Terms <strong>of</strong> reference & scope <strong>of</strong> <strong><strong>service</strong>s</strong> <strong>for</strong> MGNREGS State Resource Centre<br />

Context <strong>of</strong> <strong>the</strong> Proposal:<br />

The MGNREG Scheme has been implemented in Gujarat State since February 2006 . The objective <strong>of</strong><br />

<strong>the</strong> Scheme is to provide 100 days <strong>of</strong> guaranteed wage employment to <strong>the</strong> rural household whose adult<br />

members volunteer to do unskilled manual work. The Rural Development Department, Government <strong>of</strong><br />

Gujarat is responsible <strong>for</strong> <strong>the</strong> planning, implementation, supervision and monitoring <strong>of</strong> <strong>the</strong> scheme. The<br />

Department recognizes that ,while <strong>the</strong> MGNREG Scheme is primarily a safety net <strong>for</strong> <strong>the</strong> poor, it is also an<br />

ef<strong>for</strong>t to create durable assets which, in turn can trigger rural growth, leading to sustainable development<br />

and rural employment.<br />

The scale <strong>of</strong> <strong>the</strong> MGNREG Scheme has expanded rapidly in <strong>the</strong> State from a modest beginning in six<br />

districts in 2006. During 2009-10, <strong>the</strong> scheme was implemented in all districts providing a total <strong>of</strong> 585.11<br />

lakh mandays, and incurring a total expenditure <strong>of</strong> Rs.738 cr. The estimated Labour Budget <strong>of</strong> MGNREGS<br />

<strong>for</strong> 2010-11 is Rs. 1386 cr.<br />

Given <strong>the</strong> scale <strong>of</strong> <strong>the</strong> scheme, it is critical that programme implementation be managed as a pr<strong>of</strong>essional<br />

activity, integrating social mobilization, capacity building, quality financial management, technical<br />

supervision , quality MIS and use <strong>of</strong> modern technology<br />

Scope <strong>of</strong> Services:<br />

In order to meet <strong>the</strong> challenges envisaged in implementing MGNREGS in <strong>the</strong> State, it is proposed to<br />

set up a State Resource Centre <strong>for</strong> MGNREGS with pr<strong>of</strong>essional assistance. The Commissionerate <strong>of</strong><br />

Rural Development, Government <strong>of</strong> Gujarat, <strong>the</strong>re<strong>for</strong>e seeks <strong><strong>service</strong>s</strong> in <strong>the</strong> areas <strong>of</strong> Monitoring and<br />

Evaluation, Financial Management , Capacity Building, IEC and BCC. An indicative scope <strong>for</strong> each <strong>of</strong> <strong>the</strong><br />

listed areas is outlined below. However applicant agencies are requested to explore <strong>the</strong> full potential <strong>of</strong><br />

each area while submitting <strong>the</strong>ir proposed action plan to <strong>the</strong> Commissionerate <strong>of</strong> Rural Development .<br />

Monitoring and Evaluation:<br />

The Centre will ensure robust implementation <strong>of</strong> <strong>the</strong> online NREGAS<strong>of</strong>t MIS <strong>of</strong> <strong>the</strong> Ministry <strong>of</strong> Rural<br />

Development. It will ensure:<br />

• Technical oversight <strong>for</strong> ongoing monitoring and documentation <strong>of</strong> day to day activities and<br />

reporting to various levels.<br />

• Analysis <strong>of</strong> data on monthly basis and <strong>for</strong>mulating recommendations.<br />

• To address gender mainstreaming in NREGS implementation .<br />

• To generate quality reports and documentation on <strong>the</strong> progress <strong>of</strong> MGNREGS in <strong>the</strong> State.<br />

• To conduct impact evaluation <strong>of</strong> NREGS on periodical basis.<br />

Financial Management:<br />

Financial management is key to <strong>the</strong> implementation <strong>of</strong> MGNREGS. The Centre will facilitate:


• Availability & smooth flow <strong>of</strong> funds at district level and taluka level<br />

• Real time expenditure tracking to ensure that activities are implemented as scheduled and<br />

discrepancies trigger immediate corrective steps.<br />

• Support maintenance <strong>of</strong> accounts as per GOI and State government guidelines<br />

