B2 The project proponent was requested to furnish <strong>the</strong><br />

discussed during <strong>the</strong> presentation. It was also indicated<br />

that <strong>the</strong> members <strong>of</strong> <strong>the</strong> Committee would like to visit <strong>the</strong><br />

existing hazardous waste disposal facility at Taloja in<br />

order to get a better appreciation <strong>of</strong> <strong>the</strong> activity. The visit<br />

will be undertaken at 3 PM on 12 th February, 2009.<br />

B2 It was found from <strong>the</strong> proposed lay out that some <strong>of</strong> <strong>the</strong><br />

buildings are proposed to be built over <strong>the</strong> land housing<br />

slums, while no arrangement has been proposed for <strong>the</strong><br />

shifting <strong>of</strong> <strong>the</strong> slums. In <strong>the</strong> light <strong>of</strong> this, <strong>the</strong> project<br />

proponent was requested to recast this project<br />

appropriately and <strong>the</strong>n submit <strong>the</strong> same.<br />

B2 The project proponent was requested to furnish <strong>the</strong><br />

following clarifications/additional information:<br />

(i) The area <strong>of</strong> basement may be reduced to <strong>the</strong><br />

requirements <strong>of</strong> <strong>the</strong> DC rules, by optimally using <strong>the</strong><br />

space for parking.<br />

(ii) Number <strong>of</strong> punctures from <strong>the</strong> main road to be<br />

reduced from three to two.<br />

(iii) Plan for disposal <strong>of</strong> solid waste generated during<br />

construction to be indicated.<br />

(iv) Water balance to be reworked out on a realistic<br />

basis to avoid use <strong>of</strong> water tanker during <strong>the</strong> operation<br />

phase.<br />

(v) Design details <strong>of</strong> <strong>the</strong> sewage treatment plant.<br />

(vi) A detailed cross section <strong>of</strong> <strong>the</strong> building including <strong>the</strong><br />

(The sixth <strong>meeting</strong> which was earlier scheduled to be held on 29 th , 30 th and 31 st <strong>of</strong> December 2008 had<br />

to be postponed as <strong>the</strong> Department <strong>of</strong>ficials were preoccupied with <strong>the</strong> extended session <strong>of</strong> <strong>the</strong><br />

Maharashtra legislature).

When <strong>the</strong> presentation was made, a basic issue which<br />

came up was what would be <strong>the</strong> FSI permissible in <strong>the</strong><br />

proposed township project. It was also not clear whe<strong>the</strong>r<br />

<strong>the</strong> Government <strong>of</strong> Maharastra has issued a separate<br />

notification permitting <strong>the</strong> setting up <strong>the</strong> proposed<br />

township. The project proponent was, <strong>the</strong>refore,<br />

requested to:<br />

(i) furnish copy <strong>of</strong> <strong>the</strong> notification issued by <strong>the</strong> <strong>State</strong><br />

Government giving permission to set up <strong>the</strong> proposed<br />

township project;<br />

(ii) indicate <strong>the</strong> zoning approved by <strong>the</strong> Town Planning<br />

Department and <strong>the</strong> consequential permissible FSI; and<br />

(iii) revise <strong>the</strong> proposal in <strong>the</strong> light <strong>of</strong> <strong>the</strong> correct position<br />

regarding (ii) above, furnishing <strong>the</strong> full required details<br />

as per from IA and IB and also providing complete<br />

information as per <strong>the</strong> check list indicated.<br />

B1 It was decided to recommend <strong>the</strong> proposal for grant <strong>of</strong><br />

prior environmental clearance subject to <strong>the</strong> project<br />

proponent relating to various environmental aspects.<br />

It was decided to recommend <strong>the</strong> proposal for grant <strong>of</strong><br />

prior environmental clearance subject to <strong>the</strong> project<br />

proponent furnishing a concise statement <strong>of</strong> all<br />

commitments made by <strong>the</strong> proponent relating to various<br />

environmental aspects.<br />

B1 The project proponent has approached <strong>the</strong> Committee to<br />

get concurrence for <strong>the</strong> proposed terms <strong>of</strong> reference for<br />

