Although <strong>the</strong>se responsibilities may be entrusted to an agent under a contractual<br />

agreement, <strong>the</strong> generator should ideally be <strong>the</strong> one to sensitize and in<strong>for</strong>m <strong>the</strong> public<br />

(Section 10.5), since he is <strong>of</strong>ten perceived as <strong>the</strong> responsible party.<br />

5.2.5 Receiver<br />

The receiving party, whe<strong>the</strong>r an agricultural or o<strong>the</strong>r operation, must assume its<br />

obligations, which generally include <strong>the</strong> following:<br />

• compliance with separation distances and o<strong>the</strong>r regulatory standards;<br />

o AOR<br />

o GCR<br />

o RRQA<br />

• provision <strong>of</strong> <strong>the</strong> AEFP to <strong>the</strong> applicant (in accordance with AOR requirements);<br />

• compliance with <strong>the</strong> o<strong>the</strong>r storage and spreading criteria set out in <strong>the</strong> <strong>Guidelines</strong><br />

(Sections 9 and 10);<br />

• implementation <strong>of</strong> measures to in<strong>for</strong>m <strong>the</strong> public and raise awareness (Section<br />

10.4);<br />

• authorization from <strong>the</strong> owner if <strong>the</strong> spreading is to be done on leased parcels <strong>of</strong><br />

land.<br />

5.2.6 Commitments <strong>of</strong> <strong>the</strong> participants<br />

The applicant, <strong>the</strong> pr<strong>of</strong>essional and <strong>the</strong> receiver must sign <strong>the</strong> CA application <strong>for</strong>m, thus<br />

indicating that <strong>the</strong>y agree to <strong>the</strong> basic commitments. The producers’s undertakings must<br />

be appended to <strong>the</strong> application <strong>for</strong>m. The responsibilities <strong>of</strong> each participant may be<br />

spelled out in separate private contractual agreements and appended, as needed.<br />

5.3 Responsibilities <strong>of</strong> <strong>the</strong> Ministère du Développement<br />

durable, de l’Environnement et des Parcs du Québec<br />

The Ministry exercises a number <strong>of</strong> responsibilities related to CAs, which are described<br />

in <strong>the</strong> following subsections.<br />

5.3.1 Development <strong>of</strong> standards, criteria, guidelines and <strong>for</strong>ms<br />

The MDDEP must develop standards and criteria related to reclamation activities. In<br />

cases <strong>of</strong> uncertainty, it must determine what research and in<strong>for</strong>mation is needed in order<br />

to have <strong>the</strong> necessary studies carried out by itself, <strong>the</strong> public sector, universities or private<br />

institutions.<br />

The Ministry must also create and update reference guidelines and CA application <strong>for</strong>ms.<br />