• Undertake analysis <strong>of</strong> variance between physical and financial progress to enable appropriate<br />

action by senior <strong>of</strong>ficials<br />

• Enable timely mandatory audit process at all levels (GP, Block, and District & State) and<br />

compliance.<br />

• To ensure transparency in financial transaction at all levels.<br />

IEC and BCC:<br />

The Centre shall:<br />

• Formulate an effective state wide IEC campaign on MGNREGA, and prepare modules <strong>for</strong> its<br />

dissemination.<br />

• Develop relevant, attractive and suitable IEC materials and reports<br />

• Devise and implement an effective action plan <strong>for</strong> propagating <strong>the</strong> rights <strong>of</strong> NREGA workers and<br />

generating demand among masses <strong>for</strong> work under MGNREGS .<br />

• Develop appropriate advocacy tools to sensitise all categories <strong>of</strong> stakeholders in support <strong>of</strong> <strong>the</strong><br />

scheme<br />

• To monitor <strong>the</strong> implementation <strong>of</strong> IEC / BCC campaign and ensure <strong>the</strong> midcourse corrections if<br />

needed.<br />

Capacity Building :<br />

• To design effective training modules <strong>for</strong> each category <strong>of</strong> stakeholder <strong>of</strong> MGNREGS, with <strong>the</strong> help<br />

<strong>of</strong> SIRD,NIRD.<br />

• To organize ToT Training programmes at District & Block level to create a pool <strong>of</strong> resource persons<br />

in <strong>the</strong> field<br />

• To plan training and refresher training calendar <strong>for</strong> different locations in <strong>the</strong> State <strong>for</strong> all categories<br />

<strong>of</strong> stakeholders <strong>of</strong> <strong>the</strong> Scheme.<br />

• To monitor <strong>the</strong> effectiveness <strong>of</strong> ongoing training programmes.<br />

• To incorporate <strong>the</strong> lessons learnt during implementation <strong>for</strong> improvement <strong>of</strong> training modules.<br />

Request <strong>for</strong> Proposals:<br />

The Comissionerate <strong>of</strong> Rural Development, Government <strong>of</strong> Gujarat, hereby invites pr<strong>of</strong>essionally<br />

competent agencies individually or in consortium to provide <strong><strong>service</strong>s</strong> covering inter alia ,<strong>the</strong> above scope <strong>of</strong><br />

work <strong>for</strong> <strong>the</strong> financial years 2010-11 and 2012-13.<br />

The applicant agency/agencies are required to furnish <strong>the</strong>ir proposed strategy <strong>for</strong> <strong>the</strong> above areas which<br />

should include <strong>the</strong> following:


Approach Paper to clearly establish <strong>the</strong> nature <strong>of</strong> tasks proposed to be undertaken under <strong>the</strong><br />

project.<br />

The deliverables <strong>for</strong> each component along with <strong>the</strong> necessary milestones and timelines.<br />

Estimates <strong>of</strong> <strong>the</strong> total time ef<strong>for</strong>t to be provided <strong>for</strong> <strong>the</strong> project, supported by bar/ chart<br />

diagrams showing <strong>the</strong> time proposed <strong>for</strong> <strong>the</strong> implementation <strong>of</strong> each component with<br />

necessary milestones.<br />

Full particulars <strong>of</strong> <strong>the</strong> constitution, ownership, organizational structure and main activities <strong>of</strong> <strong>the</strong><br />

prospective agencies , including details such as :-;<br />

Unabridged annual reports or audited financial accounts <strong>for</strong> <strong>the</strong> last three years.<br />

Names and short CVs <strong>of</strong> <strong>the</strong> full time & part time pr<strong>of</strong>essionals proposed to be involved in <strong>the</strong><br />

work (<strong>the</strong> CVs would need to be backed by written commitment <strong>of</strong> <strong>the</strong> persons <strong>of</strong> availability <strong>of</strong><br />

<strong>the</strong>ir <strong>service</strong>.)<br />

Details <strong>of</strong> major assignments undertaken <strong>of</strong> a similar nature, during <strong>the</strong> last ten years. Detail <strong>of</strong><br />

partnerships and supporting document <strong>for</strong> <strong>the</strong> same.<br />

Fee structure and rationale <strong>for</strong> <strong>the</strong> same.<br />

Necessary documents required to be furnished along with <strong>the</strong> proposals:<br />

1. Proposal document signed and sealed (with <strong>of</strong>ficial seal) in Original on all pages with all pages<br />

duly numbered.<br />

2. In case applicant firm is a company- Certified copy <strong>of</strong> Certificate <strong>of</strong> incorporation <strong>for</strong><br />

companies & Memorandum and Articles <strong>of</strong> Associations,<br />

Or<br />

3. In case <strong>the</strong> applicant firm is a society- Certified copy <strong>of</strong> registration deed with objects <strong>of</strong><br />

constitution <strong>of</strong> society<br />

Or<br />

4. In case applicant firm is a corporation- Au<strong>the</strong>nticated copy <strong>of</strong> <strong>the</strong> parent statute<br />

