Members also are solely and directly responsible for the safety of their Race Equipment and are obligated to perform their duties in a manner designed to minimize to the risk of injury to themselves and others. 3.2.7 NEITHER GRAND-AM NOR THE PROMOTER IS RESPONSIBLE FOR THE ADEQUACY OF A COMPETITOR’S RACE EQUIPMENT, OR RACING ACTIVITY TO ACCOMPLISH THIS PURPOSE. GRAND-AM DOES NOT MAKE ANY REPRESEN- TATIONS OR WARRANTIES OF SAFETY TO ANY COMPETITOR OR OTHER PERSON, AND CANNOT AND DOES NOT TAKE RESPONSIBILITY TO ENSURE THE ADEQUACY, FOR PURPOSES OF SAFETY, OF THE FACILITY, SAFETY PERSONNEL OR EQUIPMENT, OR CONDITIONS AT THE TRACK. 3.3 Testing Policy. GRAND-AM has the right to restrict Testing during the season not sanctioned by GRAND-AM. Violation of this policy is determined by GRAND-AM in its sole discretion and the results of GRAND-AM’s investigation and subsequent determination are Conclusive. Members who engage in unapproved Testing of any type or Test using unapproved tires are subject to revocation of their Membership for up to one (1) year. 3.3.1 Stipulations. All DP and/or GT Testing is prohibited unless pre-approved by GRAND-AM in writing. Testing is prohibited at a track that is on the season calendar until the conclusion of that Event for that season. Requests meeting specific criteria may be approved at the sole discretion of GRAND-AM. 3.3.2 Procedure. GRAND-AM must receive a written request for approval to Test a minimum of two (2) weeks prior to the requested Test date. The request must include: who is participating, what Car(s), when and where the Test is, and why the Member wants to hold the Test. This information may be made public by GRAND-AM. 3.3.3 Requirements. All Testing must be conducted using the Official Tire in the delivered condition. A new DP Entrant is allowed a one-time allocation of six (6) Tire Sets per Car for initial familiarization during authorized Testing. 18
3.4 Event Entry. To participate in an Event, an Entrant must complete, submit with the appropriate fee and have approved, an Official Entry Form in accordance with the directions stated on the Official Entry Form. An Official Entry Form accepted by GRAND-AM shall constitute a contract, binding the Entrant to take part in the Event unless prevented by forces beyond his control. If an Entrant enters an Event without having properly submitted an Official Entry Form, the Entrant by such actions nevertheless agrees that he is subject to the Regulations, as well as all statements, releases and obligations appearing in the Official Entry Form, as if he had properly submitted a Official Entry Form. 3.4.1 Release. BY SUBMITTING AN OFFICIAL ENTRY FORM AND/OR TAKING PART IN ANY ACTIVITY RELATING TO THE EVENT, MEMBER AGREES TO ABIDE BY THE DECISIONS OF OFFICIALS RELATING TO THE EVENT OR ANY MATTERS ARISING OUT OF THE EVENT. MEMBER FURTHER AGREES TO INSPECT THE RACING AREA TO ENSURE THAT IT IS IN A SAFE, RACEABLE AND USABLE CONDITION AND THAT THE MEMBER VOLUNTARILY ASSUMES THE RISK OF AND HAS NO CLAIM FOR DAMAGES AGAINST GRAND-AM, PROMOTER OR THEIR OFFICERS, DIRECTORS, SHAREHOLDERS, OFFICIALS, AGENTS OR EMPLOYEES BY REASON OF DAMAGE TO THE CAR, EQUIPMENT, COMPETITORS OR ANY OTHER PERSON. MEMBER ASSUMES FULL RESPONSIBILITY FOR ANY AND ALL INJURIES SUSTAINED, INCLUDING DEATH AND PROPERTY DAMAGE, ANYTIME THEY ARE IN THE RACING AREA OR EN-ROUTE THERETO OR THEREFROM. MEMBER ACKNOWLEDGES THAT MEMBER’S SPOUSE AND NEXT-OF-KIN HAVE BEEN ADVISED THAT MEMBER UNDERSTANDS THE HIGH RISK OF SERIOUS INJURY OR DEATH WHICH MAY RESULT FROM PARTICIPATING AND THAT THE MEMBER SOLELY ASSUMES ALL SUCH RISKS. 3.4.2 Deadline. If an Official Entry Form is not submitted by the deadline, GRAND-AM in its sole discretion may accept the Official Entry Form, subject to a late fee. If submitted after the deadline but before the first day of registration for the Event, the late fee is $500. After the first day of registration, the late fee is $1,000. 19