EIA to be conducted. The Committee decided to give<br />

concurrence to <strong>the</strong> proposed terms <strong>of</strong> reference subject<br />

to <strong>the</strong> following modifications:<br />

(i) Under “3.2 – Objectives <strong>of</strong> Study’ s.no. (iii), <strong>the</strong><br />

words “using appropriate ma<strong>the</strong>matical/simulation<br />

models’ may be deleted (so that o<strong>the</strong>r methods can also<br />

be used depending on <strong>the</strong> need).<br />

(ii) Under ‘3.2 - Objective <strong>of</strong> Study’ s.no. (vi), <strong>the</strong> last<br />

word ‘component’ to be corrected as ‘proponent.<br />

(iii) Under ‘4.2 Land Environment’, to <strong>the</strong> sentence<br />

“Identification <strong>of</strong> <strong>the</strong> borrow areas for extraction <strong>of</strong> earth<br />

materials for construction” add “and dumping areas for<br />

disposal <strong>of</strong> debris”.<br />

(iv) Under ‘4.5 Socio-economic, Health and Cultural<br />

Environment’, add at <strong>the</strong> end ‘Disruption <strong>of</strong> existing lines<br />

<strong>of</strong> communication like rail, roads and bridges, cattle<br />

tracks etc.’


(v) Under ‘4.7 Environment Management Plan’, add at<br />

<strong>the</strong> end “It will include a detailed scheme for<br />

rehabilitation <strong>of</strong> affected people and providing adequate<br />

infrastructure, particularly those disrupted by <strong>the</strong> project.<br />

It will indicate <strong>the</strong> costs involved for pisciculture,<br />

recreational activities like boating etc. as well as<br />

organization for EMP”<br />

The project proponents at serial nos. 17 and 20 (M/s Coal India Ltd and Ichalkaranji Textile<br />

Development Ltd.) did not attend <strong>the</strong> presentation. It was decided to close <strong>the</strong>se cases.

B(2) It was decided to recommend <strong>the</strong> proposal for<br />

to <strong>the</strong> project proponent complying with/<br />

furnishing <strong>the</strong> following:<br />

(i) Submission <strong>of</strong> an undertaking that instead<br />

<strong>of</strong> a percolation tank, a storage tank <strong>of</strong> at least<br />

500 M 3 capacity will be taken up for rain water<br />

harvesting.<br />

(ii) Revised list <strong>of</strong> species and numbers <strong>of</strong><br />

trees to be planted.<br />

(iii) A concise statement <strong>of</strong> all commitments<br />

made by <strong>the</strong> proponent relating to various<br />

environmental aspects.<br />

B(2) It was decided to recommend <strong>the</strong> proposal for<br />

grant <strong>of</strong> prior environmental clearance subject<br />

to <strong>the</strong> project proponent complying with/<br />

furnishing <strong>the</strong> following:<br />

(i) Submission <strong>of</strong> design for <strong>the</strong> tertiary<br />

treatment plant for rain water to be used for air<br />

conditioning.<br />

Irrigation Department to supply water from <strong>the</strong><br />

Irrigation tank. They have also not so far got<br />

<strong>the</strong> consent <strong>of</strong> <strong>the</strong> large number <strong>of</strong> farmers<br />

through whose lands <strong>the</strong> pipeline is to be laid.<br />

The project proponent stated that <strong>the</strong>ir efforts<br />

in both <strong>the</strong>se directons were going on.<br />

The Committee considered <strong>the</strong> matter and<br />

found that even more than six months after<br />

making <strong>the</strong> presentation to <strong>the</strong> Committee and<br />

<strong>the</strong> project proponent committed to get<br />

consent for water and related matters, <strong>the</strong>re<br />

has been no progress. Since <strong>the</strong> project<br />

cannot be taken up unless <strong>the</strong>re is assured<br />

supply <strong>of</strong> water, it was decided to close <strong>the</strong><br />

case. In case <strong>the</strong> project proponent does<br />

succeed in future to tie up all necessary<br />

arrangements for supply <strong>of</strong> water, <strong>the</strong> case<br />

can <strong>the</strong>n be reopened.<br />

B(2) The points on which compliance was to be<br />

submitted were not indicated to <strong>the</strong> project<br />

proponent earlier. Now it was indicated to<br />

<strong>the</strong>m to furnish compliance in respect <strong>of</strong> <strong>the</strong><br />

following:<br />

(i) Correct FSI calculations as per <strong>the</strong> already<br />

approved norms (instead <strong>of</strong> anticipated which<br />

is yet to be approved).<br />

(ii) Redesign <strong>the</strong> total project (based on <strong>the</strong><br />

realistic FSI as mentioned in (i) above)<br />

including parking, water requirement, waste<br />

disposal etc.<br />

(iii) Restriction <strong>of</strong> <strong>the</strong> punctures from <strong>the</strong><br />