Or<br />

5. In case <strong>of</strong> Trust- Certified copy <strong>of</strong> <strong>the</strong> Trust Deed<br />

Or<br />

6. In case <strong>of</strong> Firm- Certified copy <strong>of</strong> <strong>the</strong> Registration Deed Certified copies <strong>of</strong> documents<br />

submitted, as above, must be signed and carry <strong>the</strong> seal <strong>of</strong> <strong>the</strong> authorized signatory.<br />

7. List <strong>of</strong> present Directors/owners/executive council members/trustees/ Board members as<br />

applicable.<br />

Eligibility:<br />

Reputed organizations having an experience <strong>of</strong> at least 3 years in providing <strong><strong>service</strong>s</strong> in <strong>the</strong><br />

designated areas listed above. Organisations having sector specific experience and in house<br />

capability to manage <strong>the</strong> entire assignment will be an added advantage.


Selection Process<br />

The proposals will be evaluated on a quality and cost based selection (QCBS) basis. Technically<br />

acceptable proposals will be ranked according to <strong>the</strong>ir combined technical and financial scores.<br />

The Commissionerate <strong>of</strong> Rural Development is not bound in any manner to select any <strong>of</strong> <strong>the</strong><br />

agency submitting proposals or to select <strong>the</strong> agency <strong>of</strong>fering <strong>the</strong> lower price. The agency achieving<br />

<strong>the</strong> highest combined technical and financial score will get <strong>the</strong> highest rank, followed by o<strong>the</strong>rs.<br />

The firm/firms obtaining <strong>the</strong> highest number scores will be invited <strong>for</strong> presentations with a view to<br />

clarify any outstanding points, to finalize technical and financial arrangements and, in case <strong>of</strong><br />

successful negotiations, to sign a Contract Agreement.<br />

Proposal Evaluation Committee<br />

The above evaluation shall be carried out by an Evaluation Committee to be designated by <strong>the</strong><br />

Rural Development Department , Govt. <strong>of</strong> Gujarat. The Committee shall determine <strong>the</strong> approach<br />

and methodologies <strong>for</strong> <strong>the</strong> evaluation and <strong>the</strong> issues, which may arise during <strong>the</strong> above referred<br />

evaluation exercise and have not been addressed in this Document. The decision <strong>of</strong> <strong>the</strong><br />

Committee shall be final and binding on all <strong>the</strong> participating agencies .<br />

Minimum General Criteria <strong>for</strong> evaluation:<br />

The applicant agencies would be assessed broadly on <strong>the</strong> following criteria :<br />

1. Efficiency and effectiveness, timelines and deliverables <strong>of</strong> <strong>the</strong> <strong><strong>service</strong>s</strong> proposed to be<br />

provided.<br />

2. Methodology and work programme <strong>for</strong> <strong>the</strong> proposed assignment.<br />

3. Credentials <strong>of</strong> <strong>the</strong> organization (Financial and Physical) and constitution,<br />

4. Technical and managerial capability <strong>of</strong> <strong>the</strong> organization,<br />

5. Per<strong>for</strong>mance record <strong>of</strong> <strong>the</strong> last two years, and<br />

6. Experience in <strong>the</strong> field <strong>of</strong> assignment and qualification <strong>of</strong> key team members to be<br />

deployed (full time & part time ,separately).<br />

Proposal Due date :<br />

The <strong>EOI</strong> must be received by <strong>the</strong> Rural Development Department, Block No 16/3 Dr. Jivraj Mehta<br />

Bhavan be<strong>for</strong>e 15 /8/2010 17.00 HRS by speed /Registered Post . The proposal received after<br />

due date and time will not accepted by <strong>the</strong> Department and no communication shall be entertained<br />

in this regard.<br />

Right <strong>of</strong> change and modifications <strong>of</strong> <strong>the</strong> assignment:<br />

Commissioner & Pr. Secretary, Rural Development will reserve <strong>the</strong> right to<br />

change/terminate/modify <strong>the</strong> conditions <strong>of</strong> this document or <strong>the</strong> scope <strong>of</strong> work at any time.


