Introduction<br />

<strong>Work</strong>place<br />

This <strong>Guide</strong> is aimed <strong>at</strong> safety <strong>and</strong> health practitioners, employers, managers,<br />

employees, safety represent<strong>at</strong>ives <strong>and</strong> o<strong>the</strong>rs <strong>to</strong> give general guidance on Chapter 1<br />

of Part 2 (Regul<strong>at</strong>ions 4 <strong>to</strong> 26) of <strong>the</strong> <strong>Safety</strong>, <strong>Health</strong> <strong>and</strong> <strong>Welfare</strong> <strong>at</strong> <strong>Work</strong> (<strong>General</strong><br />

Applic<strong>at</strong>ion) Regul<strong>at</strong>ions 2007 (S.I. No. 299 of 2007) rel<strong>at</strong>ing <strong>to</strong> <strong>the</strong> workplace.<br />

It is not intended as a legal interpret<strong>at</strong>ion of <strong>the</strong> legisl<strong>at</strong>ion.<br />

From 1 November 2007, Chapter 1 of Part 2 of <strong>the</strong> <strong>General</strong> Applic<strong>at</strong>ion Regul<strong>at</strong>ions<br />

2007 re-transposes Directive 89/654/EEC <strong>and</strong> replaces Part III (Regul<strong>at</strong>ions 16 <strong>and</strong><br />

17) of <strong>the</strong> <strong>Safety</strong>, <strong>Health</strong> <strong>and</strong> <strong>Welfare</strong> <strong>at</strong> <strong>Work</strong> (<strong>General</strong> Applic<strong>at</strong>ion) Regul<strong>at</strong>ions<br />

1993 (S.I. No. 44 of 1993), which are revoked from th<strong>at</strong> d<strong>at</strong>e.<br />

In this <strong>Guide</strong> <strong>the</strong> text of <strong>the</strong> Regul<strong>at</strong>ions is shown in italics.<br />

The <strong>General</strong> Applic<strong>at</strong>ion Regul<strong>at</strong>ions 2007 are made under <strong>the</strong> <strong>Safety</strong>, <strong>Health</strong> <strong>and</strong><br />

<strong>Welfare</strong> <strong>at</strong> <strong>Work</strong> Act 2005 (No. 10 of 2005) referred <strong>to</strong> elsewhere in this <strong>Guide</strong> as<br />

“<strong>the</strong> Act” or <strong>the</strong> “2005 Act”.<br />

In summary, Chapter 1 of Part 2 of <strong>the</strong> <strong>General</strong> Applic<strong>at</strong>ion Regul<strong>at</strong>ions deals with<br />

<strong>the</strong> physical environment <strong>at</strong> <strong>the</strong> place of work <strong>and</strong> sets out <strong>the</strong> welfare facilities<br />

which should be provided as st<strong>and</strong>ard facilities for a premises used as a workplace.<br />

<strong>Work</strong>ing in fields or forestry undertakings is not covered by <strong>the</strong> Regul<strong>at</strong>ions,<br />

except for workshops <strong>and</strong> buildings associ<strong>at</strong>ed with <strong>the</strong>m. The provisions apply <strong>to</strong><br />

all buildings used as places of work with <strong>the</strong> following exemptions:<br />

• Means of transport used outside <strong>the</strong> undertaking<br />

• Mobile or temporary work sites including construction sites<br />

• Extractive industries<br />

• Fishing bo<strong>at</strong>s.<br />

Several of <strong>the</strong>se are covered, or will be covered, by o<strong>the</strong>r Regul<strong>at</strong>ions.<br />

The employer must ensure th<strong>at</strong> <strong>the</strong> physical environment of <strong>the</strong> place of work is<br />

adequ<strong>at</strong>e. <strong>Work</strong> areas should be large enough <strong>to</strong> be safe <strong>and</strong> healthy <strong>and</strong> be<br />

adequ<strong>at</strong>e with regard <strong>to</strong> stability, ventil<strong>at</strong>ion, fresh air, temper<strong>at</strong>ure <strong>and</strong> lighting.<br />

Pedestrians <strong>and</strong> vehicles must be able <strong>to</strong> circul<strong>at</strong>e safely. Traffic routes, entrances<br />

<strong>and</strong> exits must be kept clear. Floors, walls, ceilings, roofs, doors, g<strong>at</strong>es, loading<br />

bays <strong>and</strong> ramps must be safe.<br />
