3.7.6 Applicant not Ready for Certification:<br />

Where the certification team is of the opinion that there are major deviations from<br />

schedule of events, unacceptable manuals, inadequate maintenance arrangements etc.,<br />

the team shall immediately notify the shortcomings in writing to DFS. If the DFS agrees<br />

with the recommendations of the team, the applicant shall be informed and briefed<br />

accordingly for the deficiencies. All documents submitted by the applicant would be<br />

returned and the applicant advised to re-apply for <strong>AOC</strong> when he/she is ready for the<br />

<strong>AOC</strong> audit.<br />

Note: The P<strong>CAA</strong> shall not be responsible of any kind of loss incurred to the<br />

prospective operator during the process of preparation / certification for an <strong>AOC</strong>.<br />

3.7.7 Variation of an <strong>Air</strong> <strong>Operator</strong>s <strong>Certificate</strong>:<br />

a) Requirement of variation in the <strong>AOC</strong> / Operations Specifications (Ops. Specs) of<br />

<strong>AOC</strong> may arise due to changes in the <strong>Operator</strong>’s planned operations , or as a<br />

result of action under the provision of the CAR’s 94 and the <strong>Air</strong> Navigation<br />

Orders;<br />

b) Where a variation is likely to take place in the planned operations under an <strong>AOC</strong>,<br />

the holder has an obligation to notify the P<strong>CAA</strong> of the proposed changes and<br />

seek approval of the amendments to the respective <strong>AOC</strong> / Operations<br />

specifications;<br />

c) In case an operator is seeking an addition or deletion to the existing Operations<br />

Specifications, he/she should give in writing to P<strong>CAA</strong> the change wanted, the<br />

reason for the requested change, procedures to be followed to comply with the<br />

change and the proposed date the change is to take place. Failure to notify the<br />

change in the operations specifications and to operate without prior approval of<br />

the procedures for that operation is a breach of CAR’s 1994 and the ANO’s.<br />

3.7.8 Addition / Removal of an <strong>Air</strong>craft to/from Operations Specifications:<br />

a) An operator is required to submit an applications to include/exclude an aircraft<br />

in/from the Operations Specifications in reasonable time for the P<strong>CAA</strong> to assess<br />

the operator’s competence to utilize that type;<br />

b) Based upon knowledge of the operator’s current fleet, the need for further<br />

inspection of the operator’s facilities, training and checking organization,<br />

maintenance organization and aircraft will be determined. If these are<br />

necessary, the operator shall provide details as to when the facilities and aircraft<br />

(as applicable) will be available for inspection. The operator must also provide<br />

appropriate amendments to operations manual, training manual and aircraft<br />

flight manual, minimum equipment list of each aircraft for approval if already not<br />

approved.<br />

3.7.9 Withholding, Suspension and Cancellation of a <strong>Certificate</strong>:<br />

The competent authority may refuse to grant or renew the <strong>Certificate</strong>, or suspend /<br />

cancel the same under the Rules.<br />

If the applicant has committed a financial breach of not paying the renewal fee or any<br />

other P<strong>CAA</strong> outstanding dues, his certificate is liable to be with held, suspended or<br />

cancelled.<br />
