SPECIAL CONDITIONS<br />

1.0 Buyers / Bidders purchasing hazardous waste defined under the "Hazardous Wastes (Management &<br />

Handling) Rules 1989", "amended Rule 2003", notified under the "Environment (Protection) Act, 1986", are<br />

required to have environmentally-sound processing technologies [EST's], efficient pollution control system &<br />

valid authentication from the 'State Pollution Control Board' / 'Pollution Control Committees in Union<br />

Territories' of handling such wastes in addition to compliance of standards laid down under Act. Violation of<br />

any provision of the rules and non-compliance with the standards are punishable as per the Act.<br />

2.0 As such all the purchasers of waste oil, batteries, non-ferrous waste particularly Lead, Copper and Zinc<br />

"wastes" are to submit the following "Clearance Certificates" alongwith the bid [at the time of tenderopening].<br />

In absence of same, the bid shall be liable for rejection.<br />

(a) Valid authorization from the appropriate authorities as per law for handling of hazardous wastes under<br />

the "Hazardous Wastes [Management and Handling] Rules 1989" & "amended Rule 2003".<br />

(b) Valid consent letters from the 'State Pollution Control Boards' under "Air and Water Act".<br />

(c) The bidders who quote for used "oil and transformer oil" should be registered with MOEF [Ministry of<br />

Environment and Forests] / CPCB [Central Pollution Control Board] as recyclers / re-processors / rerefiners<br />

having environmentally sound management facilities. Further, bidder shall also be registered<br />

with appropriate authorities of State in which the bidder's facility is situated. Bidder must indicate his<br />

sanctioned refining capacity limit and declare the amount of waste oil already procured by them till date<br />

against their sanctioned refining capacity limit failing which their bid shall not be considered.<br />

2.1 At the time of lifting of "used oil" from GAIL (India) Limited, the successful bidder / Buyer shall produce /<br />

submit necessary certificate from the statutory authority, duly approved for lifting of "used oil". The actual<br />

quantity being lifted by successful bidder shall be endorsed by GAIL (India) Limited on the Certificate.<br />

3.0 IMPORTANT NOTE TO ALL BIDDERS<br />

3.1 Returned/Undelivered Mail:<br />

The bidders must write their complete postal address correctly and legibly [preferably in "Bold Capital<br />

letters"] so that the Sale Acceptance Letters / Sale Order(s) or the EMD-refunds are made correctly, GAIL<br />

(India) Limited shall not be responsible for either delay or non-delivery of Sale Order(s) / Cheque(s) /<br />

Draft(s) due to wrong or illegible / incomplete address given in the Tender Document.<br />

In case the Sale Order(s) / Cheque(s) / Draft(s) are returned by the postal authorities / courier service to<br />

GAIL (India) Limited undelivered with any remarks such as "addressee not found", "incomplete address",<br />

"wrong address", "shop closed", "No such Firm exists at this address", or likewise, then it shall be viewed<br />

very seriously and, therefore, such Cheques / Drafts / Sale Orders shall be lying in GAIL-office at the sole<br />

risk and responsibility of the bidders. However, GAIL (India) Limited may at its sole discretion and on written<br />

request of Bidders, again send the undelivered letter / Sale Order(s) / EMD Cheques / Drafts to the<br />

addressee [without changing the text].<br />

3.2 Submission of Bid for Fire Tender:<br />

The old, used unserviceable Fire Tender available for disposal is having:<br />

(a) Registration No. of Vehicle: MP 11 3533<br />

(b) Insurance Policy valid up to: 24.11.2007<br />

(c) Road Tax paid up to: 31.03.2008<br />

Note: Bidders who submit the bid for above old, used fire tender have to bear all expenses for change of<br />

registration number, transfer to ownership, further payment of road-tax and insurance coverage.<br />

3.3 Submission of Bid for Used Oil:<br />

The rates quoted by the bidders for "used oil" should be valid for a period of one (01) year from the date of<br />

issue of "Sale Order" as GAIL (India) Limited may enter into an "Annual Rate Contract" with the successful<br />

bidder. Buyer must take the delivery of "used oil" on 'quarterly' basis. GAIL (India) Limited reserves the right<br />

to dispose off "used oil" during this period of one (01) year as and when reasonable quantity is accumulated<br />

in each quarter, or as per GAIL's requirement.<br />
