strong>the</strong>ir sitting, <strong>the</strong>y deliver a judgement <strong>and</strong> propose a solution.<br />

It does not have to be a consensus; <strong>the</strong>re is no need<br />

<strong>of</strong> unanimity. Even citizens who have had to eat humble pie<br />

at least underst<strong>and</strong> <strong>the</strong> reason for <strong>the</strong> final decision. There<br />

has been a dialogue, <strong>and</strong> confrontation, opinions have been<br />

changed.” (Knack, 19 February 2000).<br />

The tactic <strong>of</strong> this line <strong>of</strong> reasoning against direct democracy<br />

is clear. Direct democracy by means <strong>of</strong> citizens’ initiative referendums<br />

is first presented as a type <strong>of</strong> market survey, free<br />

<strong>of</strong> any social discussion or forming <strong>of</strong> opinions. Obviously<br />

no-one can find that really attractive. Then <strong>the</strong> alternative <strong>of</strong><br />

a ‘dialogic’ democracy is presented, in which <strong>the</strong> citizens do<br />

actually obtain information, discuss things with each o<strong>the</strong>r<br />

<strong>and</strong> possibly change opinions. The confusion <strong>of</strong> concepts<br />

that is carried out here is that between two pairs <strong>of</strong> opposing<br />

positions: ‘actual social opinion forming’ versus ‘no opinion<br />

forming’, <strong>and</strong> ‘popular sovereignty’ versus ‘no popular sovereignty’.<br />

Holemans <strong>and</strong> Rogiers reject <strong>the</strong> citizens’ initiative<br />

referendum on <strong>the</strong> basis <strong>of</strong> <strong>the</strong> first pair, arguing that<br />

social opinion forming is essential <strong>and</strong> is incompatible with<br />

<strong>the</strong> referendum, <strong>and</strong> <strong>the</strong>n promote an alternative that guarantees<br />

much so-called opinion forming but, unfortunately,<br />

surrenders <strong>the</strong> people’s sovereignty.<br />

However, it is absurd to claim that a citizens’ initiative referendum<br />

cannot be coupled with an intensive process <strong>of</strong> social<br />

opinion forming. Put even more forcefully, <strong>the</strong>re is an a pri-