Payment terms:<br />

Appropriate proportion <strong>of</strong> <strong>the</strong> Total Accepted Project Value, due to <strong>the</strong> agency on completion <strong>of</strong><br />

each Quarter <strong>for</strong> which <strong>the</strong> agency has rendered his <strong>service</strong> under this project shall be payable to<br />

<strong>the</strong> agency at <strong>the</strong> end <strong>of</strong> each Quarter. All <strong>the</strong> payments shall be released on certification <strong>of</strong><br />

satisfactory completion <strong>of</strong> work from <strong>the</strong> Rural Development Department.<br />

Penalty clause:<br />

The Commissionerate <strong>of</strong> Rural Development will levy a maximum <strong>of</strong> 10% penalty <strong>of</strong> <strong>the</strong> Total<br />

Accepted Project Value <strong>of</strong> <strong>the</strong> <strong><strong>service</strong>s</strong> to be provided by <strong>the</strong> agency in case <strong>the</strong> agency fails to<br />

provide <strong>the</strong> <strong><strong>service</strong>s</strong> specified by <strong>the</strong> CRD in <strong>the</strong> pre-confirmed time schedule. The quantum <strong>of</strong><br />

penalty shall be decided by <strong>the</strong> CRD and it shall be binding and final. On <strong>the</strong> agency failing to<br />

rectify <strong>the</strong> faults, <strong>the</strong> CRD may get <strong>the</strong>m attended/rectified by any o<strong>the</strong>r agency at <strong>the</strong> risk and<br />

cost <strong>of</strong> <strong>the</strong> agency and <strong>the</strong> same will be recovered from <strong>the</strong> agency . The CRD shall terminate <strong>the</strong><br />

contract on evidence <strong>of</strong> persistent non-per<strong>for</strong>mance by <strong>the</strong> agency by giving one month notice.<br />

The CRD also reserves <strong>the</strong> right to award <strong>the</strong> contract to one or more than one agency and split<br />

<strong>the</strong> work among different agencies.<br />

Contract period:<br />

This <strong>service</strong> shall commence within 15 days from <strong>the</strong> date <strong>of</strong> issuance <strong>of</strong> work order and shall<br />

continue <strong>the</strong>reafter <strong>for</strong> a period <strong>of</strong> two years based on <strong>the</strong> monthly review and results <strong>of</strong> <strong>the</strong><br />

<strong><strong>service</strong>s</strong>. The <strong><strong>service</strong>s</strong> provided by <strong>the</strong> agency/ies shall be reviewed by <strong>the</strong> CRD periodically .<br />

The contract may be extended <strong>for</strong> fur<strong>the</strong>r period as may be mutually decided. The terms and<br />

conditions <strong>for</strong> extension <strong>of</strong> <strong>the</strong> contract may be negotiated.<br />

Termination <strong>of</strong> Contract:<br />

The CRD will have <strong>the</strong> right to cancel <strong>the</strong> contract if <strong>the</strong> agency commits breach <strong>of</strong> any or all<br />

conditions <strong>of</strong> <strong>the</strong> contract. Breach <strong>of</strong> Contract includes, but not limited to, <strong>the</strong> following:<br />

It is found that <strong>the</strong> schedule <strong>of</strong> implementation <strong>of</strong> <strong>the</strong> project is not being adhered to.<br />

The agency stops work and such stoppage has not been authorized by <strong>the</strong> CRD.<br />

The agency may become bankrupt or goes into liquidation o<strong>the</strong>r than <strong>for</strong> project or<br />

amalgamation.<br />

The CRD gives notice to correct a particular defect/irregularity and <strong>the</strong> agency fails to<br />

correct such defects/irregularity within a reasonable period <strong>of</strong> time determined by <strong>the</strong> CRD.<br />

If <strong>the</strong> contract is terminated by <strong>the</strong> CRD Government <strong>of</strong> Gujarat unilaterally, <strong>the</strong> Government will<br />

pay to <strong>the</strong> agency remaining amount, if any, <strong>for</strong> <strong>the</strong> payment <strong>for</strong> <strong>service</strong> charges <strong>for</strong> <strong>the</strong> period <strong>for</strong><br />

which <strong>the</strong> <strong>service</strong> has been rendered and all o<strong>the</strong>r claims through mutually agreeable settlement.<br />

Confidentiality:<br />

The in<strong>for</strong>mation supplied by Commissionerate <strong>of</strong> Rural Development and/or, <strong>the</strong> data collected<br />

during this assignment and final report shall remain <strong>the</strong> sole property <strong>of</strong> <strong>the</strong> Commissionerate <strong>of</strong><br />

Rural Development and <strong>the</strong> agency is not authorized to divulge <strong>the</strong> in<strong>for</strong>mation or publish findings<br />

in any <strong>for</strong>m without <strong>the</strong> prior written permission from <strong>the</strong> Commissioner & Pr. Secretary, Rural<br />

Development Department , Gandhinagar.


Restriction on transfer <strong>of</strong> Rights :<br />

The agency shall not transfer <strong>the</strong> Contract/assignment , partially or fully to anybody except with<br />

<strong>the</strong> prior permission <strong>of</strong> <strong>the</strong> Commissionerate <strong>of</strong> Rural Development<br />