highway to two instead <strong>of</strong> four.<br />

(iv) Justification for <strong>the</strong> proposed parking in<br />

accordance with <strong>the</strong> approved norms.<br />

(v) Impact <strong>of</strong> <strong>the</strong> proposed development on<br />

existing air quality and proposed measures to<br />

mitigate <strong>the</strong> same.<br />

(vi) Redesign <strong>the</strong> recharge pit for rainwater<br />

harvesting on a realistic basis as per norms.<br />

(vii) Redesign <strong>the</strong> internal roads taking into<br />

account <strong>the</strong> fire fighting requirement.

B(2) It was decided to recommend <strong>the</strong> proposal for<br />

grant <strong>of</strong> prior environmental clearance subject<br />

to <strong>the</strong> project proponent complying with/<br />

furnishing <strong>the</strong> following:<br />

(i) Undertaking that <strong>the</strong> quality <strong>of</strong> <strong>the</strong> treated<br />

water will be at least 50 mg/litre COD and 20<br />

mg/litre BOD.<br />

(ii) A concise statement <strong>of</strong> all commitments<br />

made by <strong>the</strong> proponent relating to various<br />

environmental aspects.<br />

M/s Minerals and Metals B(2) The project proponent produced a copy <strong>of</strong> <strong>the</strong><br />

‘Consent to operate’ issued by MPCB. In this<br />

case <strong>the</strong> Committee noted <strong>the</strong> need to take<br />

effective steps to meet <strong>the</strong> various concerns<br />

expressed at <strong>the</strong> time <strong>of</strong> public hearing. It was<br />

decided to recommend <strong>the</strong> proposal for grant<br />

<strong>of</strong> prior environmental clearance subject to <strong>the</strong><br />

project proponent first complying with <strong>the</strong><br />

following conditions:<br />

(i) Submission <strong>of</strong> <strong>the</strong> Executive Summary <strong>of</strong><br />

<strong>the</strong> EIA and EMP covering all relevant points.<br />

(ii) Commitment to improve <strong>the</strong> approach road<br />

from <strong>the</strong> state highway to two-lane standard<br />

and black top it so as to reduce <strong>the</strong> dust<br />

pollution and also to improve <strong>the</strong> junction to<br />

<strong>the</strong> state highway so as to avoid traffic<br />

disturbances.<br />

(iii) Reascertaining <strong>the</strong> ground water level by<br />

fur<strong>the</strong>r hydrological investigations and<br />

confirmation that ground water table will not be<br />

adversely affected by mining.


(iv) Commitment to adopt safety measures<br />

such as barricading <strong>the</strong> mining area and land<br />

filling etc to avoid mishaps.<br />

(v) Furnishing a plan for taking up social<br />

welfare measures indicating <strong>the</strong> year wise<br />

programme and expenditure to be incurred on<br />

<strong>the</strong> same.<br />

(vi) Commitment to construct a catch water<br />

drain around <strong>the</strong> periphery to prevent storm<br />

water from <strong>the</strong> mining area from going out.<br />

(vii) furnishing details <strong>of</strong> <strong>the</strong> afforestation<br />

programme.<br />

(viii) Preparation <strong>of</strong> <strong>the</strong> restoration plan for <strong>the</strong><br />

mine.<br />

The cases at s.nos 2, 7, and 13 (M/s Novatel Hotel, Vastu Shilpa Complex Designer and Standard<br />

Fireworks Industry) were already recommended for grant <strong>of</strong> prior environmental clearance subject to<br />

certain conditions. Those cases need not have been brought before <strong>the</strong> Committee again; <strong>the</strong> same<br />

may be placed before <strong>the</strong> Authority. The project proponents in respect <strong>of</strong> <strong>the</strong> cases at s.nos 1, 5, 6, 8, 9<br />

and 11 (Zenith Venture Shopping, Sara Builders & Developers, Goel Patel Thakwani Developers,<br />

Naiknaware Housing Development, Kakade Estate Developers Pvt Ltd and Uttam Galva Steel Ltd)<br />

could not furnish <strong>the</strong> compliance in <strong>the</strong> <strong>meeting</strong> or attend <strong>the</strong> <strong>meeting</strong>. They may be requested to<br />

remain present with compliance in <strong>the</strong> next <strong>meeting</strong> to be held from 9 th Februray to 11 th February,<br />

failing which <strong>the</strong> case will be closed.
