Onsite Sewage System and General Sewage Sanitation Regulations<br />
SECTION 1:<br />
AUTHORITY, PURPOSE AND OBJECTIVES<br />
A. These regulations are promulgated under the authority <strong>of</strong> Chapters 70.05, 70.118,<br />
70.118A, and 70.46 <strong>of</strong> the Revised Code <strong>of</strong> Washington (RCW), and Chapter 246-<br />
272A <strong>of</strong> the Washington Administrative Code (WAC).<br />
B. The purpose <strong>of</strong> these regulations is to protect, preserve, promote and improve<br />
public health and safety by:<br />
1. Establishing minimum standards <strong>of</strong> sanitation for sewage;<br />
2. Eliminating or minimizing the potential for public exposure to sewage; and<br />
3. Eliminating or minimizing the adverse effects <strong>of</strong> sewage discharges to the<br />
ground, surface water or ground water; back-ups <strong>of</strong> sewage into structures;<br />
or inadequate treatment and control <strong>of</strong> sewage.<br />
C. This ordinance regulates:<br />
1. The location, design, installation, operation, maintenance, monitoring, and<br />
oversight <strong>of</strong> onsite sewage systems (i.e., septic systems) designed or<br />
permitted to handle up to 3,500 gallons per day; and<br />
2. The control and abatement <strong>of</strong> sewage-related nuisances detrimental to public<br />
health.<br />
D. These regulations are intended to coordinate with other applicable state and local<br />
regulations for sewage treatment, conveyance, and control; water supply; solid<br />
waste; food handling; building; land use/land use planning; and critical areas.<br />
E. It is the specific intent <strong>of</strong> this ordinance to place the obligation for complying<br />
with these regulations upon property owners, and/or their authorized agents or<br />
occupants <strong>of</strong> the property, where sewage originates, and/or sewage producers,<br />
sewage contractors, or other persons as applicable under these regulations.<br />
F. It is the intent <strong>of</strong> this ordinance to provide for fair, equal, and reasonable<br />
treatment <strong>of</strong> all persons that are subject to these regulations, and to allow for<br />
<strong>Health</strong> Officer discretion in the application <strong>of</strong> these regulations as they deem<br />
necessary to protect public health. Nothing in these regulations is intended to<br />
abridge or alter the rights <strong>of</strong> action by the state, or by persons that exist in<br />
equality, common law, or other statutes, to abate pollution or a nuisance.<br />
G. No provision or term <strong>of</strong> this ordinance is intended to impose any duty<br />
whatsoever upon the <strong>Health</strong> Officer or <strong>Health</strong> District, or any <strong>of</strong> its <strong>of</strong>ficers or<br />
employees, for whom the implementation or enforcement <strong>of</strong> these regulations<br />
shall be discretionary and not mandatory.<br />
