Performance & Payment Bonds •Bonding is required for ACI Debris Management Task Orders: • Failure is not an option when responding to Incidents of National Significance. • Bonding provides additional information about potential offerors in responsibility determinations. • Bonding facilitates payment relief to suppliers and subcontractors at the 1st and 2nd tier. •Results from not bonding ACI Debris Management Task Orders: • Not protecting the Government’s interests to the maximum level provided by the regulation and statue. • Loss of payment protection to subcontractors at any level. *Important Fact: FAR Clause 52.219-14, “Limitations on Subcontracting”, may exclude more small businesses than requirements for bonding since 50% of labor costs must be expended by employees of the small business. 15
