Onsite Sewage System and General Sewage Sanitation Regulations<br />

SECTION 11:<br />

APPLICATION AND DESIGN REQUIREMENTS – EXISTING<br />

DEVELOPMENT<br />

A. Purpose and Applicability.<br />

1. The purpose <strong>of</strong> the following requirements is to:<br />

a) Establish a standard review procedure for existing development that<br />

must utilize an onsite sewage system for which there is a proposed<br />

and/or implemented modification, expansion, or additional connection<br />

to the existing development;<br />

b) Determine whether or not a project proposal for an existing development<br />

is compatible with the existing onsite sewage system and reserve area;<br />

and<br />

c) Ensure that the project proposal and onsite sewage system are in<br />

compliance, or will be brought into compliance, with applicable <strong>Board</strong> <strong>of</strong><br />

<strong>Health</strong> regulations.<br />

2. It is the intent <strong>of</strong> the following requirements to guide and enable the owner,<br />

owner’s agent, and <strong>Health</strong> Officer to comply with these regulations and to<br />

ensure that the building proposal is compatible with the permitted design<br />

capacity <strong>of</strong> the onsite sewage system serving the property.<br />

3. These regulations apply to the following types <strong>of</strong> situations for existing<br />

development:<br />

a) There is a proposed expansion or modification <strong>of</strong> an existing building or<br />

structure;<br />

b) There is a proposed addition <strong>of</strong> a building or structure;<br />

c) There is proposed replacement <strong>of</strong> an existing building or structure;<br />

d) There is, or has been, a reduction in treatment or dispersal capability <strong>of</strong><br />

the existing onsite sewage system or the reserve area;<br />

e) There is a repair <strong>of</strong> a failing onsite sewage system when there is also a<br />

proposed and/or implemented building or property modification,<br />

expansion, or additional connection to the existing development; or<br />

f) When directed by the <strong>Health</strong> Officer or jurisdictional building or<br />

planning department to address and correct code violations.<br />

4. For repair <strong>of</strong> a failing onsite sewage system, or voluntary improvement or<br />

enhancement <strong>of</strong> a working onsite sewage system when there is no proposed<br />

expansion, modification, additional connection, remodel, or replacement <strong>of</strong><br />
