SECTION 2.2<br />

PROFESSIONAL ENGAGEMENT<br />

2.2.1 Design by Professionals<br />

2.2.1.1 Where the owner appoints an architect to design a <strong>building</strong> or a part of a<br />

<strong>building</strong> and an engineer to design the structure and the services ancillary<br />

to such <strong>building</strong>, the designs shall be deemed to satisfy the requirements of<br />

these Regulations, provided also that the owner retains the services of a<br />

registered architect or engineer until an occupation permit is issued.<br />

2.2.1.2 The architect and engineer shall be deemed competent to execute all<br />

necessary inspections and he or she shall certify to the Committee the<br />

satisfactory completion of the <strong>building</strong> before the Committee issues an<br />

occupation permit. All inspections are deemed to have been made by the<br />

Committee with respect to these Regulations.<br />

2.2.1.3 If the owner terminates the agreement with his or her appointed architect or<br />

engineer at any time before the occupation permit is issued, the owner shall<br />

immediately notify the Committee concerned, and the Committee may:<br />

a) serve a notice on the owner to stop any further <strong>building</strong> operations until<br />

the owner appoints another registered architect or engineer or reappoints<br />

the original architect or engineer who shall inform the<br />

Committee that they have commenced or re-commenced their<br />

appointment, or<br />

b) serve a notice on the owner that all inspections shall be carried out by<br />

the Committee and require the owner to give the notices for inspections<br />

as required by these Regulations.<br />

2.2.1.4 Upon termination under sub-article 2.2.1.3 or termination of the agreement<br />

by the architect or engineer, the architect or engineer shall immediately<br />

notify the Committee of such termination with copies to their respective<br />

professional bodies.<br />

2.2.2 Non-compliant Professionals<br />

2.2.2.1 Where it becomes apparent to the Committee that any architect or engineer<br />

has failed to apply any or all of the provisions of these Regulations, the<br />

following courses of action may be adopted by the Committee:<br />

a) a warning may be issued to the engineer or architect specifying the<br />

provisions in noncompliance;<br />

b) the architect or engineer may be reported to their respective<br />

professional registration boards for appropriate action;<br />

c) a request may be made to have a report submitted by the professional<br />

registration bodies on any action taken pursuant to item (b) above;<br />

d) all exemptions applicable under sub-articles 2.2.1.1, 2.2.1.2 or 2.2.1.3<br />

of these Regulations may be withdrawn on receipt of a report indicating<br />

disciplinary action pursuant to item (c) above.<br />

2.2.2.2 Where any matter is brought before the Professional Conduct Committee of<br />

the Review Board, an enquiry shall be conducted by the Board and may, if<br />

the allegations are found to be justified, impose any of the following upon<br />

the engineer or architect:<br />

i) censure the person as to his or her future conduct;<br />
