Purpose<br />

<strong>DoD</strong> Source Selection Procedures<br />

► Standardize source selection rating process across <strong>DoD</strong><br />

► Outline dollar thresholds to increase senior leader oversight<br />

► Strengthen documentation requirements for source selection decisions<br />

► Strive to increase communication with industry<br />

Mandatory use for all competitive best value acquisitions under FAR Part 15<br />

► Architect-engineer service contracts IAW FAR 36 are exempt<br />

Replaces <strong>Army</strong> Source Selection Manual (ASSM)<br />

Noted differences from ASSM<br />

► Does not contain templates<br />

► Mandates draft solicitations when value is greater than $100M<br />

► Risk can either be inherent in the Technical factor or subfactors or evaluated as a separate risk<br />

rating assigned at the Technical factor or subfactor level<br />

► No longer a “Susceptible to being Made Acceptable” rating<br />

► Source Selection Advisory Council (SSAC) must conduct comparative analysis and prepare<br />

written recommendation to SSA when value is greater than $100M<br />

► No requirement to keep <strong>of</strong>ferors anonymous from SSA<br />

What is it?<br />

Project Labor Agreements<br />

► Pre-hire collective bargaining agreement between employers and one or more labor<br />

unions to establish terms & conditions <strong>of</strong> employment for a specific construction<br />

project<br />

► Covers hours & other terms <strong>of</strong> employment (e.g. no strike, no lockout)<br />

<strong>Executive</strong> Order (EO) 13502, 6 Feb 09<br />

► Revoked prior EOs prohibiting use <strong>of</strong> PLAs on Federal Construction projects<br />

► Encouraged agencies to consider using PLAs on “large-scale” (> $25M)<br />

construction projects<br />

USACE Procedures<br />

► PLA considered for contract value <strong>of</strong> $25M or greater<br />

► Project Delivery Team (PDT) conducts Labor Market Survey during acquisition<br />

planning<br />

► PLA Decision Memorandum approved by <strong>Contracting</strong> Officer<br />

► When PLA determined suitable, solicitation provides <strong>of</strong>ferors option to propose PLA<br />

► Viable PLA provides additional credit during source selection<br />

Tax Incentives<br />

Energy <strong>Policy</strong> Act <strong>of</strong> 2005 (P.L. 109-58) and IRS Bulletins 2006-26 & 2008-14<br />

► Authorizes the Energy Efficient Commercial Buildings Tax Deduction for expenses<br />

incurred for qualified energy efficient building investments made<br />

► Allows deduction up to $1.80 per square foot <strong>of</strong> building space allocable to designer<br />

<strong>of</strong> energy efficient buildings<br />

Defense Acquisition Regulation (DAR) Council is contemplating issuance <strong>of</strong><br />

implementing procedures for designers <strong>of</strong> Government-Owned buildings<br />

► Would allow deductions to A-E firms for design <strong>of</strong> energy efficient commercial<br />

buildings if Government Owned facility can be defined as commercial buildings<br />

► Will require authorized Government Representative to attest to energy efficiency<br />

features<br />

Anticipate DAR Council to issue PGI with implementing procedures no earlier<br />

than April 2011<br />

Purpose: Deliver better value to the taxpayer by making improvements<br />

in procurement and business practices<br />

► Incentivize productivity and innovation in industry<br />

► Promote Real Competition<br />

► Improve tradecraft in services acquisitions<br />
