3.3 Commission de protection du territoire agricole (CPTAQ)<br />

The CPTAQ administers <strong>the</strong> laws and regulations related to <strong>the</strong> protection <strong>of</strong> agricultural<br />

land and activities. The term “agricultural activities” as defined in <strong>the</strong> Act respecting <strong>the</strong><br />

preservation <strong>of</strong> agricultural land and agricultural activities administered by <strong>the</strong> CPTAQ<br />

means:<br />

“The practice <strong>of</strong> agriculture including <strong>the</strong> practice <strong>of</strong> allowing <strong>the</strong> land to lie<br />

fallow, <strong>the</strong> storage and use, on a farm, <strong>of</strong> chemical, organic or mineral products<br />

and <strong>of</strong> farm machinery and equipment <strong>for</strong> agricultural purposes.<br />

Where carried out by a producer on his farm with respect to farm products from<br />

his operation or, secondarily, from <strong>the</strong> operations <strong>of</strong> o<strong>the</strong>r producers, activities<br />

relating to <strong>the</strong> storage, packaging, processing and sale <strong>of</strong> farm products are<br />

considered to be agricultural activities.”<br />

FR reclamation in agricultural zones is <strong>the</strong>re<strong>for</strong>e considered to be an agricultural activity<br />

by <strong>the</strong> CPTAQ. There are some exceptions, however. In <strong>the</strong> case <strong>of</strong> activities deemed not<br />

to be agricultural, section 97 <strong>of</strong> <strong>the</strong> Act respecting <strong>the</strong> preservation <strong>of</strong> agricultural land<br />

and agricultural activities stipulates that CPTAQ authorization must be obtained be<strong>for</strong>e a<br />

CA can be issued under <strong>the</strong> EQA. See sections 9 and 14 on temporary storage and<br />

composting.<br />

3.4 Ordre des agronomes du Québec (OAQ)<br />

The OAQ plays a role in protecting <strong>the</strong> public in keeping with <strong>the</strong> Pr<strong>of</strong>essional Code and<br />

<strong>the</strong> Agronomists Act. It is responsible <strong>for</strong> ensuring <strong>the</strong> competency <strong>of</strong> agronomists and<br />

<strong>the</strong>ir compliance with <strong>the</strong> Code <strong>of</strong> Ethics.<br />

The OAQ’s oversight role is an important one, since agronomists are required to develop<br />

agro-environmental reclamation plans (AERP) <strong>for</strong> FR-receiving parcels on agricultural<br />

lands. As a rule, agronomists also develop agro-environmental fertilization plans (AEFP)<br />

<strong>for</strong> farms in accordance with <strong>the</strong> Agricultural operations regulation (AOR).<br />

3.5 O<strong>the</strong>r pr<strong>of</strong>essional orders<br />

FR reclamation projects <strong>of</strong>ten require <strong>the</strong> services <strong>of</strong> various types <strong>of</strong> pr<strong>of</strong>essionals, and<br />

<strong>the</strong>re<strong>for</strong>e several pr<strong>of</strong>essional associations may have an oversight role to play in relation<br />

to <strong>the</strong> involvement <strong>of</strong> <strong>the</strong>ir members. Table 3.1 presents various situations requiring <strong>the</strong><br />

participation <strong>of</strong> pr<strong>of</strong>essionals or technologists who belong to a pr<strong>of</strong>essional order.<br />
