3. “Mainstream” <strong>Muslim</strong> Americans Have<br />
Terrorist Ties<br />
Islamophobic counterterrorism trainers lean<br />
heavily on <strong>the</strong> use of guilt by association. They routinely<br />
categorize civil rights groups such as <strong>the</strong><br />
<strong>Muslim</strong> Public Affairs Council (MPAC), Islamic<br />
Society of North America (ISNA), and Council on<br />
American-Islamic Relations (CAIR) as a support network<br />
for terrorists. None of <strong>the</strong>se organizations has<br />
been convicted of terrorism or formally charged with<br />
providing material support to terrorists, but <strong>the</strong>y are<br />
frequently impugned due to <strong>the</strong>ir alleged sympathy<br />
for Hamas and Hezbollah. To varying degrees,<br />
<strong>Muslim</strong> civil rights groups are led<br />
by individuals who oppose <strong>the</strong><br />
Israeli occupation of Palestinian<br />
lands, and <strong>the</strong> use of U.S. military<br />
operations in predominantly<br />
<strong>Muslim</strong> countries.<br />
It has become a norm to simply<br />
define Hezbollah and Hamas<br />
as terrorists without recognizing<br />
that <strong>the</strong>se groups have become<br />
conventional political players in<br />
recent years, leading some to distinguish between<br />
<strong>the</strong>ir military and political branches. 253 Even<br />
Homeland Security officials recognize that while<br />
Hamas and Hezbollah are both listed as terrorist<br />
organizations by <strong>the</strong> U.S. government and have targeted<br />
civilians with bombings, <strong>the</strong>y are distinct from<br />
al Qaeda in methods and motivations. 254<br />
CAIR, in particular, has been <strong>the</strong> target of reckless<br />
accusations. 255 CAIR is a nonprofit organization<br />
of American citizens who are <strong>Muslim</strong> and <strong>the</strong>ir “mission<br />
is to enhance understanding of Islam, encourage<br />
dialogue, protect civil liberties, empower<br />
American <strong>Muslim</strong>s, and build coalitions that promote<br />
justice and mutual understanding.” 256 It is a<br />
legitimate lobbying group for <strong>the</strong> rights and civil liberties<br />
of <strong>Muslim</strong>s in America, who need protection<br />
from McCarthyistic witch hunts.<br />
The Holy Land Foundation case is used by<br />
Islamophobic trainers to impugn <strong>the</strong> entire <strong>Muslim</strong>-<br />
American community. A Texas grand jury named<br />
CAIR and ISNA unindicted co-conspirators in <strong>the</strong><br />
prosecution of U.S. v. Holy Land Foundation for Relief<br />
and Development, along with 246 o<strong>the</strong>r <strong>Muslim</strong><br />
organizations and individuals. In <strong>the</strong> Holy Land<br />
Foundation case, <strong>the</strong> government charged five leaders<br />
of <strong>the</strong> Foundation with financing terrorism by sending<br />
more than $12 million to charitable groups,<br />

known as zakat committees, which build hospitals<br />
and feed <strong>the</strong> poor. The prosecution said <strong>the</strong> committees<br />
were controlled by Hamas, and contributed to<br />
terrorism by helping Hamas spread its ideology and<br />
recruit supporters. 257 Critics of <strong>the</strong> government’s case<br />
point out that it was based on events that took place<br />
before it was illegal for U.S. groups to support<br />
Hamas.<br />
A federal court ruled that prosecutors violated<br />
<strong>the</strong> North American Islamic Trust’s due process<br />
rights when <strong>the</strong>y publicly released <strong>the</strong> list of unindicted<br />
conspirators. Conservative commentators,<br />
counterterrorist officials, and lawmakers use <strong>the</strong> list<br />
to target legal groups based on guilt-by-association<br />
accusations. 258<br />
Although <strong>the</strong> government did not charge CAIR<br />
with financing Hamas, David Gaubatz cites <strong>the</strong> Holy<br />
Land Foundation case to conclude that “CAIR is a terrorist<br />
organization.” 259 Steven Emerson claims that<br />
CAIR ties to <strong>the</strong> Holy Land Foundation were “extensive”<br />
and “its own leadership has multiple ties to<br />
Hamas and Hamas-front groups in <strong>the</strong> United<br />
States.” 260 Emerson told police at a recent conference<br />
that <strong>the</strong>y need to ask all <strong>Muslim</strong> American groups to<br />
renounce Hamas and Hezbollah as a precondition to<br />
working with <strong>the</strong>m. 261 Although Emerson is not affiliated<br />
or speaking on behalf of any of <strong>the</strong> three groups<br />
profiled here, his comments are emblematic of <strong>the</strong><br />
problems we area addressing. ICTOA invited<br />
Emerson to speak in 2007, 2008, and 2010, but he<br />
did not appear. In <strong>the</strong> words of Alejandro Beutel from<br />
<strong>Muslim</strong> Public Affairs Council (MPAC),<br />
Islamophobes are “failing to see who are <strong>the</strong> potential<br />
enemies and who are <strong>the</strong> potential allies. Nothing<br />
we do is going to be good enough for <strong>the</strong>m.” 262<br />
4. <strong>Muslim</strong> Americans Wage “Lawfare”:<br />
Violent Jihad by O<strong>the</strong>r Means<br />
“Lawfare” is <strong>the</strong> “offensive use of democratic<br />
legal systems by those whose intent is to destroy<br />
democracy.” 263 It is a rhetorical device used to<br />
describe “<strong>Muslim</strong> extremists” alleged use of litigation,<br />
free speech, and o<strong>the</strong>r freedoms to advance<br />
<strong>the</strong>ir diabolical agenda and silence opponents.<br />
“Lawfare” is used by several trainers, such as Clare<br />
Lopez and Security Solutions International characterize<br />
lawsuits as a tactic of <strong>the</strong> purported “stealth<br />
jihad.” 264<br />
“Lawfare” utilizes a kind of Orwellian doublespeak<br />
in which “terrorism” is not <strong>the</strong> use of terror, but<br />
<strong>the</strong> use of legal procedures. The practice of law
