5 CA application<br />

5.1 CA application <strong>for</strong>ms<br />

Application <strong>for</strong>ms can be obtained from <strong>the</strong> Ministry’s regional <strong>of</strong>fices <strong>for</strong> FR<br />

reclamation projects requiring a CA.<br />

5.2 Responsibilities <strong>of</strong> <strong>the</strong> applicant and partners<br />

5.2.1 CA applicant<br />

The applicant is <strong>the</strong> legal or natural person who signs <strong>the</strong> application (see Glossary). This<br />

person may be:<br />

• <strong>the</strong> FR user, e.g. an agricultural operation;<br />

• <strong>the</strong> FR generator, e.g. an industrial company or a municipality;<br />

• a brokerage firm;<br />

• a specialized promoter.<br />

The applicant must sign <strong>the</strong> CA application <strong>for</strong>m. If <strong>the</strong> signatory is an agent, <strong>the</strong><br />

mandate must be appended to <strong>the</strong> CA application.<br />

Generally, <strong>the</strong> applicant produces a CA application <strong>for</strong> each receiving operation that has<br />

an agro-environmental fertilisation plan (AEFP) and a phosphorus report (if required), in<br />

<strong>the</strong> case <strong>of</strong> a farm. If <strong>the</strong> authorisation is issued, <strong>the</strong> applicant becomes <strong>the</strong> holder <strong>of</strong> a CA<br />

(see Glossary).<br />

In <strong>the</strong> event <strong>of</strong> failure to comply with a CA, <strong>the</strong> holder (CA applicant) is liable to receive<br />

a violation notice from <strong>the</strong> Ministry and to legal proceedings. Applicants must <strong>the</strong>re<strong>for</strong>e<br />

make sure that any responsibilities <strong>the</strong>y share with partners are clearly set out in <strong>the</strong>ir<br />

contractual agreements. Regardless, any individual who violates a specific regulatory<br />

standard is liable to receive a violation notice from <strong>the</strong> Ministry. An example would be a<br />

farmer who, in carrying out a spreading operation, failed to comply with <strong>the</strong> separation<br />

distances <strong>for</strong> ditches and watercourses stipulated in <strong>the</strong> Agricultural operations<br />

regulation.<br />

5.2.2 Agronomist<br />

The agronomist’s main role is to attest that all <strong>the</strong> requirements set out in <strong>the</strong> <strong>Guidelines</strong><br />

have been addressed in <strong>the</strong> CA application. More specifically, agronomists must ensure<br />

that <strong>the</strong> agro-environmental reclamation plan (AERP) requirements have been met (see<br />

Section 10). Should <strong>the</strong>y find any discrepancies, <strong>the</strong>y must make sure that <strong>the</strong>y are<br />
